Frederick, Md, man enters plea to child sex abuse

A Frederick man who entered a plea Thursday to sexually abusing a 9-year-old girl in 2017 faces up to 10 years in prison.
Jose Benito Lopez, 43, was charged with sex abuse of a minor, third- and fourth-degree sex offense, and second-degree assault, online court records show. In Circuit Court this week, Lopez took an Alford plea — in which a defendant does not admit guilt but concedes that the prosecution has enough evidence to get a conviction — to one count of sex abuse of a minor, according to the Frederick County State’s Attorney’s Office.
Sentencing guidelines recommend between five and 10 years of incarceration for this case, state’s attorney spokesman Will Cockey wrote in an email. The sentencing is set for Aug. 24. Lopez will remain out on bail until then. His defense attorney could not be reached for comment Friday afternoon.
In October 2020, the victim came to the Frederick County Child Advocacy Center for an interview, according to charging documents. She detailed three instances of sexual abuse that occurred in a local residence when she was 9, charging documents read. When the child tried to flee, Lopez grabbed her, police wrote.
He told her not to tell and, in an earlier interview with police, denied the allegations, charging documents state.
Parker Co., Tx, Sheriff Seeks Help Locating Child Sex Assault Suspect

The Parker County Sheriff's Office is asking for the public's help in locating a 35-year-old man suspected of child sexual assault.
After a young girl reported repeated sexual abuse, investigators obtained an arrest warrant for Timothy Richard Cisar, 35 for a first-degree felony charge of continuous sexual abuse of a young child.
According to investigators, the victim told a family member Cisar had sexually abused her on numerous occasions over the past two years.
The family member went to law enforcement immediately, authorities said, and after an investigation, the arrest warrant was obtained for Cisar.
But the 35-year-old man fled Texas after the report was made.
Now, authorities believe Cisar may have recently returned to Parker County.
The sheriff's office warned the public not to approach Cisar if he is located and to call law enforcement.

Graysville, Ala, man arrested on child sexual abuse charge in Hoover

HOOVER, Ala. (WBMA) — A Graysville man was charged in a child sexual abuse investigation Thursday following an investigation with the Hoover Police Special Victims Unit.
Police said 42-year-old Jason Baunach was charged after the department received a report of sex abuse involving a child in July.
Police said interviews were conducted with a minor who said they had been sexually abused by a relative.
Police said further investigation revealed Baunach is required to register as a sex offender due to a 2019 conviction in Kentucky of Sexual Abuse 1st degree.
Baunach was arrested for a Alabama Sex Offender Registration and Community Notification Act (SORNA) violation on July 29 and transferred to the Jefferson County Jail in Birmingham.
Police said an additional warrant for Sexual Abuse of a Child Less than 12 was issued by the Jefferson County District Attorney’s Office on Thursday.
Baunach is being held at the Jefferson County Jail on bonds totaling $150,000.00.
Police said additional charges are pending and the investigation is ongoing.

gets a trial date

A Fairfield man charged with multiple counts of child sex assaults has finally learned the date of his jury trial.
Felipe Jesus Rios-Angulo, 32, appeared Friday morning in Department 9 of Solano County Superior Court for a trial setting and heard Judge Carlos R. Gutierrez schedule it for 9 a.m. Oct. 6 in the Justice Center in Fairfield.
But before he faces jurors in the case, filed more than three years ago, Rios-Angulo will return at 8:30 a.m. Sept. 30 for a trial management conference with his defense attorney, Vincent Maher.
A Mexican national, Rios-Angulo, whose date with a jury has been delayed and previously rescheduled over the past year, in part because of the pandemic, is accused of continued sexual abuse of a child under 14 and six counts of lewd acts with a child 14 or 15 years old, among other charges.
His latest court proceeding follows an early January 2019 arraignment on the charges after a December 2018 preliminary hearing.
During the arraignment, Maher noted that his client had been arrested in Sacramento by U.S. Immigration and Customs Enforcement. Rios-Angulo posted a $160,000 bond and was released but he still faces possible deportation.
Maher said that the bond and a previous $255,000 bond related to the sex abuse case had “crippled my client and his family,” and asked the judge, asserting his client was not a flight risk, not to impose an increase in bail in the abuse case.
Citing testimony from the Dec. 4 preliminary hearing, Maher further characterized some of the District Attorney’s charges as vague, adding that the DA’s investigation and the information it yielded may have been inconsistent with the police report.
Gutierrez denied the DA’s request for a bail increase but reminded Rios-Angulo, who remains out of custody, about an existing restraining order not to go near the victim or her family.
In May 2018, Rios-Angulo pleaded not guilty to 18 charges, all felonies, and all involving the same child at various times between 2016 and 2017.
Court records indicate the DA filed a complaint on May 2, 2018. Shortly afterward, on June 21, the court issued a subpoena for records held by the Fairfield-Suisun Unified School District. Rios-Angulo posted the $255,000 bond on June 26.
If convicted on all the charges, Rios-Angulo faces a lengthy state prison sentence.

