Three men deny raping woman who was vulnerable due to alcohol in Maastricht




Three men aged 19, 22, and 24, who are accused of raping a young woman in October of last year in Maastricht, deny forcing her to have sex. The suspects claim that the woman consented to the sexual acts. The Public Prosecution Service (OM) believes that the suspects took advantage of the woman’s “vulnerable state,” partly due to alcohol use.

The 18-year-old victim was reportedly raped during the evening hours of October 28, leading into October 29, when she was on her way home after a night out. She encountered four men by the Sint Servaasbrug. Because the woman was still unfamiliar with her new neighborhood, the four offered to take her home.

Instead, she was taken to a building on Hoogbrugstraat, where she was reportedly raped. The police later released blurred CCTV footage, which resulted in the arrest of all four suspects.

Three of the men appeared at a public hearing for the first time on Tuesday. “I think it’s strange that the prosecution is accusing me of rape with violence,” defendant Mohamad A. told the court through an interpreter. “I did have sex, but it was not forced.” The OM said that a co-defendant testified that A. had sexual intercourse with the victim against her will.

Suspect Ibrahim I. is also accused of two other instances of sexual violence in addition to the rape accusation. In May, he allegedly raped a girl under 16 in Maastricht and is also facing charges of sexual assault.

The court decided that the three suspects will stay in detention. The presiding judge stated that allowing them to remain free while awaiting trial would be hard to justify to society. A fourth suspect may face the court at a later date, though it is unclear when; he is currently not in custody.




Father and twin sons jailed in Rotterdam for incest and long-term abuse of daughter




A court in Rotterdam has sentenced a father to five years in prison in an incest case. For years, he physically and sexually abused his daughter. Her twin brothers, who also assaulted her, received prison terms of 32 months each, with 8 months conditionally suspended.

The victim was abused by her father from the age of 12 to 19. The sexual abuse included groping, rape, and sexual assault, and occurred weekly. Other instances of abuse included hitting the girl with a stick, slapping, or punching the girl.

The court found the victim’s statements to be credible, partly because they were detailed and consistent and were supported by other evidence. The trial also revealed that the strictly Christian family from Rotterdam-Zuidwijk had lived in isolation, dominated by the father’s control.

Psychiatric evaluations showed that both the father, Marius van der P., and his sons, Johannes and Bouwen van der P., have autism spectrum disorders. The court sentenced the father to five years in prison along with mandatory psychiatric therapy at a TBS facility under conditions, while the brothers must also receive treatment.

Prosecutors had sought harsher penalties: eight years in prison and TBS with compulsory treatment for the father, and 54 months and TBS with conditions for the brothers.

Actor Gerard Depardieu found guilty of sexually assaulting 2 women

French film star Gerard Depardieu has been found guilty of sexually assaulting two women during the filming of a movie in 2021 and will serve an 18-month suspended prison sentence.

He was also fined €29,040, and the court requested that he be registered in France’s national sex offender database.

Depardieu, 76, was convicted of groping two female employees: a 54-year-old set dresser and a 34-year-old assistant during the filming of Les Volets Verts.

The set dresser said Depardieu trapped her between his legs in a narrow corridor before grabbing hold of her hips and groping other parts of her body, including her chest. She also said he used an obscenity to ask her to touch his penis and suggested he wanted to rape her.

She told the court that the actor’s calm and cooperative attitude during the trial bore no resemblance to his behaviour at work.

The other defendant said that Depardieu groped her buttocks and breasts on three separate occasions on-set.

The case was widely viewed as a post-#MeToo movement test of how French society and its film industry would handle allegations of sexual misconduct involving high-profile individuals.

Depardieu, who has denied the accusations, did not attend the hearing in Paris. His lawyer said the actor would appeal the decision.

Following his conviction, Carine Durrieu Diebolt, the set dresser’s lawyer, said, “It is the victory of two women, but it is the victory of all the women beyond this trial.”

“Today, we hope to see the end of impunity for an artist in the world of cinema,” she continued. “I think that with this decision, we can no longer say that he is not a sexual abuser. And today, as the Cannes Film Festival opens, I’d like the film world to spare a thought for Gerard Depardieu’s victims,” she concluded.

Depardieu told the courts he has made more than 250 films throughout his illustrious career, propelling him to the pinnacle of French cinema. In 1991, he received an Oscar nomination for his performance in Cyrano de Bergerac as the eponymous lead.

In recent years, the actor has been accused of misconduct by more than 20 women, but only the sexual assault case went to court. Several other cases were dropped due to a lack of evidence or a statute of limitations.

During the four-day trial in March, Depardieu denied the accusations, saying he’s “not like that.”

