A HISTORICAL sex abuse trial at the high court has collapsed after the death of the accused.
Donald Ellingham, 68, of Tay Place, Irvine, was to face eleven charges of sexual abuse.
These were in relation to six alleged victims, aged between four and 16 years old.
He was due to take the stand at the High Court in Glasgow from September 18 next month. However, the High Court confirmed they have received formal notification of the death of the accused.
One of the six accusers taking the stand against him has spoken out online since his death, publishing an audio recording with apparent admissions to the crime.
She also spoke of her despair at now being unable to take the stand against the accused. She also said she was angry there was not closer supervision of the accused while he was waiting trial, following unconfirmed reports that he had taken his own life.
Police Scotland were contacted, but they declined to comment about the case.
At a preliminary hearing at Glasgow High Court in April, Ellingham was faced with charges against him, dating between 1976 and 1998. It was alleged he committed sex acts against a girl, then aged between five and twelve, and induced her to commit acts, on various occasions between February 3, 1976 and February 2, 1983, including at two addresses in Irvine, an address in Paisley, at the Magnum Leisure Centre, in a signal box in Irvine Train Station and in a motor vehicle on journeys around Irvine, Paisley and elsewhere.
He was also accused of abusing the same female, then between the ages of 12 and 16, on various occasions between February 3, 1983 and February 2, 1985 at an address in Irvine, Paisley and the Magnum Leisure Centre.
Ellingham was accused of the assault and attempted rape of the same young female at an occasion between February 3, 1977 and February 2, 1980 at an address in Irvine.
He was also accused of forcing a second female aged 12-16, to commit an act on him, and other indecencies, between December 20, 1977 and December 19, 1982 at two addresses in Irvine, as well as the Beachpark, the Magnum, a signal box at Irvine train station and in a motor vehicle in Irvine and elsewhere.
He faced further sex offences against the same female while in a motor vehicle at various locations in Irvine between December 20, 1982 and December 19, 1984.
Between August 6, 1983 and August 5, 1986 Ellingham was accused of the rape of a third underage female at an address in Irvine. He was accused of sex charges against a fourth female then aged between (7 and 10) on various occasions between February 12, 1989 and February 11, 1992 at an address in Irvine, an address in Ardrossan and during journeys in a motor vehicle in Irvine.
In the same period was also accused of raping the same child to her injury. Ellingham faced further accusations of sexual abuse of a fifth female then aged between nine and 12-year-old on various occasions between December 6, 1989 and December 5, 1992 at an address in Irvine, and in journeys in a motor vehicle in the Irvine area.
He was also charged with raping a sixth female, then aged between 14 and 15, at an address in Ardrossan between August 24, 1996 and August 19, 1997. He faced an eleventh charge of the sexual assault of same female between August 24, 1997 and August 1998.
He had denied all charges against him, forcing his alleged victims to face the ordeal of giving evidence against him.
Police were unable to confirm the cause of his death.
Good grief! How could he get away with so many atrocities for so long? It's hardly believable! Nevertheless, he didn't escape judgement by offing himself.
Norfolk man jailed for child sex attacks

A Norfolk man has been jailed for 18-years for a number of sex attacks on young girls.
42-year-old Gary Izatt, from Icknield Way in Thetford, was charged in August 2016.
It followed a number of rape and child abuse offences, which began in June 2012.
Norfolk Police say Gary Izatt befriended the two 13-year-old girls, and then "abused them countless times".
Norfolk Constabulary’s Safeguarding Children Online Team (SCOLT) charged him with 28 offences.
Izatt admitted 8 counts of rape, 4 counts of sexual assault by penetration, three counts of causing or inciting a child to engage in sexual activity, four counts of possession of indecent images and one count of sexual assault by touching.
The other offences will remain on file.
When sentencing Izatt to 18 years in prison with a seven year extension, Judge Ayres described his offences as "humiliating and degrading" to both children who are under 13.
He described Izatt as a "dangerous individual" who posed a serious risk of significant harm in the future.

The Corporate Area pastor who has been charged for allegedly raping and impregnating a 12-year-old girl, has consented to do a DNA test to help clear his name.
Kenneth Blake, 56, of Harbour View in St Andrew, appeared in the Kingston and St Andrew Parish Court on several charges on Wednesday, and signed an order authorising the DNA test after his attorney indicated to the court that Blake was prepared to take the step in a bid to establish innocence on his part.
The churchman, who heads the Harvest Temple Apostolic Church on Slipe Pen Road in the Corporate Area, faces charges of rape, grievous sexual assault, forcible abduction, sexual touching, and sexual intercourse with a person under the age of 16 years old.
The allegations are that he had sex with the child on several occasions in 2015, resulting in her getting pregnant.
Further allegations are that he used cash and other forms of gifts to keep her quiet about their alleged sexual contacts.
Notably also, the child is a daughter of a former officer of the church with whom the pastor has acknowledged having had an intimate relationship with in the past
The accused, who has denied having had any sexual contact with the child, was offered $1.5 million bail by Parish Judge Simone Wolfe-Reece under a batch of strict conditions. These included not to have contact with the complainant, her mother or other siblings, and not to be alone with any person under the age of 18 year, unless they are his children.
In court, Blake’s lawyer, Able-Don Foote, suggested that the allegations against his client emanated from malice and ill-will from the complainant’s mother, whom he alleged had stolen $300,000 from the church.
The attorney confirmed that Blake was previously in a relationship with the child's mother, who was an officer of the church up to July of this year. Foote said the relationship between the two adults ended early in 2015.
It was suggested that the sexual abuse allegations emerged after Blake stopped supporting the child’s mother and she fell into financial difficulties, which culminated with the alleged theft from the church.

