Nowhere is safe for children as perverts roam homes freely in Nairobi

The first time it happened, he told her it is a game. He fondled her and said it was their special moment they should secretly share when nobody was around.

She was nine years old. The stepfather who is a matatu driver was always home early. Her mother, a food vendor in Kawangware was always away.

“I was afraid, but he kept warning me that if anyone knew, he would kill my mother and something bad will happen to me,” she says.

With time, he became more daring. The evening when he went beyond touching and raped her, he told her it was because she was special. She cried afterwards, but he reminded her that she cannot tell anyone. Then vaginal itching started, followed by heavy bleeding.

“When she told her mother that she was having a discharge, he took a Bible and swore that he did not do it,” says the girl’s aunt.

They believed him. He continued to defile her as he had been doing even before the Covid-19 pandemic, and people had started noticing that she had changed.

“The teachers would tell us that she would get startled easily, and she barely concentrated in class,” says the girl’s aunt. When schools closed due to the pandemic, she went to visit her aunt, and it is then that she revealed what she was going through.

It is at Nairobi Women’s Hospital that they were hit with the reality of what the little girl had gone through. Vaginal infection, torn private parts, bleeding uterus, and heavy psychological torture were among the conditions she was treated for. The police arrested the man but he was released soon after.

“We were told cells are full, and because of coronavirus, they could not hold him,” says the girl’s aunt.

They now live in anxiety. The man hovers close, so the girl rarely leaves home. She takes a lot of medication, but her aunt says she prefers to sit alone, lost in her own thoughts.

“She is 10-years-old but has gone through so much. It is sad that the person who did it is free. We worry that he might harm her, so she never leaves the house. It is not the right way for a child to live,” says the aunt.

Hit her mother

Looking back, the aunt admits that the signs were all there. The clinginess and refusal to go home whenever the girl visited relatives should have made them dig deeper. The man had instructed the girl never to visit people.

“He would turn violent and hit her mother whenever he found out my niece had visited us. One time, she wanted to spend the night at her grandmother’s home, and the man got so furious, she had to be taken home at night,” she says.

Psychologists say most abusers always alienate their victims from the public. Sylvanus Wambani, a counsellor, notes one of the earliest signs that a child is being sexually abused by someone close to them is when the person gets paranoid about the child interacting with adults.

“They fear that the child will reveal the abuse to other adults. Some of them even pull the children out of school because teachers are always the first to notice abuse in children,” he says.

Sadly, he says that most of the sexual abuse cases are perpetrated by people close to the child. Even more confounding, Wambani notes is the fact that families prefer out of court settlement cases of sexual abuse to be handled without the involvement of authorities.

He adds that other signs of abuse are the child secluding themselves or becoming clingy to people they feel might save them from the situation.

Martha Sunda, director of Childline Kenya, an organisation that works with the government to stop child abuse paints a grim picture on the number of children who report sexual abuse.

“Since the set up of the Child Helpline in Kenya, the highest reported form of child abuse was child neglect consistently. This narrative has changed with the onset of Covid-19. In this season, defilement cases have skyrocketed, accounting for at least 63 new cases reported every month. This is alarming,” she says.

Face stigma

According to the agency’s data in the last few months, 32 children of up to 5 years old, 71 aged between 6 and 10 years, and 277 children aged between 11 and 17 years were sexually abused. The number, she says, is higher since most children rarely report sexual abuse.

She urges teachers to encourage children, even when using online learning platforms, to report cases of abuse.

Data from the latest Violence Against Children report by the Ministry of Labour and Social Protection Services indicates that two-thirds of females who experienced childhood sexual violence are likely to be victims again before they turn 18.

Those who report are likely to face stigma. The girl’s aunt says she has to look for a new school for her niece.

“She says she does not want to go back to her former school, because when the man was arrested at home, some of her classmates saw, and word went round,” she says.

While launching the report in July, Labour and Social Protection Cabinet Secretary Simon Chelugui said sexual violence experienced by girls aged between 13 and 17 years has increased.

A TEACHER was today jailed for more than two years after sexually abusing a 15-year-old pupil who considered genital mutilation to escape her.

Fay Mcrobbie was 25 when she groomed the teenager at her school in Berkshire.

Reading Crown Court heard she forced the youngster to join her martial arts class where she kissed him. She later took his virginity at a friend's house.

But the schoolboy was so devastated by her demands, he admitted considering sexual harming to make himself less attractive to her.

The court was told how Mcrobbie, now 32, had planned a future for the pair before he ended their two-year relationship.

PUPIL AFFAIR

He claimed he did not love the learning support assistant anymore and when she found out he was starting a relationship with a girl of his own age she penned a letter threatening to kill herself.

The pupil, now 22, stood up in Crown Court to express how the teacher's controlling behaviour had deeply affected him.

He said: "Fay was relying on me emotionally, I felt responsible for her feelings. She would turn to me if she was feeling sad, I had started to distance myself from my friends and family.

"The relationship only got worse, arguments were getting more frequent and the reasons were getting more silly each time. I was becoming severely depressed as I could not speak to anyone, Fay was my only friend.

"I told her I did not love her anymore. She broke down saying she could not continue life if we were not together, she told me she wanted to kill herself. At the time I would have done anything to get her away from me, I even considered genital mutilation."

"Fay found out about my new girlfriend and she went crazy. She made it her mission to break us apart. At the time I would have done anything to get her away from me, I even considered genital mutilation - I thought if I had nothing there to interest her then she might leave me alone."

The pupil, who cannot be named for legal reasons, added: “I felt I wanted to run away, I was very much not ready, it was the first time I was naked in front of someone else. I felt dirty, I could not stand the sight of myself in the mirror and I felt my innocence had been taken away."

After the relationship had turned sour, the victim later disclosed his secret to an employer who, with his permission, informed police.

Mcrobbie was arrested on May 16 2019 and gave a "no comment" interview but later admitted three counts of causing a child to engage in sexual activity.

Defending the sobbing teacher, Robert Slinn, said: "Fay is appalled by her actions.

'YOU GROOMED HIM'

“She knew it was damaging at the time but she was fatalistic in her own view."

In sentencing Mcrobbie, Judge Paul Dugdale said: "The victim was 10 years younger than you when you first got involved with him. There is no doubt that you groomed him. You were in a position of trust as his teacher and you treated him like your boyfriend.

"You placed further pressure writing to him telling him and his girlfriend that you were going to kill yourself.

“The reality is not only were you acting in breach of trust, having a sexual relationship with a pupil 10 years younger than you, you were behaving in a controlling coercive way towards him because of the perception that you were in a relationship and you needed him to support you in the difficulties in your life.

"You used him for that purpose as well as using him for your own sexual gratification. He was not remotely able to deal with it and you caused a lot of damage.”

Mcrobbie, of Wallingford, Oxfordshire, was jailed for two years and four months and will be subject to a Sexual Harm Prevention Order for 10 years.

A STUDENT bit off an armed robber's penis after he allegedly broke into her room and forced her to perform oral sex, according to reports.

Emmanuel Ankron, 23, has been accused of raping the 24-year-old woman after he turned up at hospital covered in blood in Ghana.

