The singer, 75, who was this week interviewed by officers over the child abuse allegations for a second time, apparently presented evidence that he was never on his own with his accusers.

He was backed by affidavits signed by his minders and other staff members saying he had been accompanied by them while filming in the presence of the boys, a source told The Sun.

Sir Cliff has always denied the 'completely false' allegations made by the two unidentified men.

It comes as the star's new DVD - 75th Birthday Concert, recorded at The Royal Albert Hall - is set to make the Christmas No 1, despite the widely-publicised abuse claims against him.

The product is already at No 2 in Amazon's sales charts - on pre-orders alone - and industry insiders predict it will clinch the top spot in the official music DVD charts after its release on November 30, according to the Daily Mirror.

Amy, the much-anticipated documentary film depicting the life and death of singer Amy Winehouse, is currently at No 1 on Amazon.

Sir Cliff faces another Christmas in legal limbo after his spokesman confirmed he met with officers voluntarily earlier this week.

His home had been previously raided by officers 15 months ago – with the BBC on hand to show officers entering the property live on television.

Sir Cliff was first interviewed under caution last year by police investigating claims he abused a boy at a Christian rally in 1985. He was not arrested, nor charged with an offence.

It is believed he was quizzed this week over allegations that he sexually assaulted another boy during the filming of a music video in 1981, which surfaced since his home was raided.

A former aide to state Child and Family Services caseworkers in Helena is charged with sexually abusing a minor.

Andrew T. Lewis of Whitehall pleaded not guilty Wednesday to five felony counts during a hearing before District Judge Loren Tucker. Lewis was released after posting a $25,000 bond.

Prosecutors allege Lewis committed the crimes between August and Oct. 16, when he was arrested.

State health department spokesman Jon Ebelt tells the Independent Record that Lewis was placed on unpaid administrative leave.

Lewis began working for the state in March as a social services technician. Agency officials have said social service technicians spend most of their time transporting children, supervising visits between parents and children, and providing other support services to children and families.



Trial of alleged chronic pedophile begins with no physical evidence

Testimony began Thursday in the Sutter County, California jury trial of a child molestation case in which the defense says there is no physical evidence.

Javier Jimenez, 45, is charged with oral copulation or sexual penetration of a child under the age of 10, sexual intercourse or sodomy with a victim 10 or younger, and lewd or lascivious acts with a child under 14.

Deputy District Attorney Anu Chopra told jurors in her opening statements that two children, a boy and a girl, will testify that Jimenez molested them each multiple times over a period beginning in July 2008 until the children informed their family member of the behavior in 2012.

In addition, an unrelated woman is scheduled to testify that after she read about Jimenez's arrest in the newspaper, she called to report that the defendant abused her 13 years ago, Chopra said.

Defense attorney Craig Leri said there is no physical evidence to show the alleged incidents occurred, including medical records of the young girl. Medical records show no scarring and that her hymen is intact, he said.

Jimenez had access to the children because he was dating a woman related to the children. That woman took the stand as the first witness.

If he is found guilty, Jimenez faces a life sentence.

Photographer Accused of Producing Images of 

Child Sexual Abuse

According to documents filed with the U.S. District Court for the Southern District of Florida, Richard Emerich, who has lived on Western Avenue in Brattleboro since late 2014, took pictures of a sexual nature of underaged boys. According to the court documents, Emerich used his profession as a photographer to take the pictures, first for modeling purposes and then to produce images of child sexual abuse.

Emerich was originally identified through the assistance of a cooperating defendant in the State's Attorney's Office for Palm Beach County, in Florida. The defendant, who has not received any guarantees of preferential treatment for cooperating with prosecutors, has also been charged with pornography-related crimes. The defendant told prosecutors they worked as a talent scout and recruiter for "a New England-based photographer," who turned out to be Emerich. "The CD would book teenage boys to model for Emerich, who would fly to Florida from New England and take both non-nude and nude photographs of young boys."

Emerich, who owns and operates RWE Productions, a modeling and photography company in Brattleboro, was asked by the informant to send photographs of underage boys to Florida. Emerich responded by sending an external hard drive and thumb drive via the postal service. Included in the package were business cards from RWE Productions. Emerich's fingerprints were also found on the contents of the package. The hardware was found to contain images of child sexual abuse.

