‘Most vile and horrific case’: Princeton, WVi, woman sentenced in child sexual assault trial

PRINCETON — A woman who pleaded guilty last year to first-degree sexual assault, sexual abuse and incest involving videos of a child subjected to sexual acts learned Wednesday that she will be 88 years old before she’s eligible for parole.

Elizabeth Haway, 43, of Princeton was brought before Mercer County Circuit Court Judge William Sadler for sentencing. Haway pleaded guilty in December 2019 to two counts first-degree sexual assault, two counts first-degree sexual abuse, two counts sexual abuse by a parent, guardian, custodian or person of trust, and incest.

The case started on April 2, 2018 when Detective-Sergeant Steve Sommers, with the Mercer County Sheriff’s Office, responded to a cyber tip that was received from the National Center for Missing and Exploited Children involving the distribution of child pornography through Facebook Messenger.

In a criminal complaint, Sommers stated that he reviewed the video file and it showed an adult male engaging in a sexual act with a prepubescent female child. Sommers also found graphic messages between Haway and another Facebook user, according to the complaint. He then obtained and served a search warrant on Facebook, compelling them to disclose Facebook records for Haway.

“As I searched her Facebook records further, I found two video files that were approximately 3 minutes and 21 seconds (each) in length that had been sent to another Facebook user,” Sommers stated in the complaint. After viewing the video file that included audio, he saw that it showed an adult female with the prepubescent female engaging in sexual acts.

“I estimated the age of the child to be between 5 and 6 years of age,” Sommers said in the report. “I also observed that the bathtub had distinct cracking of the molding at the wall and bathtub and that the adult female had a tattoo on her finger of a smiley face (two dots and a line).”

Sadler said as he sentenced Haway that “lifelong damage has been inflicted on this child.”

“This child has lost innocence that can never be restored on replaced,” Sadler stated. “I’ve been involved in the criminal justice system for over 30 years. From that standpoint, this is one of the most vile and horrific cases I have ever experienced in the criminal justice system.”

Haway had a sex offender evaluation before Wednesday’s sentencing hearing. Sadler reviewed the resulting report and said the one of its most revealing aspects was the examiner’s conclusion that the offenses involved detailed planning and were not done on impulse.

“These acts were set up and planned,” Sadler said. “That’s a frightening conclusion. Frightening.”

The report stated that Haway was abused when she was a child and had a history of psychiatric treatment. She also has a criminal history including embezzlement, distribution of cocaine and possessing contraband in prison, Sadler said. Haway is facing child pornography charges in federal court since the video was shared with another individual.

Prosecuting Attorney George Sitler described the crimes as “heinous and disturbing. On behalf of the victim, I would ask that the maximum sentence be imposed,” he said.

Haway was sentenced to a term of 25 to 100 years on both counts of first-degree sexual assault, which will run currently (concurrently?). She received another five to 25 years on both counts of first-degree sexual abuse, which will run concurrently. Sadler also sentenced her to serve 10 to 20 years in prison for two counts of sexual abuse by a parent, guardian or custodian. Those sentences will run concurrently. She will also serve five to 15 years on each of the two incest charges, which will run concurrently. 

Sitler estimated that this gave Haway a sentence of 45 to 155 years in prison. She will be about 88 years old when she is eligible for parole.

Sadler informed Haway that if she is ever released from prison, she will be required to register with the West Virginia State Police as a sex offender and serve 20 years of supervision. 

Attorney Paul Cassell, special prosecutor for crimes against children, also represented the state at Wednesday’s hearing.




Pomona, Ca, leaders demand resignation of councilman accused of possessing child pornography

The Pomona City Council voted unanimously this past weekend to censure one of their own, Councilman Rubio Gonzalez, following his arrest on child pornography and molestation charges.

At a special City Council meeting late Saturday, May 23, two days after authorities arrested 45-year-old Gonzalez, Pomona Mayor Tim Sandoval called for the council to deliver a letter asking for the councilman’s resignation from office, effective immediately. The letter has been delivered but the city had not received a reply by midday Tuesday.

Efforts to reach Gonzalez were not successful Tuesday.

If Gonzalez chooses not to resign, Sandoval said, the city will monitor the situation and possibly explore other legal options to remove him from office.

Gonzalez’s continued presence “will present a distraction from the significant work the City Council has to perform for the community, especially as we search for ways to assist our residents and businesses and safely reopen the city,” Sandoval said, according to a recording of the Saturday meeting.