The woman told police she woke to find a man breaking into her room while holding a sword in Obuasi at 2.30am on Saturday.

She says he drugged and raped her and then stole her TV, mobile phone and cash, reports the BBC.

He went to leave with the stolen items - but then returned and attempted to rape her a second time, it is alleged.

It was then that she bit hard on his penis, reportedly severing it from his body.

The organ was retrieved by police and sent to the hospital for possible reattachment, according to reports.

Ankron was arrested after turning up at the same hospital where his alleged victim was being treated for her injuries.

She is said to have recognised him at the clinic and told police.

The woman told local ADOM TV after she was released from hospital: "Around 2.30am, I was sleeping and I heard someone hitting my window and the person finally broke into the room - I saw him holding a cutlass.

"So when I woke up and asked him what he was coming here to do, he responded that he was coming to steal. Before I knew, he reached for my panties and (raped) me.

"He took my phone and money. So I pleaded with him to take the things, but he shouldn’t kill me. And he said before he leaves, he must have another round again."

She said she bit him as hard as she could, and he reacted by biting her on the back before running away.

A police statement reported by local media says: "The suspect, with blood oozing from the wound, ran away leaving the TV set and her mobile phone behind."

Penticton, B.C. man will spend 18 months behind bars for

collection of 27,000 images of child sexual abuse

A Penticton man who pleaded guilty to collecting a stash of nearly 27,000 images and videos of child sexual abuse will spend 18 months in jail for his crime. 

In court Monday, Judge Gregory Koturbash handed down his sentence to Kenneth Daniel Large, 49. 

Large had previously admitted to his criminal collection and self-described compulsion. He was caught with his stash in October 2018, after the blog website Tumblr alerted authorities to potential child porn activity from an account registered to Large.

An RCMP search warrant executed on his phones, computers and other electronics revealed 26,366 images and clips of sexual abuse, some involving children as young as 6.

Crown counsel Ann Lerchs sought two years in jail for Large, followed by two years of probation, while Large's lawyer James Pennington argued for a two-year conditional sentence to be served in the community. 

But Koturbash decided a conditional sentence would not do, given the volume and graphic nature of the collection, and the fact that a term of house arrest served in the very basement of his parents' house where Large spent so much of his time amassing the images in the first place did not seem like much of a punishment. 

"There is nothing within my power that would redress the harm done [to the victims in the images]," Koturbash said. "The only way to acknowledge the harm is to send him to jail."

He added that the sentence should be a deterrent to others, to send "a message that if you are caught you will go to jail."

Koturbash did not go as high as two years in his sentence, noting mitigating factors like a prompt guilty plea, Large's past two years on bail with no breaches, expression of remorse and his history of seeking counselling.

He also noted in his sentencing that Large did not create the images and videos in question.

Large was escorted out of the courtroom in handcuffs to begin his 18 months of incarceration. Following that, Large will have strict probation requirements for three years, including limiting his allowed uses of the internet and access to children under 16. 

He will also have a 10-year ban on attending any public space where children under 16 could reasonably be, and will be on the sex offender registry for 20 years. 

Magnum Continued to Sell Photographs of Vulnerable Children,

Including Sexually Explicit Images

Three months after announcing an inquiry into its archive, it emerged that Magnum Photos was still selling sexually explicit images of what appear to be children through third-party websites. An image of a half-naked child playing with their genitals was also available for purchase. Further images described as “juvenile prostitutes” were still for sale on the Magnum website itself until they were removed on Friday.

Magnum temporarily took its archive offline in August and a number of images by photographer David Alan Harvey were withdrawn. Shortly afterwards, Magnum’s president, Olivia Arthur, announced an internal review. Despite this, Harvey’s sexually explicit photographs — tagged “teenage girl - 13 to 18” — were this week still available for purchase through third-party websites that license the photographs from Magnum.

A number of images by Patrick Zachmann appear to have been removed from Magnum’s archive on Friday afternoon (November 6) after concerns were raised on Twitter.

Perhaps most problematic is a photograph by Zachmann that shows a young child (described by the metadata as 0-3 years old), drinking from a bottle of milk, naked from the waist down, and holding his penis. The image is accompanied by the title “FRANCE. Paris. Summer 2001” and is presented without further context. It was available to purchase without any restrictions until it was removed from the Magnum website on Friday November 6, but it remained available to purchase as of Monday November 9 through a third-party website.

Three images featured identifiable children photographed in 1993 during a police raid in Thailand on what is described in the caption as a “‘gay’ beach.” Several photographs describe the children — whose faces are visible — as “juvenile prostitutes.”

In the U.K., victims of sexual offenses must be kept anonymous in order to protect the victim from the potential of further trauma. It is now widely understood that children cannot be “prostitutes” but are instead victims of sexual exploitation and abuse.

When asked about the removal of images from its archive last week and the continued presence of problematic images on third-party websites, Magnum provided the following statement:

Magnum announced earlier this year that we were embarking on a re-examination of our past archives, with outside guidance. Progress has already been made, but with almost one million images sitting across many different platforms and millions more tags amassed across our 73 year history, this was never going to be a quick process.

Everyone at Magnum remains committed to ensuring we carefully examine our archives to ensure we fully understand the implications of past work, both in terms of imagery and context. Images and tags that have been found to be inappropriate have been removed, but there remains much work to be done. This is a journey with plenty of road ahead of us.

Magnum photographers are assisting by looking at their own archives and highlighting any problematic images. We are also grateful to others outside the organisation who have brought to our attention additional materials that the review has not yet addressed.

To be clear, Magnum is a rights-managed business and images are not licensed without the express permission of photographers and the company. We often refuse requests to license sensitive images and we always require them to be used responsibly in appropriate context as part of our usage agreement.

When asked previously, Magnum offered no comment on whether it had appointed the outside guidance mentioned in its statement on August 14. It also would not comment on whether it has been in contact with law enforcement.

In August, Magnum explained that while its inquiry into Harvey’s photographs was ongoing, the assumption that Harvey's photographs might feature sexually exploited children was not correct. “It seems that at some point mis-tagging of these photos has led you to a mistaken conclusion that they represent something they do not,” Magnum stated in an email. The spokesperson for Magnum later clarified that “the review remains ongoing and Magnum has not reached a conclusion or made an assertion.”

Last month, in a separate issue relating to a historical accusation, Harvey was suspended by Magnum for one year following an investigation. A statement posted on the Magnum website explained that the investigation was carried out “by an independent investigator, Magnum’s board, with the assistance of outside legal counsel” and has “concluded that the behaviour represented a breach of its code of conduct and by-laws.”

Magnum has repeatedly refused to make its code of conduct public, stating that it is a confidential document.

92 y/o man jailed for sexual assault in Dorchester in 1980s

A 92-year-old man has been jailed for more than five years after he was convicted of sexually assaulting a young girl in the 1980s.

Formerly a successful businessman, Eric Alan Amey, from Puddletown, was sentenced today at Bournemouth Crown Court, days after being convicted of four counts of indecent assault of a child aged under 12.

The offences occurred on one occasion at some time between July 10 1984 and July 10 1988 in the Puddletown and Crossways areas.