Nonetheless, he acknowledged that he had used vulgar and sexualized language on the film set and that he grabbed the set dresser’s hips during an argument. He denied that his behaviour was sexual.

The court’s three-judge panel decided that Depardieu’s explanations were “unpersuasive” and “not credible” and stressed both accusers’ “constant, reiterated and substantiated declarations.”

The court also said Depardieu’s defence team employed an “aggressive” defence strategy and considered their comments in court to have caused more harm to the plaintiffs, therefore justifying higher fines.

Depardieu’s lawyer, Jérémie Assous, said he regretted that the court “considered that questioning the accusations is an additional assault,” adding that this type of defence, “even in this type of trial, is no longer accepted.”




World junior complainant finishes testimony after marathon round of questioning

The female complainant in the high-profile world junior sexual assault trial has finished her time on the stand after first taking it nearly two weeks ago.

The 27-year-old woman, whose identity is protected under a standard publication ban, has been appearing virtually inside a London, Ont., courtroom since May 2.

She began her testimony against five former members of Canada’s world junior hockey team that day and wrapped up on May 5, after which she was subject to tense cross-examination that finished Tuesday.

Crown prosecutors Wednesday followed up on any topics raised in cross-examination. Re-examination, as its known, was bogged by legal arguments that were made without the jury present; matters discussed when the jury is not present can’t be reported until after jurors are sequestered to deliberate.


Not in order

Michael McLeod, Carter Hart, Alex Formenton, Dillon Dube and Callan Foote have all pleaded not guilty to charges of sexual assault stemming from what the Crown alleges was non-consensual group sex in McLeod’s room at the Delta hotel in London back in June 2018. McLeod has also pleaded not guilty to an additional charge of being a party to the offence of sexual assault.

Court has heard the team was in town for events marking its gold-medal performance at that year’s championship, and E.M. was out with friends when they met at a downtown bar on June 18. After being with McLeod and his teammates at the bar, E.M. would go on to have consensual sex with McLeod in his room in the early morning hours of June 19.

Court has heard E.M., who was 20 at the time, was in the washroom after she had sex with McLeod and came out to a group of men in the room allegedly invited for a “3 way” by McLeod in a group chat.

Throughout the marathon cross-examination, defence lawyers have suggested E.M. wasn’t as drunk as she has testified she was, wanted a “wild night” with the players, was “egging” them on to have sex with her and accused her of having a “clear agenda” at the trial.

E.M. has both pushed back against those claims, and at points outright rejected them, saying she was coaxed into staying in the room, was disrespected and was taken advantage of by the group who she said “could see I was out of my mind.”

When the jury was present Wednesday, Crown prosecutor Meagan Cunningham sought to have E.M. clarify how she knows she wouldn’t have said the things defence lawyers are suggesting she may have said in McLeod’s room.

“I had left with only one person, and that after a sexual encounter, I’m assuming I’m just staying in bed and staying there and not expecting anything else,” she told Cunningham.

“I left under one certain impression that I was leaving with him, and that would be how the night ended.”

After answering Cunningham’s questions, Superior Court Justice Maria Carroccia released E.M. Court will now hear from the next Crown witness in the case.

Diddy trial Day 2: Ex-girlfriend Cassie Ventura testifies about ‘freak-offs’

As the sex trafficking trial for Sean “Diddy” Combs enters its second day, Combs’ ex-girlfriend, Cassie Ventura, took the stand Tuesday.

Ventura is considered a star witness for the prosecution and her testimony is particularly valuable. Combs was captured on security video violently assaulting Ventura in a hotel hallway in 2016.

The video was obtained and distributed by CNN in May 2024, and showed Combs launching a brutal physical assault on Ventura in which he grabbed her by the back of the neck and threw her to the floor, before kicking her twice while she lay on the ground.

While giving testimony, Ventura became emotional at times and spoke about feeling the “disgusting” and “humiliated” by Combs’ control over her, particularly during his alleged days-long sex parties, where she says she was forced to have weekly sex with escorts while her boyfriend plied her with drugs, watched, recorded and orchestrated her behaviour.

Day 2

As an eight-month pregnant Ventura entered the court Tuesday, Combs turned in his chair to watch, reports the New York Times. She didn’t meet his gaze, looking straight ahead as she walked to the front of the room.

“There were violent arguments that would usually result in some sort of physical abuse. Dragging, different things of that nature,” she told the court, when asked by the prosecutors to describe her relationship with the rapper.

She testified that Combs would mash her head, drag her, kick her and stomp on her when she was down.

Asked how frequently Combs became violent with her, Ventura softly responded: “Too frequently.”

She was then asked about her role in Comb’s so-called “freak-offs” — the drug-fuelled, multi-day sex parties her ex allegedly orchestrated.