Gonzalez was scheduled to make his first appearance in a downtown Los Angeles courtroom on Tuesday but that was rescheduled to Aug. 28, according to spokesman for the Los Angeles County District Attorney’s Office.

According to the DA’s office, authorities arrested Gonzalez Thursday, May 21, on suspicion of possession of “child sexual abuse material” and annoying or molesting a child.

In a statement early Saturday, Rep. Norma J. Torres, D-Pomona, said Gonzalez should step down immediately. She called for an investigation into whether there have been prior complaints “of a sexual nature” involving the councilman, either at the city of Pomona or the Pomona Unified School District, where Gonzalez is a substitute teacher.

“If you did this, resign now,” Torres said, according to the statement. “Do not force our community to wait if you know the verdict will eventually be guilty. And if you are innocent, I urge you to cooperate fully with law enforcement to remove this cloud of suspicion as quickly as possible.”

Seriously! He can't resign now without appearing guilty. What a dumb thing for Rep Torres to say.




Oklahoma man behind bars for child sex crimes charges in Wichita County

A Waurika, Oklahoma, man is accused of 11 child sex crimes committed against a little girl over nearly five years in Burkburnett, according to court documents.

The child recounted incidents of alleged sexual abuse inflicted on her, beginning when she was 4, under the guise of playing a game while her hands were bound and she was blindfolded, court records show. 

Cody Allen Atwood, 27, was being held on $5500,000 (???? - your guess is as good as mine) in bonds Tuesday in Wichita County Jail, according to online jail records. He was booked into jail Thursday. 

He faces up to life in prison if convicted of any one of the 11 charges against him. They are all first-degree felonies. 

A Wichita County grand jury handed down sealed indictments against Atwood for a charge of continuous sexual abuse of a child under 14 in connection with incidents from June 1, 2014, through March 2, 2019, according to court records filed March 5. 

He was also indicted on 10 charges of aggravated sexual assault of a child alleged to have taken place over the same time period, court documents show. 

If Atwood goes to trial, jurors could opt to convict him of any of the aggravated assault charges if they determine he is guilty instead of the charge of continuous sexual abuse if they don't believe it was proven. Atwood is innocent until proven guilty. 

Atwood was arrested for a charge of continuous sexual abuse of a child under 14 on April 30, 2019, according to jail records. He was released May 3, 2019, from Wichita County Jail on a $50,000 bond for that charge until his recent arrest. 

A Burkburnett police arrest warrant gave this account: An 8-year-old girl spoke with a forensic interviewer in a videotaped conversation March 2, 2019. 

The interviewer asked the girl if something had happened to her or if she was worried about something. The girl shook her head yes. She promised the interviewer that she would tell the truth. 

She said an incident happened when Atwood came into her bedroom. Atwood told her they were going to play the “food game.” The 8-year-old described a game in which Atwood sought to trick her into giving him oral sex.

During this game, he would blindfold her and bind her hands behind her back, but she could at times see under the blindfold. The blindfold fell off once, and Atwood was standing in front of her naked. 

The girl said he used pink pajama bottoms to cover her eyes and a belt or rope to tie her hands, which hurt. 




Foster parent held on $5.5 million bond after report of child sexual abuse in Grimesland, NC

GRIMESLAND, N.C. (WNCT) A foster parent is being held under a $5.5 million bond after a report of child sexual abuse in Grimesland, deputies said.


On April 17, the Pitt County Sheriff’s Office received a report alleging child sexual abuse involving Aaron Michael McLawhon of 1383 Tucker Road in Grimesland. 

At the time of the incidents McLawhon was the foster parent of the victim child, deputies said.

On Thursday, detectives arrested McLawhon on the following charges:

Three counts felony statutory sexual offense with a child by an adult
Felony sexual act by substitute parent/custodian
Felony indecent liberties with a child

McLawhon was sent to the Pitt County Detention Center under a $5.5 million bond.


The case remains under investigation.






Montana former deputy sentenced for taking
sexually explicit photographs of a minor

GREAT FALLS — Virgil Allen Wolfe was sentenced in federal court in Helena on Thursday after admitting to taking sexually explicit photographs of a minor.


Wolfe, 54 years old, pleaded guilty in May 2019 to sexual exploitation of a child.

The prosecution said in court records that law enforcement had received a report that Wolfe used a camera to take photographs of the victim in the nude and then uploaded them to his computer. The victim was younger than 12 years of age.

Law enforcement officers with Homeland Security Investigations and the Cascade County Sheriff’s Office executed a search warrant at Wolfe’s residence in June 2017 and seized computers, a phone and a digital camera. A forensic analysis of the devices found child pornography images on a computer and on a memory card inside the camera. The images were taken in 2008 and 2009.