Today, Amey was sentenced to five years and three months in prison. He has also been placed on the Sex Offenders Register for life.

Amey was a successful businessman in the local community and was well-known under the nickname 'Giant'.

Police officers said they hoped Amey's jail sentence would give some sense of closure to the victim and her relatives.

Detective Constable Holly Spillman, of Weymouth CID, said: "Eric Amey has been given a custodial sentence for the crimes he subjected his victim to.

"This offending has had a profound impact on the victim’s life and the lives of her close family. I hope the fact he has now been brought to justice will bring her the sense of closure she deserves.

"I would like to pay tribute to the victim for her bravery in coming forward, reporting these offences to Dorset Police and giving evidence in court.

"I would also like to commend the witnesses who gave evidence at the trial for the strength and courage they demonstrated throughout.

"I hope that the outcome of this case will give any other victims of sexual abuse the confidence to report offences, no matter when they were committed."

Former Bethel, Ak school principal pleads guilty to federal charge of

attempted child sexual coercion

BETHEL — A former Alaska elementary school principal reached an agreement with prosecutors to plead guilty to federal charges of attempted sexual coercion of a minor, court documents said.

The plea agreement with Christopher Carmichael was entered into court records Friday, KYUK-AM reported. Carmichael signed the plea agreement Nov. 3., according to court records. His Anchorage-based attorney Allen Dayan, declined comment on Monday.

The former principal of Gladys Jung Elementary School in Bethel will plead guilty to knowingly attempting to persuade, induce, entice or coerce a minor to engage in sexual activity, the agreement said.

A federal grand jury indicted Carmichael on three other charges including a second count of attempted coercion of a minor, one count of possession of child pornography and one count of attempted transfer of obscene material to a minor.

Those three charges will be dropped in the plea deal.

Carmichael was arrested in December 2019 by the FBI’s Child Exploitation Task Force.

A 14-year-old girl claimed in June 2019 that Carmichael sexually assaulted her. Police in Bethel investigated by posing as the girl’s 13-year-old cousin and messaging Carmichael online.

The former principal replied with sexually explicit messages and asked for a meeting in Anchorage with what he believed to be the 13-year-old girl, authorities said.

The maximum penalty for the charges are no less than 10 years and up to life in prison and a fine of $250,000. Carmichael will also have to register as a sex offender.

The state of Alaska separately charged Carmichael with two counts of sexual abuse of a minor. The charges are still being processed in the court system and Carmichael’s next hearing is scheduled for Dec. 17.

Attorneys for four girls have filed lawsuits against the Lower Kuskokwim School District claiming the district failed to protect them from sexual abuse by Carmichael. Jury trials for the lawsuits are scheduled to begin in the fall of 2021.

Abbeville, SC man faces charges of sexual exploitation of a minor

An Abbeville County man is facing 11 counts connected to the sexual exploitation of minors, according to a news release from the state Attorney General's Office.

Benjamin Davis Henderson, 34, of Abbeville was arrested Nov. 3 and charged with three counts of first-degree sexual exploitation of a minor, three counts of second-degree sexual exploitation of a minor, and five counts of third-degree sexual exploitation of a minor.

Investigators followed up on an online tip from the National Center for Missing and Exploited Children, which led them to Henderson, the release said. He is accused of creating, distributing and possessing files of child sexual abuse material — a phrase the state Attorney General's office and others have been using to replace "child pornography," citing that the word pornography might imply the child was a consenting participant.

Investigators from the state Internet Crimes Against Children Task Force paired with the Abbeville County Sheriff's Office and Homeland Security Investigations to aid in this case, the release said. 

Two East Bay men charged with cyberstalking, sexually extorting children; feds say there are at least 21 victims, youngest was 11 years old

OAKLAND — Two East Bay residents have been charged with cyberstalking and extorting sexual imagery from children as young as 11 years old, and authorities say they continue to search for potential victims.

Delaney Tang, 21, of Oakland, and Vincenz Sison, of Concord, were charged last week with solicitation of child pornography and conspiracy to commit cyberstalking, two federal offenses. The child pornography charge alone carries a minimum term of five years and a maximum 20-year penalty, along with a fine of up to $250,000, court records show.

In the charging records, authorities say they believe there at least 21 victims. So far, eight — residents of California and other states — have been identified, according to San Francisco police.

The criminal complaint describes Tang as the primary offender, alleging that he reached out to girls online for child sexual abuse material, and threatened numerous times to “expose” them if they didn’t film themselves committing various sex acts. Sison, meanwhile, is described by authorities as an accomplice; the complaint alleges that when the victims would block Tang’s social media accounts, he would ask Sison to reach out to them with threats.

At a Nov. 4 hearing, U.S. Magistrate Judge Jacqueline Scott Corley granted Sison’s release from jail on a $75,000 bond, court records show. Tang remains in Santa Rita Jail in Dublin on a no-bail hold.

According to the criminal complaint, Tang was blunt about his desire for customized child pornography from the girls. Later, when police interviewed Tang, he confessed, authorities said.

During his police interview, Tang claimed he thought the girls were all around 16 years old, according to the complaint. But police say that he knew some of the victims were much younger, allegedly replying, “so?” when one girl told him she was in middle school.

A girl younger than 13 allegedly told Tang she was crying on social media, in an attempt to rebuff his threats. “I don’t care,” Tang allegedly wrote back. “You did this to yourself.”

According to the complaint, Tang demanded victims send him various images and videos of themselves “until I’m bored of you,” and reached out to their also-underage male friends to participate in the videos with the girls.

Tang allegedly told one girl, listed in court records only as “Minor Victim 6,” that she had to comply with his sexual demands “or I could expose you to yoir (sic) classmates.”

Minor Victim 6 allegedly sent Tang at least 100 sexually explicit photos and videos, but stopped talking to him late last year. In response, he posted the videos and pictures online, making good on his threat against her, the complaint alleges.

On September 25, police served search warrants on both Tang and Sison, and interviewed them, with different results.

“Tang said that he successfully extorted 20-30 girls over approximately two years. He said that knew what he was doing was illegal and that his victims were all underage,” San Francisco police Sgt. Christopher Servat wrote in the complaint. Sison, meanwhile, “claimed that he was trying to investigate the accounts’ online activities because he knew that they were targeting minors. However, when officers confronted Sison with messages showing that he actively conspired with Tang, he could not explain his actions,” Servat wrote.

Police say they are still looking to identify 13 additional victims whose names they do not know, and are investigating the possibility that additional victims exist. They have advised members of the public to report activity involving specific Instagram screen names: thedrunkg1raffe, jimmynguyen0950, anthonytran800, bobbychao5150, davidnguyen850, kevin_luong5150, brianchao0150, and delaneyytang.

Authorities are encouraging any potential victims or people with information on Tang or Sison to contact the SFPD Special Victims Unit at 415-558-5500.

Father sues Carmel Clay Schools, alleging his child wasn't protected from sexual assaults

The father of a special education student is suing Carmel Clay Schools because he believes the district failed to protect and adequately supervise his child and other students, leading to his child being allegedly sexually assaulted.

Per the lawsuit, the father said the school, principal, law enforcement officers and a hospital knew of the alleged sexual abuse as early as May 2019 but did not report it.