One of the victims was identified by police and he confirmed that he was paid by Emerich to model in the nude, beginning as early as 2007, when he was only 10 or 12 years old.

In April 2015, the cooperating defendant told investigators Emerich was planning to travel to Florida to photograph underage boys. In June, Emerich sent the CD another external hard drive, which contained "thousands of images of minor boys and age-indeterminate males," according to the court documents.

On Nov. 2, investigators served a search warrant on Emerich's Western Avenue home, during which time they discovered more than 50 external hard drives containing images of child sexual abuse. During the search, Emerich was read his Miranda Rights and though he was told he was free to leave at any time, discussed his activities with investigators. According to court documents, Emerich admitted to creating the images, to being sexually attracted to minors and to having had sexual contact with at least one minor boy. Emerich also admitted to sending the external hard drives to Florida.

Emerich's "day job," according to the documents, is with TestAmerica, an environmental testing company, which is owned by a hedge fund in Miami, but has offices across the United States, including in Brattleboro.

Assistant U.S. Attorney Barbara Masterson said Emerich is being held pending a detention hearing. If the government's request for detention is approved by a federal judge, Emerich will then be transported to Florida to face the charges.

Masterson said because the investigation is ongoing, she couldn't comment on whether Emerich might have taken illegal pictures of children in southern Vermont. However, if a parent or guardian is concerned, they should contact her office at 802-951-6725.

THE founder of a support group for families in North East Lincolnshire has denied conspiring to procure a child to become a common prostitute, false imprisonment and conspiracy to rape.

Karen MacGregor, 58, helped set up the Grimsby branch of the Kinkids support group at Riverside Children's Centre last year.

She appeared at Sheffield Crown Court yesterday along with seven other people who all pleaded not guilty to a range of alleged offences involving 14 girls in Rotherham.

They include rape, abduction and indecent assault and span a timescale between 1990 and 2003.

The defendants were arrested as part of South Yorkshire Police's Operation Clover investigation.

All are due to go on trial in December.

Judge Sarah Wright granted bail to six of the eight defendants - including MacGregor, who now lives in South Yorkshire.

2708 Child Sex Abuse Cases in One State in India in 2.5 Years

But only 193 perpetrators are behind bars

RAIPUR, India: Though Chhattisgarh state, hugs fourth rung in rogue's gallery on crime against children in 2014 contributing to 4.9% to all-India figure, shocking numbers of incidents have been registered under Protection of Children Against Sexual Offences Act (POCSO) since its inception.

On an average, three children are sexually molested everyday in Chhattisgarh.

TOI accessed data of incidents registered under POCSO in state from November 2012 to March 2015, according to which 2,708 cases were reported from 27 districts for child molestation.

State capital recorded maximum number of 288 cases under POCSO, followed by Durg with 256 cases while 190 incidents were reported in Raigarh district. Among the vulnerable remote districts, Koriya recorded 165 cases, followed by Jashpur district with 157 incidents of child assault.

At a place where people hesitate in reporting about such incidents to police, number of incidents recorded is quite high. This indicates that there are a number of cases which still go unreported, a senior police officer said.

Incidentally, of 2708 cases registered, accused in only 193 incidents have gone behind the bars while, of 2,377 cases presented before court, 1,732 are still pending and alleged accused in 452 cases have been acquitted.

So nearly 77% of cases result in acquittals! Clearly justice is not being served. Either people are being wrongfully charged, or police and prosecutors are doing a very lousy job of gathering evidence; or, judges are being too sympathetic to pedophiles. Whatever the problem(s) is, it does not appear to be in the best interest of sexually abused children to come forward and endure a trial that has a less than 1 in 4 chance of success. Then, 3 of 4 possible sexual abusers are back on the streets and probably furious at the poor child who reported them. The children are arguably worse off than before. This system has got to improve dramatically - so far it is a major FAIL.

The situation not only calls for justice through fast-track courts, but creating awareness about newly formed Act among children and parents. Besides, proper training to police officials for imposing appropriate sections of the Act is also essential.

CID child cell has been imparting training to police in several districts in collaboration with Delhi-based NGOs, but the need for more is always felt amid ignorance.

Talking to TOI, Vikram Srivastava, prominent advocate and founder of Independent Thought in Delhi said, "High number of cases signifies that children and parents are gaining confidence in terms of reporting. It's very important to inform children in schools about protection and its mechanisms like ChildLine number."