Senior U.S. District Judge Charles Lovell presided and sentenced Wolfe to prison for 21 years and eight months, followed by a lifetime of supervised release.


(MAY 29, 2019) A former Lewis & Clark County Sheriff’s deputy has entered into a plea agreement for sex abuse charges.

In April, Virgil Wolfe was charged in federal court with three counts of sexual exploitation of a child. On May 17, he pleaded guilty to one count of sexual exploitation of a child.

The contents of the plea agreement are sealed until sentencing.

The government’s order of proof states law enforcement received a tip Wolfe was taking nude photos of an underage victim.

During an interview with authorities, the victim said Wolfe used a camera and uploaded the photos to his computer. Wolfe’s home was searched in June of 2017 and several electronic items were taken.

The Rocky Mountain Information Network examined the devices and found child pornography under the user profile of Virgil Wolfe.

Wolfe’s sentencing was set for August 29 (13th story on link) at the federal courthouse in Helena. He remains in custody.




N.C. Deputies charge suspect in decade-old
child sex abuse case

After being investigated and accused of child sex abuse more than a decade ago, a Selma man now faces two dozen charges in three Wilson County cases involving two victims, officials say.

The Wilson County Sheriff’s Office arrested 53-year-old Gregory Allen Bunn on Friday. He’s charged with four counts of first-degree rape of a child, seven counts of first-degree sex offense against a child and 13 counts of disseminating pornography to a child.

Bunn is being held in the Wilson County Detention Center under a $200,000 secured bond.

In March, a victim contacted the sheriff’s office about a sexual assault investigation into Bunn that occurred 15 years ago and wanted to know why he was never charged in the case, said Wanda Samuel, sheriff’s office chief of staff.

Samuel said the current sheriff’s office sexual assault detective, Julie Jackson, immediately began looking into it and spoke to the victim, who is now an adult. After that, Jackson began an investigation.

REOPENED INVESTIGATION

Jackson was able to find three reports accusing Bunn of child sex abuse involving two victims, according to Samuel. Reports were filed in 2005, 2008 and 2009, all during former Sheriff Wayne Gay’s administration. Sheriff Calvin Woodard took office in 2010.

The victims were 5 and 7 years old when the alleged sexual abuse was reported, officials said.

Jackson also looked into the sheriff’s office archives for any hard copies of notes, statements or child medical evaluation reports from those cases, but none were found, according to Samuel. The detective did find documentation of three reports in the system.

“All evidence from the 2005 case had since been destroyed, and the only item left was a CD containing photos,” Samuel said.

DOCUMENTATION

Jackson reached out to the Wilson County Department of Social Services and the Tedi Bear Children’s Advocacy Center in Greenville, which assists law enforcement by providing assessments for children who may have been victims of child abuse and neglect. The detective also contacted former Wilson County Sheriff’s Office employees to determine if they had information on the cases, according to Samuel.

Jackson then requested any and all documentation from those agencies and or parties involved in the cases. Jackson was able to reopen the case based on what she discovered, and Bunn was charged on Friday.

Samuel said due to the sensitivity of the investigation, details of the allegations will not be released.

“There was enough probable cause developed from the investigation back then that could have led to warrants being obtained against the suspect by the investigator,” Woodard said in a statement. “Victims need to be taken seriously regardless of their age.”

The Johnston County Sheriff’s Office and N.C. State Bureau of Investigation assisted the sheriff’s office in Bunn’s apprehension.

TEXARKANA, Texas — A father and son have been arrested by Texarkana, Texas, police for alleged continuous sexual abuse of a 7-year-old child to whom they are related.
David Fant, 56, and Hayden Fant, 19, were taken into custody Wednesday afternoon, Texarkana, Texas, Police Spokesman Shawn Vaughn said. Court records show both defendants were released Thursday afternoon on bonds of $200,000 each.

The alleged victim's parents contacted police last week after a disclosure regarding the alleged abuse was made by the child. Investigators believe the abuse occurred over several years at the Fant home in Texarkana, Texas.

Detective Tabitha Smith obtained arrest warrants for both father and son after her investigation yielded information allegedly corroborating the child's account, Vaughn said. Following the arrest of the two Wednesday, a search of their residence was conducted and evidence was seized from the home.

Continuous sexual abuse of a child under 14 is punishable by 25 to 99 years or life in prison and there is no parole from any sentence imposed for the offense.

An arrest warrant was issued for Vincent Michael Darley, 36, of Las Cruces, on May 22.