“They didn’t tell me and they didn’t tell DCS,” he told the IndyStar. “If this was reported in May, if I was notified in May, we could have helped her more. I would have gotten proper therapy that centers around victims of sexual abuse.”

The father is not being named by IndyStar to protect the identity of his minor daughter. 

The alleged sexual assault happened when the student was 13, so because of her age and disability, the student is not able to consent, the lawsuit states.

According to the lawsuit, the student has “Oppositional Defiant Disorder, Anxiety Disorder, and Attention Deficit Hyperactivity Disorder” and is under the care of a psychiatrist, takes medication and has been to the hospital at least three times for inpatient mental health treatment.

Her father said that due to her disabilities she often struggles to communicate what she has experienced, which made her more vulnerable.

“People who work with children with disabilities need to know what their obligations are in reporting,” he said. “These children are vulnerable, and they need to be protected.”

Carmel Clay Schools responded to the allegations in a statement to IndyStar.

"The facts we have gathered regarding this claim are very different from what is being alleged by (the father)," Carmel Clay Schools said in its regarding the lawsuit. "We will respect the privacy of all involved and follow the appropriate legal process to respond to these allegations."

The alleged assault

Somewhere between January and February 2019, the lawsuit alleges that the student was forced to perform oral sex on a male student and allow him to touch her chest in an area of the classroom called “the fort” that the resource teacher allowed the students to build. 

The student said she told multiple teachers as well as the principal and school resource officer what happed, per the lawsuit. But the father said he was not notified.

NASHVILLE, Tenn. — A Tennessee paramedic is accused of possessing and sending sexually exploitative images and videos of children using an instant messaging app accessed from his employer's IP address. 

A Vanderbilt University Medical Center spokesperson said Dylan Wilson, a paramedic at the hospital, was placed on administrative leave after he was arrested Sunday on two counts of sexual exploitation of a minor, according to WKRN. 

Wilson allegedly used the instant messaging app Kik to possess and send 24 images and 29 videos of children as young as four involved in sexual activity, according to his arrest warrant. The Tennessee Bureau of Investigation opened a case on Wilson's online activity after receiving a tip from the National Center for Missing and Exploited Children. 

Investigators said IP addresses from Vanderbilt University Medical Center, Air Methods and Verizon Wireless were used to access the profile containing the images. 

Wilson's bond was set at $100,000. 

Wyoming Man Loses Appeal of Scotts Bluff Co. Child Sex Assault Conviction

A 69-year-old Guernsey man who was sentenced to 12 to 20 years in prison for sexually assaulting a 14-year-old girl in Scotts Bluff County has lost his appeal to the Nebraska Supreme Court.

Last year, Larry Senteney was found guilty on two counts of 3rd Degree Sexual Assault of a Child, one count of Attempted 1st Degree Assault of a Minor, and an additional Class 3A Felony sex crime. In his appeal, he claims the deputy that first interviewed him should not have been able to testify about his demeanor during questioning…as well as the sentences being excessive.

The high court ruled that Scotts Bluff County Court did not commit plain error by allowing the deputy’s testimony, and the sentences were not an abuse of discretion and within sentencing guidelines.

Both his convictions and sentences were upheld following the ruling.

Dubai: A Dubai maid has alleged that she was raped by her employer while she was sleeping and that she woke up in the middle of the act as she was a heavy sleeper.

The 30-year-old maid from Angola told the Dubai Court of First Instance on Monday that the 36-year-old Pakistani defendant raped her while she was sleeping inside her room at the defendant’s house in Al Barsha. The incident occurred in August this year when she had not locked the door of her room.

“I woke up to see him naked on the bed. I asked him to leave and I rushed out of the house crying. I then alerted Dubai Police. I’m a heavy sleeper and didn’t feel the defendant while he was touching my body,” said the maid in official records.

A 26-year-old Emirati policeman testified that he saw the victim outside the villa crying and told him that her employer raped her.

“The defendant admitted that he entered the room to change the door’s locker when he saw her sleeping. He said that she was only wearing a black shirt on her body,” the policeman said in records.

During interrogation, the defendant claimed that he thought she wanted to have sex with him as he saw her sleeping without any underwear.

Dubai Public Prosecution charged the defendant with raping the victim.

The defendant failed to show up in court.

Dubai: A Dubai visitor has been accused of molesting an Indian housewife by touching her inappropriately inside an elevator.

The Dubai Court of First Instance heard on Sunday that the 39-year-old Indian visitor followed his countrywoman into the lift at a residential building in Al Nahda before touching her breast.

The 32-year-old Indian housewife testified that she was walking to her residence at 10pm when she felt the defendant following her. “I entered the lift of my building and he followed me in. We were alone and he touched my body. I yelled when the door opened and escaped to my apartment,” said the woman in official records.

She said she alerted her husband who called Dubai Police. During interrogation, the defendant, who was traced, admitted to abusing the victim. Dubai Public Prosecution has charged the defendant with sexually molesting the victim. The next hearing in the case is scheduled for December 27.

Karachi: Police have rescued 13-year-old Christian girl Arzoo Masih who was allegedly abducted in Karachi and forcefully converted to Islam and unlawfully married to a 44-year-old Muslim neighbour.

Sindh Law and Environment Adviser Barrister Murtaza Wahab, who also acts as the spokesman for the Sindh government, made an announcement to this effect on Twitter.

Wahab said earlier the Sindh High Court, on an application made by the Sindh Government, had ordered the police to locate Arzoo within five days and shift her to a shelter home.

The police said the Christian girl had been rescued safely while the police arrested her alleged husband. The girl is being sent to a shelter home as per the directive of the court.

She will be produced before the court on the date of the next hearing - November 5 - while a medical test will be conducted to know her exact age.

Arzoo had gone missing last month from her home in Railway Colony near Karachi’s Cantonment Railway Station.

Speaking at a press conference, Central President of Minorities’ Wing of Pakistan Tehreek-e-Insaf, Shunila Ruth, said that a false affidavit had been prepared to show that Arzoo was 18.

She said the Sindh government should have taken action swiftly to rescue the minor after she went missing. She said that marrying a minor girl was an unlawful act.

Leader of Opposition in Sindh Assembly, Firdous Shamim Naqvi, who also belongs to the PTI, said the provincial government should punish the persons who violated the Sindh Child Marriages’ Restrain Act of 2013.

He said all the persons who had facilitated the marriage of the underage girl should be arrested. He said members of religious minorities had been facing several issues in the province related to the human rights.

Punjab Minister for Minorities and Human Rights, Ejaz Alam Augustine, condemned the negligence and dereliction of duty on the part of the Sindh government in Arzoo’s case.

He said the Sindh government had failed to act upon its own laws to give due protection to minorities.

Sindh Governor Imran Ismail also met a delegation of the minorities and stated that the government would not do any compromise on the issue of underage marriages. He assured the delegation that the issue of Arzoo would be resolved in accordance with the law.

TWO women were allegedly gang-raped and assaulted at a police station by a dozen COPS after being arrested in Sonipat, India.