He added that children in conflict zones at residential schools at both government and non-government institutions are most vulnerable, unaware and ignorant of right and wrong. "Hence, it's very important to implement effective legal mechanisms under juvenile justice Act and ICPS," Vikram said.

Too Many Child Pornography Cases to Report

Thinking it might be good to compile the child pornography stories here, I quickly came to realize that there were just too many. In the past 24 hours 23 different news stories were issued about pedophile pornographers, just in the USA. It's horrible to see so many porn-peds out there, but, at the same time, it might very well mean that police are making great progress in tracking down these perverts. There's a long way to go before the demand for child porn is reduced, in fact, it is still increasing, but it is a start, and I commend those involved in this very difficult line of work.

There were several stories from other countries as well including the one that follows. I include it because it's from Nova Scotia, Canada one of my favourite targets since the Rehtaeh Parsons suicide. Also, because in the late 1970s, I lived in Lower Sackville about 2 kms from where this creep lives.


Nova Scotia man faces child porn charges

A 21-year-old Lower Sackville, N.S. man faces charges of possessing and distributing child pornography after a search Wednesday.

The Internet Child Exploitation unit went to an address at Beaver Bank and Old Sackville roads at 9 a.m. Lorne Leslie Stewart was arrested without incident.

Stewart was previously charged with child pornography offences last fall. He was released on conditions and now stands accused of a breach of those court orders.

He is being held in custody until a bail hearing set for Monday.

Maryland Man Linked to Four Child Sex-Abuse Cases Since 1999

Frederick, Maryland police have linked a man to four sexual assault cases dating to the 1990s, after a domestic disturbance at the man’s house last month.

At 3:15 a.m. Oct. 25, police arrived at 47-year-old Joey Leon Laster’s home in the 1800 block of Ganby Way to find a teenage boy knocking on neighbors’ doors and asking for help, according to charging documents.

The boy told police Laster had sexual contact with him, causing him to flee, according to charging documents filed against Laster over the last week in Frederick County District Court.

Laster denied the accusations, but a man and two more boys contacted detectives over the next two days to report past abuse after Laster was charged with second- and third-degree sex offense and sex abuse of a minor.

The earliest abuse reported to police dated to 1999, when Laster began inappropriately touching a boy who was then 8 years old, according to documents. The other two boys told police they were abused between 2008 and 2013.

Police said Laster would alternate between using threats and promising gifts to the boys to keep them from telling anyone about the abuse or refusing his advances, the documents state.

“I would kill you before you even thought about telling anyone,” Laster told one boy, according to one set of charging documents.

In addition to the charges filed against him Oct. 25, Laster was also facing five counts of second-degree assault, four counts of sex abuse of a minor and one count of fourth-degree sex offense, according to the charging documents.

Laster was released from the Frederick County Adult Detention Center as of Friday when his combined $725,000 bail was posted through a bondsman, court records state.

Laster was scheduled to appear in court for a preliminary hearing Nov. 25, court records state.

Jury Awards $8m to Child Sex Abuse Survivor of Catholic Pedophile Priest

Diocese of Duluth, Catholic order are responsible

The verdict, rendered after less than a day of deliberations, is the first for a trial under the Child Victims Act.

A Ramsey County, Minnesota jury on Wednesday handed down one of the nation’s highest single monetary awards for a survivor of clergy sex abuse, signaling to the church that such crimes are being taken seriously, observers in the field said.

A jury of three women and three men found that the Diocese of Duluth and a Catholic religious order were responsible for the sexual abuse of a 15-year-old altar boy in 1978, and awarded the now 52-year-old survivor $8.1 million for past and future damages and loss earnings.

“This is one of the largest verdicts in the country,” said Marci Hamilton, a law professor at Yeshiva University in New York and a national expert on clergy abuse.

The vast majority of cases settle out of court, with an average settlement of about $1 million to $1.3 million, she said.

The verdict is the first for a trial under Minnesota’s Child Victims Act. The 2013 law allowed older claims of child sex abuse barred from criminal prosecution due to statutes of limitations to be aired in civil court.

A man identified in court records as Doe 30 sued the diocese in Ramsey County, alleging that it failed to protect him from the Rev. James Vincent Fitzgerald, that it failed to supervise the priest and that it should have known that he was dangerous.