Ventura told the court the parties stemmed from Combs’ interest in voyeurism, and they would entail hiring an escort and “setting up this experience so that I could perform for Sean,” Ventura said.

A chiropractor in British Columbia who has faced several allegations over the last three decades of sexually assaulting or inappropriately touching his patients has agreed to permanently give up his licence ahead of his next criminal trial.

Murray Kievit's registration will be cancelled for life as of July 31, even though he denies allegations of improperly touching a patient, according to a notice from the College of Chiropractors of B.C.

Kievit, from Vernon, B.C., is set to go to trial in January on two counts of sexual assault, the B.C. Prosecution Service confirmed Thursday. The Crown is not releasing further details of the allegations, including whether the criminal case involves a patient.

Kievit could not be reached for comment.

This will not be his first trial for sexual assault or his first brush with professional discipline for inappropriate touching.

Twenty-three years ago, Kievit was found not guilty of sexual assault after six women alleged he had touched their breasts and pubic areas during treatments between 1995 and 1998, according to reports in the Vernon Morning Star newspaper at that time.

Following his acquittal in 2000, Kievit signed a consent agreement with the college admitting that he had failed to meet the expected standard of care "in relation to the provision of treatment in the patient's pubic area that resulted in unintentional violations of their sexual integrity," according to a public notice.

Amazing! And he was found 'not guilty' of sexually assaulting 6 women. Ahhhh! Canadian Justice!

That consent agreement included a fine, restrictions on his ability to do pubic treatments and a promise to minimize accidental contact with patients' breasts and genitals.

Kievit was disciplined again in 2009 after admitting he didn't get consent before placing his hands in the front of a patient's pants to treat her pubic bone, according to another public notice.

He also acknowledged improper use of a teddy bear during that treatment, the college says, which was "without clinical benefit, inappropriate to any intended clinical purpose, and demonstrated a lack of gender sensitivity."

The college's notice does not go into any further explanation of how the teddy bear was used, but says the incident resulted in discipline measures including a three-month suspension and an apology letter to the patient.

In response to the most recent complaint of inappropriate touching, Kievit has been required to have a chaperone present during all appointments with female patients since January 2022.

Now his licence has been permanently cancelled, Kievit has also agreed not to engage in any form of health care again, and must pay costs of $1,000.

A man on a Delta Air Lines flight downed at least 10 vodkas and a glass of wine before groping a 16-year-old girl and her mother, according to a lawsuit.

Flight attendants on the nearly nine-hour nightmare flight out of JFK Airport “blatantly ignored” the pair’s pleas for help — including a demand to stop giving the abuser booze — according to court papers filed Tuesday in Brooklyn Federal Court.

Staffers then allegedly let the jailbait-loving drunkard quietly walk off the plane when it landed in Athens, Greece, without notifying local police of an alleged sexual assault.

“What happened to them during a flight was not just a nightmare, it was completely preventable,” said the family’s lawyer, Evan Brustein, of the July 26, 2022 trip.

Flight staff allegedly served the man vodka even though he was noticeably drunk.

He “frightened” the teen by putting his hands on her back, making “obscene gestures,” screaming, and demanding she tell him her address and other personal information, the family claims.

He also told the mom he “did not care” the daughter was a minor.

When the mom complained, a flight attendant blew her off, telling her to “be patient.”

The unidentified man, who “mumbled” that he was from Connecticut, gave the mother and daughter a brief reprieve by heading to the bathroom to “loudly” puke before returning with a glass of wine, they contend.

Rather than move the man to a different seat, a flight attendant allegedly told him to “stop talking” to the victims, prompting an enraged, profanity-laced outburst from the drunk, who called mom and her kid “f–king bitches.”

Delta declined to comment on the allegations in the suit.

The teen began to have a panic attack and put her head down in her mom’s lap, only to “feel the intoxicated Delta passenger’s clammy fingers underneath her shirt climbing up her back … fingering her bra strap and moving over her body,” according to the $2 million lawsuit.

She jumped out of her seat crying, and the drunk passenger then allegedly reached over and put his hand up the mother’s leg before she screamed at him to stop and also jumped out of her seat.

The mother demanded a Delta flight attendant contact the police but was told to “calm down and think about it.” The victims then switched seats for the rest of the flight.

When the plane landed, the flight attendants offered 5,000 free airline miles as an apology.

Delta declined to comment on the lawsuit but insisted it “has zero tolerance for customers who engage in inappropriate or unlawful behavior.”

Yeah! Sounds like it!

Aug. 1 (UPI) -- Australian police on Tuesday announced charges against a former childcare worker in connection with the suspected sexual abuse of 91 young girls at early learning facilities across Brisbane and Sydney for more than a decade.