A woman and her underaged cousin were accused in the murder case of two policemen - but it has now been claimed that they were gang-raped and molested while in police custody.

The two girls were part of a group of six people accused of murdering the policemen - and were taken to Baroda police station in July, according to The Print.

But one of the victim's mothers claimed that during their custody period, the pair were gang-raped and assaulted by cops.

The older girl was allegedly raped by dozens of policemen, while her underaged cousin was stripped and assaulted, reported The Hindu.

According to the mum, objects were also used during the horrific assault while they were in police custody.

The mother told ThePrint: "The police officials inserted wood sticks, bottles and fingers in their private parts."

After complaining that they were bleeding, the two girls had a medical exam at the Karnal Civil Hospital.

Narendra Chikara, the lawyer representing the women in the gang-rape case, said that the medical examinations don’t indicate sexual assault, "but there are other evidence of the assault which will substantiate the girls’ claims."

ARREST ORDEAL

Over the last two weeks, the case has drawn the attention of the National Human Rights Commission. Bekhauf Azaadi, Chandigarh-based women collective, has now ordered for immediate medical attention for the two girls and an independent probe.

Their report said: "At a time when we are witnessing erosion of long fought rights of survivors in matters of sexual violence whether it is in Hathras incident or Gurmandi case in Delhi, it is all the more important to recognise that patriarchy creates conditions that makes it more difficult to believe survivors in such matters.

"The custodial and caste violence, actions of the police officers, continued harassment of the family members, cannot be ignored and need to be condemned.

"At each step, these police officers belonging to dominant caste have tried to intimidate the family by making assertions that they will never be able to prove anything against the police officers."

This comes after a young female patient in an Indian hospital was allegedly gang-raped by a doctor and staff and then murdered.

Shortly before she died, the 20-year-old reportedly called her parents to tell them she had been brutally sexually assaulted by the medic and other employees.

A rape occurs every 15 minutes and 90 each day on average — according to government data. Large numbers are also feared to go unreported as women do not feel like they can go to the authorities.

Huge demonstrations have been held calling for action. But although the authorities have responded with tougher penalties, India's rape crisis shows no sign of abating.

A SHOPKEEPER dad has today admitted slitting the throats of his two young children during lockdown as his customers "upset" him.

Three-year-old Nigish Nithiyakumar and 19-month-old Pavinya Nithiyakumar were found dead at their home in Ilford, East London.

The children's mother Nisa was in the shower at the time of the knife attack in April and alerted police.

Horrified neighbours heard "tortured" screams coming from the house as Nisa shouted: "Help me".

Dad Nadarajah Nithiyakumar, 41, today pleaded guilty to manslaughter by diminished responsibility at the Old Bailey.

He had been charged with murder after receiving treatment for knife wounds.

Mum Nisa wept in court as her husband's plea was accepted by the prosecution.

KNIFE ATTACK

The court was told shop worker Nithiyakumar was depressed and had been "upset" by his customers.

He told police he thought about killing himself but believed it would "ruin the children's lives and they would go off the rails".

Instead, he cut the throats of both his kids then turned the knife on himself.

So, out of fear that the children would go 'off the rails', he creates a train wreck! Good Grief!

Pavinya was pronounced dead at the scene at 5.53pm and Nigish was rushed to Royal London Hospital where he was pronounced dead at 7.42pm.

Nithiyakumar was arrested on April 29 while receiving treatment and charged with murder after he was discharged from hospital.

The court was told he suffered from a delusional disorder but was receiving "very little treatment".

Prosecutor Duncan Atkinson QC said one expert found it "remarkable he was able to function for as long as he did".

He added: "It was clear it was that disorder that led him to kill his children."

'TORTURED SCREAMS'

Speaking at the time of the knife attack, neighbour Reshna Begum, said she heard screaming coming from the house.

"She said: "I knew something horrible must have happened, it went on for about 10 minutes." Ms Begum said she later saw medics carrying a "little body" in a bag outside.

She added: "My heart just sank, it's devastating, horrific. From a mother's perspective I'm still shaken from it, I can't imagine what she feels at the moment."

Another local, retired builder Thomas Dodds, 78, also told of his horror at the deaths.

Mr Dodds said: "I could tell something awful had happened from the high-pitched screaming. There was lots of screaming and panicking and then it just stopped."

Mrs Justice Cutts adjourned sentencing until December 10 and said she will consider a hospital order.

Nithiyakumar was sent back to the medium secure mental health centre in East London where he is being treated.

This week, the family of a 19-year-old girl in the Indian city of Mumbai strangled her and later dumped her body on a beach, thinking she had died. On Sunday, a farmer who was passing by noticed the girl lying unconscious in the bushes at Suruchi beach in Vasai.

The farmer informed the local police, who took her to a nearby hospital. The girl regained consciousness and started crying, and later narrated her ordeal to the police.

She told them that her parents recently found out that she was in a relationship and were unhappy about it. According to the police, the family was opposed to the relationship and tried dissuading her against it. But, she was persistent about marrying the man.

On Sunday, on the pretext of going out for a walk, her parents and elder brother allegedly took her to the beach before noon. She alleged that they tried to strangle her using the dupatta (scarf) that she was wearing. Assuming that she was dead, they dumped her in the bushes and returned to their residence in Vasai.

Senior inspector Anant Parad said that the cops arrested the girl's parents, aged 55 and 50, and her 25-year-old brother. However, her two younger siblings had no role in the crime, they said.

According to Indian news reports, the police booked the girl’s family under relevant sections of the Indian Penal Code. And, a Vasai court remanded them to police custody.

The police also seized the cellphones of the family members. Further investigation of the case is on, and the police said they were checking if the family had threatened the man.

The pope vowed to end cover-ups by Catholic Church officials and to make victims a priority, but some survivors were disappointed that no firm action plan was presented during the first-ever global summit.

A 76-year-old defrocked Catholic priest who lives in West Manchester Township has pleaded guilty to indecently assaulting two altar boys when he served at a Harrisburg church.

John G. Allen, of the 1600 block of Kenneth Road, pleaded guilty in Dauphin County Court on Thursday morning to all of the charges against him, according to Jennifer Gettle, that county's chief deputy district attorney.

As part of his negotiated plea agreement, Allen will be sentenced to five years of probation, Gettle said. She declined further comment until after sentencing.

Defense attorney Brian Perry said state-sentencing guidelines call for probation or a minimum sentence of up to nine months in county prison.

"The district attorney took into consideration his age, his health and the specific allegations," Perry said. "We're reserving our comments for sentencing, but John has accepted full responsibility."

Allen pleaded guilty to six misdemeanors — two counts each of indecent assault against a child under 13, indecent assault of a child under 16 and corruption of minors.

He remains free on $25,000 unsecured bail pending his sentencing hearing, set for Jan. 21 before Common Pleas Judge Deborah E. Curcillo.

Dauphin County detectives arrested Allen on March 14, 2019, District Attorney Fran Chardo has said.

The crimes: Allen indecently touched the altar boys from 1997 to 2002 while he served as a priest at St. Margaret Mary's Alacoque Church on Herr Street in Harrisburg, court documents state.

In October 2018, Victim 1 reported to police that Allen would come up behind him, grab his buttocks and look down on him.