Fitzgerald, who is deceased, took the boy on a trip across the state in 1978 and sexually assaulted him for two weeks while working in a Diocese of Duluth parish. Fitzgerald was a priest with the Oblates of Mary Immaculate religious order.

Jurors Wednesday found that the diocese was 60 percent responsible and the Oblates was 40 percent responsible for the negligent supervision of Fitzgerald, and that it was a “direct cause” of Doe 30’s abuse.

Doe 30’s attorney, Jeff Anderson, had asked jurors in his closing arguments Tuesday to find the diocese 90 percent responsible and the Oblates 10 percent responsible. Wednesday, he said that he supported the jurors’ findings.

“Through this jury’s decision, there is now hope … and there has been great healing,” he said.

‘Voice of the people’

Jurors began deliberating shortly after 4 p.m. Tuesday, and returned their verdict about 2 p.m. Wednesday. The Oblates were originally named in the lawsuit, but were later dismissed by a judge’s order.

“I think, clearly, the finding of the jury … reflects that they really appreciate fully the magnitude of both the harm done here and the betrayal of trust. …” Anderson said. “It really has important, far-reaching implication. …”

Terence McKiernan, president of the Boston-area watchdog group, Bishop Accountability, said that the largest jury award he could immediately recall was $11.5 million given several years ago to two abuse survivors in New York. The closest jury awards or settlements tend to hover in the $5 million range, he said.

“This is, in a way, the voice of the people,” McKiernan said of Wednesday’s verdict. “This is an indication of how the people feel about this kind of crime.

“One of the things that the money means is that this was truly horrible, and this poor man really deserves significant compensation for what he’s suffered and what it’s done to his life.”

Anderson asked jurors to award his client a little more than $11 million, and said they could calculate an amount of their own. But he also cautioned them not to “punish” the diocese by awarding an “outrageous” sum.

Overly large awards may carry some symbolism, but haven’t proved successful. In 1997, McKiernan said, a jury awarded 11 plaintiffs in a Texas case $119.6 million. That award was eventually knocked down to $30.9 million.

Anderson said Wednesday that he expected the diocese to fight the verdict and possibly ask for a reduction or elimination of the monetary award.

Diocese attorney Susan Gaertner declined to comment after the verdict was read.

Gaertner told jurors in her closing arguments Tuesday that the diocese bore no responsibility because Fitzgerald’s history of inappropriate behavior was known to the Oblates, and was not communicated to the diocese. She also argued that he was an employee of the Oblates.

“[The Oblates] was pulling the strings and making the plans for the ministry of J. Vincent Fitzgerald,” Gaertner told jurors.

Anderson argued, and advocates agree, that bishops are ultimately responsible for protecting children from predatory priests.

“We hope the wisdom of this jury and the courage of this victim will prod others who are victims of sexual violence to come forward, seek justice, prevent crimes and expose those who commit and conceal heinous abuse against children,” said a statement from David Clohessy, executive director of the Survivors Network of those Abused by Priests (SNAP). “The bottom line is that every bishop is responsible for the safety of every Catholic kid from every Catholic pedophile. …”

Behavior Changes in Children May Signal Child Sexual Abuse

Every Saturday night the Walsh families gathered for dinner, music, and cousin time. There were nine children, ranging in age from 4 to 14. It was boisterously good fun. Kids catapulted across the lawn playing games, adults BBQ'd, and set tables for dinner. The swing hanging from an old oak tree was in constant use.

Later that night, Jamie strapped her 5-year-old exhausted noodle-like daughter into her car seat, and slipped into the front. She took Paul's hand as the dome light dimmed. He turned the music low and they drove home.

Jamie wondered if Priscilla (Pru) might be coming down with something, she was so quiet the following day. Jamie spent extra time cuddling her when she saw Pru pop her thumb in her mouth, a habit she'd broken a year ago. As the week went by, Pru seemed to gain energy, but wet the bed twice. Another anomaly.

The next Saturday, as Jamie prepared their assigned dish for the evening with the family, Pru went quiet. At her grandparents' house, she clung to Jamie's leg as if she'd never let go. No amount of coaxing could encourage her to play outside with her cousins. When Josh, Pru's 14-year-old cousin came in from outside, Pru slid around behind her mother, and buried her face in her skirt. Jamie took Pru out onto the front porch and asked what was wrong. Pru told her Josh said she couldn't tell. Anyone. Ever.