child sexual abuse case

EASTON — An Easton man accused of sexually abusing a child over the course of several years pleaded guilty to a felony sex offense charge on July 27.
Carlos Lopez-Cruz, 37, entered an Alford plea for a third-degree sex offense charge at a hearing in the Talbot County Circuit Court. The plea does not require the defendant to admit guilt, but acknowledges there’s likely enough evidence for a conviction if the case had gone to trial.
Circuit Judge Stephen Kehoe sentenced Lopez-Cruz to the maximum punishment of 10 years and suspended seven years of the sentence, leaving him to serve three years. Because Lopez-Cruz has been held in the Talbot County Detention Center since August 28, 2020, Kehoe credited him with serving 334 days of his sentence. His total jail term is two years and one month.
The plea hearing is the end to a multi-year child sexual abuse case. The victim, now a teenage girl, originally filed the report with the Cambridge Police Department, who forwarded it to the Talbot County Sheriff’s Office. Following the report, Lopez-Cruz was arrested and taken into custody in August 2020.
Lopez-Cruz’s attorney, Talbot County public defender Holland Brownley, gave the court background and history on him prior to sentencing. Lopez-Cruz was born and raised in El Salvador and came to the U.S. in 2003. He’s lived in Talbot County for almost the entire time he’s been in the country.
Brownley asked the court to give Lopez-Cruz credit for time served so far and suspend any time remaining, saying that when his case is resolved, he expects to be deported. Court documents indicated that Lopez-Cruz pleaded guilty to the count because he believed it was in his best interest.

Prior to sentencing, Lopez-Cruz made an allocution statement — a formal opportunity to address the court, express remorse for actions and explain personal circumstances to be considered in sentencing.
“This time I’ve spent here has not been easy,” Lopez-Cruz said through an interpreter. “At the beginning when I came to this place, I didn’t understand many things; the first few days when I came to this place, I kept hearing a voice telling me to kill myself, to take my life, to kill myself.”

He explained that after some time in the detention center, he started reading the Bible to try to understand things. In June, there came a moment when he asked the Lord to help him in this situation and he awakened to hear a voice talking to him in something that “felt like an out of body experience.”
“This voice talked to me and I was impacted and surprised. At that moment I heard a voice that said you’re going to be out of here soon,” he said.
Lopez-Cruz continued to detail his experience, explaining the darkness he saw and the fearfulness he felt prior to seeing a light and coming back to his body. He reported that when he looked at the clock, only an hour had passed.
“I understand now that God’s plans are perfect and I know that I will be deported, but that God has a plan.”
Kehoe considered the nature of the abuses and the age of the victim during the crimes. The victim was still in elementary school at the start of the abuse.
“What troubles me is that this was a repeated set of events that occurred over several years — that will have a lingering effect on the victim,” he said prior to sentencing.
The repeated nature of the abuse led Kehoe to hand down a 10-year sentence with all but three years suspended. He agreed to Brownley’s request to give Lopez-Cruz credit for time already served. Following this conviction, the state entered a nolle prosequi for the three other sex abuse charges.
As part of the plea agreement, Lopez-Cruz will be placed on probation and supervised by the Sexual Offender Management Team for five years after his release. Progress reports will be submitted to the circuit court and local law enforcement every six months. After his release, he will also be required to register as a Tier III sex offender in Maryland — a lifetime registration.
Lopez-Cruz will have to comply with all conditions and supervision during his probation, as well as specific regulations under the state’s sex offender registration laws. He’s also barred from having any contact with the victim and her family.