Defrocked Catholic priest John G. Allen, of West Manchester Twp., is accused of molesting two altar boys at a Harrisburg church in the late 1990s and early 2000s, according to the Dauphin County DA's Office.

"These occurred inside the church. … The defendant did this to him over 10 times," documents state. "The defendant assaulted him from (the time) he was 10 years old to 13 years old."

The assaults stopped in 2002 when Allen was removed from the parish by the Harrisburg Catholic Diocese, according to court documents, which state he was later defrocked by the Catholic Church.

On March 2, 2019, Victim 2 told Dauphin County detectives that Allen "repeatedly grabbed his buttocks on different occasions" inside the church when the boy was serving as an altar boy, documents state.

2 years of assaults: He also told detectives that he was 12 years old when Allen first indecently assaulted him and that the assaults continued until he was 14 years old, which was in 1999, documents state.

Allen also touched the boy's genitals when the boy was 12, according to court documents.

County detectives began investigating after speaking with Victim 1, according to a previous news release from Chardo's office.

"Allen's name appeared on the Harrisburg Diocese list of priests accused of past molestations and was named as an abuser in the (Pennsylvania) Attorney General's grand jury report," the news release states. "In February 2002, Allen was removed as pastor of St. Margaret Mary's Church after a man reported to the Diocese that Allen had abused him as a boy."

Defrocked in 2006: At the request of the Harrisburg Diocese, the Catholic Church removed Allen from the priesthood in February 2006, according to the news release.

According to the Diocese of Harrisburg's online list of accused priests, Allen served at churches in the Gettysburg, Harrisburg, Lancaster, New Cumberland, Steelton, Lebanon and Selinsgrove areas between 1970 and 2002.

The Diocese of Harrisburg released a statement in March 2019 after Allen's arrest. It states, in part:

"The Diocese of Harrisburg removed John Allen from ministry 17 years ago immediately upon receiving a credible allegation of child sexual abuse against him. That allegation was also turned over to law enforcement and publicly announced by the Diocese at that time.

"Every allegation of child sexual abuse concerning Allen has been reported by the Diocese to multiple law enforcement authorities. Allen’s name was released by the Diocese of Harrisburg in our list of clergy, deacons and seminarians with allegations of child sexual abuse on August 1, 2018, and he was included in the Pennsylvania Grand Jury Report."

The release expressed "heartfelt sorrow and apologies to all survivors of clergy sexual abuse."

‘Credibly accused’ former RI priest charged with child molestation

PROVIDENCE, R.I. (WPRI) — A former priest named to the Roman Catholic Diocese of Providence’s list of “credibly accused” clergymen last year was arrested on multiple charges of child molestation, according to R.I. Attorney General Peter Neronha.

John Petrocelli, 75, was indicted by a statewide grand jury on three counts of first-degree child molestation and nine counts of second degree molestation, according to state prosecutors. The indictment was unsealed after he was arraigned in Providence Superior Court where he pleaded not guilty.

The grand jury alleged Petrocelli committed multiple acts of child molestation against three male victims under the age of 14 between November 1981 and October 1990.

“There is nothing more critical to the mission of my office than to deliver justice on behalf of victims and of the people of Rhode Island, regardless of the time that has passed after the alleged offense,” Neronha said in a statement. “Our ongoing review of alleged misconduct by clergy in Rhode Island is intended to achieve that result wherever possible.”

The charges stemmed from an ongoing investigation headed by Neronha’s office and R.I. State Police, who have spent more than a year investigating claims of sexual abuse of children at the hands of priests and other clergymen over several decades.

Petrocelli was ordained as a priest in 1971, according to court documents, and appointed to St. Ann Church in Providence. Five years later, he became assistant pastor at the Cathedral of Saints Peter & Paul in Providence where he served until 1981.

The Thursday charges are not the first time accusations of child molestation have surfaced against the man. In 1981, Petrocelli was assigned to the Holy Family Church in Woonsocket, where he was later accused of abusing a young boy. In 2003, a Lincoln man filed a lawsuit against the Diocese, alleging Petrocelli abused him in the late 1980s, according to news reports and court documents filed at the time.

The charges filed Wednesday are related to Petrocelli’s time spent at Holy Family Parish, according to prosecutors.

The church settled with the man — along with 35 other people who claimed they were molested by priests — for $14 million, although 12 News reported in 2007 that the man continued to fight the church over statute of limitations.

Prior to the allegations, Petrocelli was also assigned to Our Lady of Fatima Hospital in North Providence from 1990 to 1994, and St. Joseph Hospital in Providence from 1994 to 2002, according to the Diocese.

After the lawsuit against him came to light, the church placed Petrocelli on a leave of absence, according to news reports at the time. The Diocese said it removed him from ministry in 2002, which would have been around the same time the Lincoln man contacted the Diocese to report he had been molested, according to court documents.

In a statement, the Diocese reiterated that point.

“Petrocelli was removed from the ministry nearly twenty years ago, in 2002, following receipt of credible allegations of abuse, which were promptly reported to law enforcement,” a spokesperson wrote in a statement.

In 2019, the Diocese released a list of 50 priests and other clergymen it said were “credibly accused” of sexually abusing minors since the 1950s, which included Petrocelli. The term “credible accused” has no legal bearing, but is used by the church to describe allegations it has investigated internally and concluded to be plausible.

Retired Rhode Island State Police Maj. Kevin O’Brien, who leads the diocese’s Office of Compliance, helped put together the report after reviewing 70 years of files.

A Target 12 review of the report at the time showed the 50 priests and other clergymen were assigned to 185 Rhode Island institutions, including churches, schools hospitals and Catholic youth organizations.

Around the same time, the attorney general entered into an agreement with the Diocese, which provided his office and state police with access to all complaints and allegations of child sexual abuse by clergy since 1950.

The court set bail at $50,000 with surety, and a judge ordered no contact with victims or minors under age of 16, according to the attorney general’s office. His next court date is scheduled for Nov. 19, and he’ll have a pre-trial hearing in February.

Petrocelli’s arrest marks the first to come out of that investigation, which remains open and ongoing.

Pedophile priest Paul Shanley, key figure in Boston clergy sex abuse scandal, dead at 89

WARE — Convicted pedophile priest Paul Shanley, a key figure in the Archdiocese of Boston clergy sex abuse scandal, has died. He was 89.

Shanley, who was removed from ministry by the Vatican in 2004 and convicted of child rape a year later in a landmark case in Middlesex Superior Court that rested on the repressed memories of a 27-year-old man, had been a Ware resident since his release from prison as a level 3 sex offender in 2017, and police in that Hampshire County town confirmed in media reports Nov. 6 his death Oct. 28 of heart failure.

The Boston Archdiocese, which has paid millions of dollars to victims of clergy sexual abuse, including those with allegations against Shanley, released a statement acknowledging his death and what it called the “harm caused to so many.”

“The harm caused to so many by Paul Shanley is immeasurable," the statement said.

“His victims showed great courage in exposing his crimes and fighting for justice both within the criminal justice system and the Church. We are indebted to Shanley’s victims and all victims of clergy abuse for what they have done to stop the abuse, assure that the Church supports healing for those abused, and puts the protection of children at the top of our priorities.”