Note: The stats below are 'reported' cases which make up a small part of the actual number of cases of child sex abuse. As such, the high percentage of teachers abusing children, while very concerning, is probably too high in actuality because the majority of sex abuse happens in the victim's home and involves a family member or neighbour. Consequently, those numbers should be much higher than reported.
St Edmund's College teacher on trial for alleged historic sex abuse

A former Canberra school teacher was sacked from St. Edmund's College after allegations of improper conduct with a student, a court has heard.
The alleged victim did not go into detail with the school headmaster at the time and then kept his silence after Garry Leslie Marsh's termination.
The ACT Supreme Court has heard that coverage of the Royal Commission into Institutional Responses to Child Sexual Abuse stirred memories and prompted the alleged victim to report the matter to police 35 years on.
But the defence says this passage of time disadvantaged the accused as it made it harder to challenge the allegations.
Marsh, 72, of Sydney, is on trial before Justice John Burns accused of indecent assault and buggery.
He has pleaded not guilty.
One count of indecent assault was dropped during the trial earlier this week due to lack of evidence.
The abuse allegedly took place between 1979 and 1980 when the alleged victim was aged about 13.
Jurors have heard Marsh – who had been the boy's school teacher and football coach – had struck up a friendship with the teen after his parents separated.
The boys mother worked long hours and he would spend time at Marsh's home, receive lifts to football, and on one occasion, slept over. The Crown alleges that Marsh used this relationship to indecently assault the boy on six separate occasions.
The court also heard allegations that Marsh would watch the boys in his care shower and change after physical education and would grab at their groins and buttocks as a game. Prosecutor Jane Campbell argued this behaviour showed Marsh had a sexual attraction towards the alleged victim.
In her closing, Ms Campbell said the alleged victim had reported the allegations to his mother and a friend at the time. The school had been notified and Marsh's position terminated.
He later left the country to work in Nauru.
Ms Campbell also pointed to a number of apparent contradictions between Marsh's statement to police and his evidence from the witness stand, including that no children had visited his home, the alleged victim had not slept over at his house, and he had not driven students in his car.
But defence barrister, Ray Livingstone, argued the prosecution's case had amounted to an array of allegations and had not discharged the burden of proof beyond reasonable doubt.
He said it would be appropriate for jurors to return verdicts of not guilty.
Justice John Burns gave jurors final directions and sent them to deliberate on the fate of Marsh on Thursday afternoon.
The jury were sent home for the night about 4.30pm and will reconvene to continue their deliberations on Friday morning.
SA, NSW arrests over online child sex abuse
and exploitation material
Two South Australians and a woman from New South Wales have been charged over online child sex abuse and exploitation material, as part of an investigation involving SA, NSW and Federal Police.
Officers said a 34-year-old man from Adelaide's northern suburbs had been refused bail over alleged possession and dissemination of child exploitation material.
A 32-year-old woman from regional NSW was refused bail and will face court in Taree accused of aggravated sexual assault of a child and dissemination of child abuse material.
A 45-year-old woman from Adelaide's northern suburbs, also denied bail, is facing aggravated offences of production, possession and dissemination of child exploitation material, indecent assault and gross indecency allegations.
Police warned the public that any app, online game or social media platform which allowed people to be in contact with others they did not know could put them at risk.
They urged anyone with information about people involved in online child sexual exploitation or abuse to report the issue to Crime Stoppers on 1800 333 000.
Case involving sexual abuse at a crèche
provisionally closed
The case involving a child who was reportedly sexually abused at a crèche (daycare) in the Boksburg CBD has been provisionally closed.
Members of the Child Protection and Sexual Offences Unit were forced to provisionally close the matter because there is inadequate evidence to support the allegations and to link someone to the crime.
Members of the unit registered a case of sexual abuse after a little girl, who was complaining of pain in her genitals, told her mother that a man sexually abused her with his fingers at the crèche.
“Detectives investigated the possibility of the abuse but they could not find any proof to support the claim,” said the Boksburg SAPS spokesperson, Sgt Cebisa Maseko.
Maseko added the child failed to give a statement to the investigators.
You must have specially trained police woman and men who can deal with children. Regular police, especially uniformed police, should never interview a child sex victim.
Despite the withdrawal of the sexual assault case at the CBD crèche, Maseko still encourages parents to always monitor the state of their children and immediately report anything suspicious that points to child abuse, to the police.