Darley is charged with two counts of the criminal sexual contact of a minor, and one count of contributing to the delinquency of a minor.

Chicago Tribune report finds 500 cases of sexual abuse, rape in CPS schools over 10 years

CHICAGO (WLS) -- Hundreds of Chicago Public Schools students have been sexually abused by CPS employees over the past ten years, according to a Chicago Tribune report published Friday.

In an article titled, "Betrayed," Tribune reporters detailed more than 500 reports of sexual abuse and rape at CPS schools over the last decade. The report drew from police, public and confidential records.

CPS CEO Janice Jackson sent a letter to all parents of CPS students, detailing steps that are being taken to protect students.

"I'm a parent, I'm a woman this is unacceptable to me," Jackson said.

Tribune reporters spoke to several former CPS students, who said they were abused by coaches, security guards and teachers.

In some cases, teachers and principals who heard reports of abuse failed to notify police or the Department of Child and Family Services. Such reports are required under Illinois' mandated reporter law.

"We are going to train everybody again top to bottom, every principal, teacher paraprofessional, individuals who work with students, we want to make sure everybody is crystal clear on their responsibilities as a mandated reporter," Jackson said.

Jackson said CPS will conduct random background checks on current employees as well as applicants. A former Assistant U.S. Attorney will also do a top-to-bottom analysis of CPS's sexual abuse policies and procedures.

As a precaution, all CPS employees accused of sexual assault will be removed from schools immediately rather than waiting to see if the evidence is credible.

"Parents need to have the confidence we have the structures in place to prevent this from happening," Jackson said.

Representatives from parent group Raise Your Hand said they were horrified by the report and called for schools to have more social workers and counselors.

"I know school is about academics, but we need to be really looking out for our kids in their social and emotional needs," said Jennie Biggs of Raise Your Hand.

According to Raise Your Hand, CPS cut dozens of social workers and school counselors over the last few years.





Man accused of sexually assaulting 8 and 9 y/o girls
arrested in Oklahoma

A man accused of sexually abusing two girls when they were 8 and 9 years old was apprehended in Oklahoma on Thursday, Lake Worth police said.

Isaias Garcia Jr., 44, of Lake Worth faces two charges of aggravated sexual assault of a child, two charges of indecency with a child and one charge of continued sexual abuse of a child, the department said in a post on its Facebook page.

His bond is set at $80,000.

The two girls, now 13 and 14, told a relative that Garcia had been touching them in their private places while their mother ran errands or was away from home at work, according to a probable cause arrest warrant affidavit.





Maryland man charged with sex abuse of a minor

A Washington County man is accused of inappropriately touching a preteen girl.

Luther Eugene Giffin, 60, of Resh Road, is charged with sex abuse of a minor and sex abuse of a minor as a continuing course of conduct.

Washington County District Court Judge Mark D. Thomas set Giffin's bond at $50,000 Friday during a hearing. Giffin previously was held without bond at the Washington County Detention Center.

Thomas ordered that Giffin stay away from the alleged victim and other children unless he is supervised by an adult. In addition, Giffin was ordered to wear a GPS device.

The Washington County Sheriff's Office wrote in court documents that Giffin inappropriately touched the girl over the course of several months in Washington County.

Deputies said the girl told a Washington County Child Protective Services investigator that Giffin touched her more than 10 times.

Giffin initially denied to detectives that he touched the girl, but he later admitted to touching the girl 10 to 15 times when he believed she was asleep, investigators wrote in the documents.

His preliminary hearing is set for June 27.

Virginia Man Sentenced To Prison For Child Pornography

A Fairfax man was sentenced today to five years in prison for downloading videos depicting the sexual abuse of children.

According to court documents, Gabriel Lin, 25, used a peer-to-peer file-sharing network to search for and download child pornography videos. Lin also stored more than 600 videos and 10,000 images of children being sexually abused on electronic devices in his residence. Some of this material depicted children as young as infants and toddlers.

This case was brought as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse. Led by U.S. Attorneys’ Offices and the Child Exploitation and Obscenity Section, Project Safe Childhood marshals federal, state and local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims. Texas man, a former police officer, gets life sentences
for sexually abusing 9 y/o girl

LLANO — A Llano County jury handed a former police officer two life sentences May 31 after he was found guilty of molesting a 9-year-old girl while on a family trip, according to court testimony.

424th Judicial District Judge Evan Stubbs presided over the three-day jury trial, held in the Llano County Courthouse.

Billy Joe Roush, 70, of Kingsland was accused of sexually assaulting the girl in the spring of 2017 while the two were riding in a travel trailer while it was being pulled down the road by the girl’s family.