The Vatican removed Shanley from ministry only after he was arrested and numerous complaints of child sexual abuse were filed against him, even though the release, under court order, of archdiocesan records and documents showed church officials at the highest levels knew for decades of such allegations and continued to allow him to minister.

In her Jan. 31, 2002 profile on Shanley, Boston Globe Spotlight reporter Sacha Pfeiffer described the Dorchester-born Shanley, who attended St. John’s Seminary in Boston and was ordained in 1960, as a “handsome and charismatic” priest who did street ministry to alienated youth for two decades beginning in the 1960s, and his story as “among the most insidious cases of clergy sex abuse” her team investigated.

His death provides perspective on what it has taken and continues to take, particularly on the part of complainants willing to coming forward with allegations of clergy sexual abuse, to show the Catholic Church’s lack of accountability and transparency in addressing the issue, what clergy were involved either as abusers or protectors and the steps taken to conceal information in archives as well as rely on statutes of limitation around cases of clergy sexual abuse of minors.

The Boston Globe Spotlight team revealed decades of the archdiocese’s coverup of such abuse, and the movie based on the investigation highlighted the early efforts of Attorney Mitchell Garabedian to expose it and obtain diocesan documents in his suit against the Rev. John Geoghan, who was removed from ministry by the Vatican in 1998, and later murdered in prison where he had served one year of a 9-to-10 year sentence for sexually assaulting a child.

Asked about Shanley’s death, Garabedian, who represented 50 complainants who alleged sexual abuse by the priest, said, “Unfortunately, even though Paul Shanley has passed, courageous victims are still coming forward to try to heal and the Archdiocese of Boston must continue to be monitored with regard to practices of cover up concerning the safety of children.”

“The passing of Paul Shanley serves as a reminder of how great the emotional pain caused by a pedophile priest can be to so many innocent children and how dangerous an institution such as the Archdiocese of Boston can be when it chooses to cover up the evil acts of child abuse,” Garabedian added.

KRAKÓW, Poland – In an unprecedented move for the Polish Church, the Vatican banned a retired cardinal from public ministry, public appearances, and the use of the bishop’s insignia.

Cardinal Henryk Gulbinowicz of Wrocław also cannot be buried in the archdiocesan cathedral after his death.

The disciplinary measures are a historic and symbolic moment for the Church in Poland.

When the Vatican embassy published the statement on Gulbinowicz on Friday, the cardinal was informed about the decision, but the archdiocese said his state of health meant he was probably unaware of what had just happened.

Father Rafał Kowalski, the spokesman for the Archdiocese of Wrocław, told Crux the development “is a sign that things are not swept under the carpet in the Church and that there is no reduced tariff for anyone.”

The Vatican statement said the decision came as “a result of inquiries into accusations against Cardinal Henryk Gulbinowicz, and after analyzing other charges concerning his past, the Holy See has taken disciplinary measures.”

Although the Vatican statement didn’t give details on the “accusations” against Gulbinowicz, it included a requirement he give compensation to the St. Joseph Foundation, which was established by the Polish Bishops’ Conference to help victims of sexual abuse.

“People were hurt, and this is the moment to tell them – we’re sorry,” Kowalski told Crux.

The abuse crisis in Poland exploded after the release of a documentary on YouTube in May 2019 called Tell No One, by the filmmakers known as the Sekielski Brothers. The film documented a history of abuse and cover-up in the country and was viewed by more than 2.5 million people in less than 24 hours.

Soon after its release, an alleged victim using the pseudonym Karol Chum posted on Facebook that he was abused by Gulbinowicz, but never reported it to the Church authorities. However, after the archdiocesan offices were made aware of the post, they contacted the alleged victim, and he eventually filed an official canonical complaint against the cardinal.

He was allegedly abused by Gulbinowicz when he was a 15-year-old student at the Franciscan Minor Seminary.

His case was turned down by the state prosecutor in 2019, due to the statute of limitations. The Church proceeded with its own investigation, which ended with the disciplinary measures announced on Friday.

“Even if we’re talking about actions that took place decades ago, in the Church they are never going to be considered too old,” the Archdiocese of Wrocław said in a statement.

“The fact that we know publicly what penalty was imposed on the cardinal is a game changer,” Father Piotr Studnicki, head of the Child Protection Office of the Polish Bishops Conference, told Crux.

“People need to know whether the case was solved and what is the truth,” he said, adding that it is a visible sign of change in the communications strategy surrounding high-profile cases in the Church.

“It’s enough to compare it to the case of Juliusz Paetz, the deceased metropolitan of Poznan: It happened 20 years ago and we still don’t know how the case was processed,” he said.

Robert Fidura, a clerical sex abuse survivor, told Crux: “Finally – if such serious penalty was imposed and publicly announced, the reasons must have been grave.”

A once glorious past leads to a downfall

Gulbinowicz was an important figure in the communist-era Church in Poland. He became a Archbishop of Wrocław in 1975, and he was the one who hid the funds of the local branch of Solidarity when martial law was about to be imposed on the country in 1981.

Four years later John Paul II made him a cardinal. He resigned as Archbishop of Wrocław in 2004.

The Polish government also honored Gulbinowicz. President Lech Kaczyński decorated the cardinal with the Order of the White Eagle, and Poland’s Institute of National Remembrance, IPN, called him “the unbroken cardinal” in light of his anti-communist activities.

However, historians at the IPN later discovered a darker history about the cardinal in the state archives.

“Before I studied the secret service documents, it seemed like Gulbinowicz was a positive hero,” Professor Rafał Łatka, a historian at the IPN, told Crux.

Łatka and co-author Filip Musiał will later this month publish a new book on the cardinal called Dialogue Needs to be Continued. Operational Conversations of Communist Secret Service with Cardinal Heryk Gulbinowicz. A Case Study.

Even if Gulbinowicz wasn’t an official agent of the communist secret service, historians claim his dealings with the Służba Bezpieczeństwa (SB) – the communist secret service in Poland – for 16 years were harmful to the Church.

“Bishop Gulbinowicz informed neither Primate [Stefan] Wyszyński nor his successor Primate [Józef] Glemp about his meetings with the SB,” Łatka said, adding that any encounters between any clerics with the SB were officially prohibited by the bishops’ conference.

“It was thanks to those conversations with the regime that Gulbinowicz obtained a post he really wanted – becoming the metropolitan of Wrocław. It was the regime that wanted him in Wrocław, considering that he was not loyal to Cardinal Wyszyński, unlike the candidates previously indicated by the primate,” Łatka told Crux.

The professor also said the SB had information on Gulbinowicz’s homosexual relationships.

Several Polish priests confirmed in conversations with Crux that Gulbinowicz’s homosexuality was an open secret in the Church in Poland.

For Church in Poland, a Pandora’s box is opened

Many observers now say the Gulbinowicz case opens up Pandora’s box for the Church in Poland.

His case touches on several others now dominating the headlines in the country.

Bishop Edward Janiak was recently removed from the Diocese of Kalisz after allegations he covered up clerical sexual abuse were made earlier this year in Hide and Seek, a second documentary produced by the Sekielski Brothers.