Pru's cousin had molested her at those family gatherings. It blew the family apart when Jamie confronted her brother and his wife about their son. The sad truth is, this is not unique. 90 percent of molestation is done by a family member, or someone known and trusted by them. As a parent, the more informed you are, the more attuned to your child's behavior, particularly when they seem "off" to you, the faster you can step in, if something is wrong.

Here are some telltale signs your child may be being sexually abused. No single behavior indicates child sexual abuse -- except disclosure. If several of these apply, begin asking clarifying questions.

In younger children:

• Recurring nightmares
• Eating habits suddenly change
• Inexplicable mood swings
• Draws frightening images
• Plays in sexual ways with toys (like stuffies)
• Develops a fear of certain people or places
• Mentions a secret shared with an older child or adult, but won't talk about it
• Has different names for private parts than she/he was taught
• Regresses to younger behaviors (such as bed wetting)
• Becomes uncharacteristically clingy and anxious

Sheri came from a very strict home. The only people who babysat them when they were little were their grandparents. In high school she and her sisters were driven to and from school. They were not allowed to take the school bus. They attended church, where both parents were quite active. Sheri was a junior, her older sister a senior. The baby of the family, completing a trio of girls, was nine.

Sheri always wore high necklines and long sleeves, no matter the weather. Beautiful, with long glossy auburn hair, she excelled scholastically, was shy, and at 16 was not allowed to date. She had a best friend who also attended the same church.

Tessa, Sheri's friend, risked detention that day to follow Sherri into the bathroom. Tessa had grown increasingly worried for her friend. Something wasn't right. She slipped through the door. Sheri wasn't immediately visible, having taken a right turn further into the bathroom, but the mirrors over the sink gave her away. Tessa's hand flew to her mouth when she saw Sheri, pocketknife in hand, crying as she cut herself.

Sheri had told no one, but when she saw her father begin grooming her younger sister to take her place, her hard fought-for façade of normalcy began to crack. Tessa insisted Sheri come to her house and talk to her mother. The entire story tumbled out. Tessa's mom went to Sheri's and broke the news to her.

• Running away from home
• Promiscuity
• Drug or alcohol abuse
• Unexplained money or gifts

Did you know that more than 50 percent of children wait up to five years before disclosing abuse? If you know what to look for, and create the climate for disclosure by asking clarifying questions you will stop the abuse. As a parent, your best defense is to teach your children early about how special their bodies are, and what appropriate boundaries are. (Dos and Don'ts for parents) But if the unimaginable happens, know that the sooner you are able to stop the abuse, the more positive the outcome.

Pakistan Moves Toward Death Penalty for Child Sex Abuse

Pakistan has taken a step towards punishing the sexual abuse of girls with life imprisonment or even death after an influential parliamentary committee voted to amend current laws.

The National Assembly's standing committee approved the proposal by lawmaker Shaista Perveiz Malik yesterday, according to a statement on parliament's website.

"After detailed discussions, the committee unanimously passed the bill," it said. Wow!

The amendment only appears to address the sexual abuse of girls aged under 14, not boys. 

Under the existing penal code, the punishment for rape ranges from a minimum of ten years' incarceration to the death penalty, but it does not specify the victim's age or gender.

The bill will now come before lawmakers in both parliamentary chambers, who are set to pass it into law.

Malik told the committee the state should protect vulnerable women and children.

In a report, independent child rights watchdog Sahil said that last year almost 10 children were sexually abused in Pakistan every day on average. 

These are registered cases. Most rape cases are never reported to police. So, in reality, there may be more like 30 to 50 child sex abuse cases per day.

Parliamentary records show that some 14,583 rape cases were registered in Pakistan between 2009-2014, while only 1,041 offenders were convicted. 

Pakistan ended a six-year moratorium on the death penalty last year, at first just for terror-related charges but later for offences including murder, drug smuggling, blasphemy and treason.

This law, by specifying age parameters, will cause judges to have to consider whether the death penalty is warranted. Consequently, it will certainly result in executions, but not many. Therefore, it will not make much of a difference in child sex abuse rates. Until they find a way to get children or parents to report the majority of CSAs to police; and until the conviction rate improves dramatically from the approximately 1 in 15 currently, there will be no great advancement in child protection.