Australian Federal Police officials withheld the name of the 45-year-old Gold Coast man accused of 1,623 separate offenses, including 136 counts of rape and 110 counts of having sex with children under 10 years old.

Authorities described the alleged crimes as "horrific" and "unfathomable," claiming the suspect filmed himself committing rapes and other sex crimes inside the facilities before uploading the videos to the dark web.

The victims were pre-pubescent girls at the time, but are now all more than 18 years old, authorities said, adding that 87 survivors had been identified so far, including all the victims in Australia.

The man -- who was taken into custody a year ago in Queensland -- used digital cameras and his cellphone to record the acts during his employment with 10 childcare centers in Brisbane between 2007 to 2013 and 2018 to 2022, police said.

At the time of the man's arrest, authorities seized more than 4,000 images and videos of the alleged abuses, resulting in charges on two counts of making child exploitation material and one count of using a carriage service for child abuse material.

The suspect also faces charges in connection with abuses at a foreign daycare facility in 2013 and 2014, where four children were abused, and another early learning center in Sydney between 2014 and 2017.

Investigators said evidence showed he worked at several other childcare sites where he did not offend.

"It's beyond the realms of anyone's imagination what this person did to these children," said New South Wales police force Assistant Commissioner Michael Fitzgerald. "I can only say, you try not to be shocked after a long period of time in the police and crime reporting, but this is a horrific case."

Last August, police launched Operation Tenterfield after they discovered the illicit content on the dark web and traced the image metadata back to a childcare center in Brisbane, where some of the files were created.

Days later, federal agents arrested the suspect in the middle of the night at a suburban home in southwest Brisbane. After going through the man's mobile devices, police said they uncovered additional morbid recordings that dated back at least 15 years.

Over the past year, detectives have worked tirelessly in an effort to contact the victims in hopes of bringing closure to the case.

"These are horrific crimes (but) the AFP never gave up, and our partners never gave up, in terms of identifying all of the children," said AFP Northern Assistant Commissioner Justine Gough. "We are highly confident that all of the children who are subject to the recorded child abuse material have been identified and contact made with parents."

FBI: Woman kidnapped, raped, kept in cinderblock cell

Local, state and federal law enforcement officials are asking for the public’s help in identifying potential victims of a violent sex assault offender who has lived in at least 10 states, including in the Portland area.

At a press conference held Wednesday, Aug. 2, Stephanie Shark, FBI special agent in charge, laid out the details of the July 16 arrest of Negasi Zuberi, 29, in Klamath Falls. Zuberi allegedly kidnapped a woman in Seattle on July 15, drove her for seven hours to his home, where he assaulted her, and locked her in what authorities call “makeshift cinder block cell" with a metal door and a single light bulb.

“Some cases alarm even the most seasoned of investigators, particularly when shocking details are revealed and we see that there may be multiple victims,” Shark said. “This is that kind of case.”

According to court records, on Saturday, July 15, 2023, Zuberi traveled from his home in Klamath Falls to Seattle, Washington, where he solicited the services of a prostitute, posing as an undercover police officer. The victim told investigators that he pointed a taser at her and placed her in handcuffs and leg irons. He allegedly put her in the back seat of his car. He then traveled roughly 450 miles with the woman, sexually assaulting her during the trip.

According to the victim, once he arrived at his home in Klamath Falls, Zuberi moved her into a makeshift cell that he had constructed in his garage. 

“The woman fought for her life, beating on the doors of the cell with bloody hands,” Shark said. “Sadly, we believe there are more victims, as well as persons out there who may have vital information.”

The victim "bravely escaped her terrifying circumstances,” said Shark, who previously served in the FBI’s counterterrorism division. The victim has not been identified, but Shark said she is physically OK and is receiving victim services.

“She forced her way out of that cell,” said Capt. Rob Reynolds of the Klamath Falls Police Department. “If she didn’t do what she did, we wouldn’t be here today and Zuberi would not be in custody.”

After escaping the cell, the woman was able to flag down a passing motorist who called 9-1-1.

Zuberi is known by several aliases, including Sakima, Justin Hyche and Justin Kouassi. He was captured July 16 in Reno, Nevada, after a standoff with police. Shark said Zuberi was identified based on information provided by the victim. He is being held in federal custody on charges of interstate kidnapping. Shark said he has only been in Oregon for a few months and has lived in nearly a dozen other states.

Zuberi has lived in 10 states over the last 10 years and FBI investigators have reason to believe there could be additional sexual assault victims. Those states could include: California, Washington, Oregon, Colorado, Utah, Florida, New York, New Jersey, Alabama, and Nevada.

Authorities said Zuberi may have used several different methods to gain control of his victims; including by drugging their drinks and impersonating a police officer. The victims are often threatened with retaliation if they notify the police.