Janiak was a priest in Wrocław and served as an auxiliary bishop of the archdiocese under Gulbinowicz.

In addition, the cardinal was a close friend of Archbishop Józef Kowalczyk, a Polish Vatican diplomat who served as Apostolic Nuncio to his homeland from 1989-2010, and was therefore responsible for submitting names of possible bishops in the country. Kowalczyk later served as Archbishop of Gniezno from 2010-2014.

Journalist Tomasz Terlikowski said the sanctions against Gulbinowicz will cause an earthquake in the Church in Poland. “Now the actions of Archbishop Józef Kowalczyk should be looked at through a magnifying glass by the Vatican,” he wrote on Facebook.

Another close collaborator of Gulbinowicz was the recently retired archbishop of Gdańsk, Sławoj Leszek Głódź. When he was a priest, Głódź served as the driver for the cardinal’s secret meetings with regime officials.

Głódź has been accused of covering up clerical sexual abuse in his archdiocese, and an inquiry has been launched under the rules of Vos Estis Lux Mundi, the Vatican’s new anti-abuse legislation which came into effect last year.

“The history of bishops – including those that were dying as heroes – will be written anew,” Terlikowski wrote.

“A very hard time is ahead of us.”

Florida closes investigation into Catholic Church, alleged sexual abuse by 300+ priests

The Office of Statewide Prosecution released a statement on the conclusion of an investigation regarding the Catholic Church and alleged sexual abuse by priests.

TALLAHASSEE, Fla. — The Attorney General's Office of Statewide Prosecution has closed a 2-year investigation regarding the Catholic Church and alleged sexual abuse by Catholic priests.

On Friday, the Office of Statewide Prosecution announced it "found no evidence of ongoing, unreported, current sexual abuse of minors by church priests in Florida."

The state released a 19-page report on its findings, bringing to light new details surrounding the investigation.

The Office of Statewide Prosecution's investigation into the Catholic Church began in 2018 after reviewing a Grand Jury report from Pennsylvania about sexual abuse by Catholic priests.

That report from the grand jury listed more than 300 priests accused of sexual misconduct and described instances of cover-up, with several ties to Florida, according to state prosecutors.

The attorney general's office then launched a website for victims to come forward. For the first time Friday, the I-Team learned just how many tips the state received regarding clergy abuse: more than 260.

The state reports it investigated every allegation of sexual abuse it received, with the help of the Florida Department of Law Enforcement.

In a statement, Statewide Prosecutor Nicholas B. Cox said, "After a thorough investigation of every tip and every allegation in the church’s file, the Office of Statewide Prosecution found no evidence of ongoing, unreported, current sexual abuse of minors by church priests in Florida. We also conducted a comprehensive, historical review of allegations of sexual abuse against priests in Florida, and based on the facts of those allegations and the law, we are unable to prosecute any additional priests or church officials because the then-existing statute of limitations bars such prosecution and/or the alleged abuser is no longer alive."

The investigation revealed, historically, Florida was a state where priests accused of abusing children in other states were "routinely relocated." The report listed 81 priests who fit that description.

The state also identified 97 priests in Florida who had allegations against them of historical sexual abuse, and included a note next to each name, indicating why none of those priests could be prosecuted. The notes state factors like, "barred by statute of limitations", "previously prosecuted", and "deceased".

“As the Statewide Prosecutor, I treat such allegations extremely seriously. If any additional allegation is brought forward, I, and this office’s prosecutors, stand ready to investigate and prosecute any such allegations to the fullest extent possible under Florida law," Cox said.

The Survivors Network of those Abused by Priests (SNAP) responded to the closing of the investigation on Friday with the following statement:

Florida’s Office of Statewide Prosecution has released a report on their investigation into Catholic sexual abuse in their state. We are grateful to the office for looking into this issue and urge them to keep their hotline and communication channels open.

The efforts by attorneys general in Florida has so far not resulted in the same arrests that we saw following the investigations in states like New Jersey, Pennsylvania, and Michigan. Still, the report lays bare critical facts that show how Catholic officials protected and shifted abusers, preventing their prosecution and allowed “depravity, abuse, and criminal conduct” to continue in the state of Florida.

Stated plainly in the Florida report is a fact that is already known and understood by survivors and advocates: “This investigation uncovered acts by the Church and its personnel that enabled sexual abuse of minors in Florida by its priests and prevented or obstructed discovery, investigation, and prosecution of such crimes.” This exact same behavior has been found by every attorney general that has so far investigated sexual abuse in the Catholic Church and speaks to the nationwide use of the “circle of secrecy” that Pennsylvania A.G. Josh Shapiro detailed in his 2018 clergy abuse report. With each report, the truth becomes clearer: the institutional Catholic Church has actively worked to prevent parents and parishioners from learning about abusers to the detriment of children, families, and communities across the globe.

The report indicates that many of the still-living priests identified were only saved from prosecution by the expiration of the criminal statute of limitations. We hope that this news will awaken legislators in every state that has not yet abolished the criminal statute of limitations for child sexual abuse to work to do so now so that future children are not prevented from seeking justice because of archaic laws. Such reform should be accompanied by civil SOL reform as well so that those institutions that covered-up for abusers can also be held accountable. We believe that this will be a huge help in preventing future cases of abuse.

While the report seems to indicate that current Catholic officials in Florida are properly routing complaints to the authorities, we nevertheless encourage all survivors to report to law enforcement themselves and to do so before going to the Church. We also urge the attorney general’s office to keep their reporting hotlines open – following the publication of the Pennsylvania Grand Jury report, hundreds more survivors came forward, empowered by an office that took their stories seriously. We suspect the same would be true in Florida.

Seattle Archdiocese Worker Gets 30 Months in Prison for Child Porn,

Facing Molestation Charges in California

Seattle, WA – A 61-year-old Issaquah, Washington, man was sentenced today in U.S. District Court in Seattle to 30 months in prison for possession of child pornography, announced U.S. Attorney Brian T. Moran.  PHILIP B. GILBERT, who was employed in the IT department of the Archdiocese of Seattle, was arrested on state charges in May 2019.  He was charged federally in October 2019 and pleaded guilty in June 2020.  At the sentencing hearing, Chief U.S. District Judge Ricardo S. Martinez noted that GILBERT will be transferred to custody in California where he is charged with sexual assault and faces up to life in prison if convicted.

According to documents in the case, in January 2019 an electronic service provider reported GILBERT’s account to the National Center for Missing and Exploited Children (NCMEC) for uploading images of child rape and molestation.  After obtaining a court-authorized search warrant, law enforcement served the warrant at GILBERT’s residence and seized electronic devices.  The devices contained 256 images of child pornography.

 

Following GILBERT’s arrest, a victim came forward to law enforcement and reported GILBERT molested her.  Contra Costa County, California, has charged the defendant with multiple sexual abuse crimes against a minor for which he faces life in prison.  Following his federal sentence, he will be transferred to California to resolve those charges.  On the federal case, Chief Judge Martinez imposed ten years of supervised release to follow prison and $12,000 in restitution to the victims depicted in the various child pornography series that GILBERT possessed.
