A Second Judicial District Court judge rejected a former Albuquerque, New Mexico magic shop owner's attempt to have child sex abuse charges against him dismissed.
Neil Stammer is accused of sexually assaulting two boys in the late 90s. The boys said Stammer, a professional juggler, lured them into his magic shop and assaulted them.
Stammer's attorney argued his client's right to a speedy trial had been violated due to several delays in the case. But in his ruling, Judge Stan Whitaker said that while the state bears some responsibility for the delay, the majority of the time delay was caused by Stammer leaving the country. He was caught in Nepal after 14 years on the run.
A trial is scheduled to take place in December.