Since the location of the alleged incidents could not be determined, state law allows for the county of residence for the accuser or the accused to conduct the jury trial. In Roush’s case, counselors agreed to hold court in Llano County, where the defendant lived at the time.

During the trial, the accuser, now 11, and another accuser, an adult who was a child at the time of the defendant’s assault on her, both testified against Roush.

In the sentencing phase, three additional accusers surfaced, two of whom are now adults and the other a child to make statements against the defendant.

Other allegations involved inappropriate comments made to at least three of the alleged victims and an incident in which one alleged victim was forced to view pornographic material.

The defense also introduced information about Roush, including his past police and military service as well as him raising his two sons.

The jury, comprised of seven men and five women, deliberated for more than six hours to reach a guilty verdict on two charges of aggravated sexual assault of a child and deliberated 45 minutes to recommend two life sentences, which the judge stacked so Roush must serve the first life sentence before the second begins.

“Every citizen is entitled to a vigorous defense. That’s exactly what we gave Mr. Roush and did everything we could to defend him,” said defense attorney Austin Shell of Shell and Shell Associates law firm.

Another child sexual abuse case is pending against Roush in Madison County.




Maryland Man Goes to Prison for Child Sex Abuse

in as many days.

SALISBURY, Md.- A Salisbury man convicted of child sex abuse has been sentenced to 17 years behind bars.

Richard Nathaniel Jones, 36, of Salisbury, received a total sentence of 35 years, with all but 17 suspended when he appeared before Wicomico Circuit Court Judge Donald C. Davis late last week. Jones will be required to register as a sex offender for life upon release.

A Wicomico County jury in March 2017 convicted Jones of sex abuse of a minor as a household member and related offenses.

Jones fled while out on bond following his conviction in March 2017 and remained at large for nine months. Jones was finally taken into custody in November 2017 by a member of the Regional Fugitive Task Force.




Utah man on parole arrested for sexual abuse
of two young kids at birthday party

MOAB, Utah (News4Utah) A Moab man currently on parole was charged Friday with two counts of sex abuse of a child for an incident that police say occurred at a birthday party over Memorial weekend. 

According to charging documents Kenneth Sherman, 59, was at a birthday party when a woman noticed one of the children at the party, a 5-year-old girl, was very upset. The girl's mother said she could not get the girl to settle down so she took her and the girl's 7-year-old brother home. 

At home, the girl told her mom that Sherman had touched her and kissed her and that he had touched her brother in his privates while he was sleeping. The mother then called the same witness at the party to advise her of what had happened. The owner of the home confronted Sherman and the witness told police an altercation broke out and police were called. 

Police said several witnesses told them Sherman was visibly intoxicated and one witness had seen him in the room with the two children and when they walked in he got up suddenly and acted strangely. 

Sherman was arrested after police conducted an interview with witnesses and the young girl. The young boy told police he was asleep and does not remember anything.

During his interview with police, Sherman told them the witness had "instructed" the girl to make up the allegations and he didn't know what they were talking about. He refused to speak with police further and requested an attorney.

Sherman is currently on parole for a felony DUI conviction involving a 2-year-old unrelated female who was with him. Charging document state Sherman was also accused of kidnapping the girl, but because of "complications in the case and the lack of a disclosure of sexual abuse by the child", that portion of the charges was dropped.

Good grief!

Sherman was booked into the Grand County Jail on two charges of 2nd degree felony sex abuse of a child.




Texarkana, Ark. man accused of child sex abuse

A Texarkana, Ark., man is facing three felony charges in connection with the alleged sexual abuse of two female relatives.

William Jesse Boswell, 56, was arrested in April for allegedly abusing a teen relative while she was spending the night at his Texarkana, Ark., apartment in March, according to a probable cause affidavit. The alleged victim told an interviewer at the Children’s Advocacy Center in Texarkana that Boswell climbed into the bed where she was sleeping in a guest room, made her kiss him and touched her inappropriately.

Boswell has been charged with second-degree sexual assault in that case. If found guilty, he faces five to 20 years in prison and a fine up to $15,000. Boswell posted a $25,000 bond in April.

After the teen came forward, an adult female relative of Boswell’s disclosed that Boswell “started messing with her” when she was around 7 years old and Boswell was living in Horatio, Ark., and later Dierks, Ark. The adult relative told investigators Boswell continued to molest her after Boswell moved to Miller County when the woman was an 11-year-old.

Boswell is charged with rape and sexual indeceny with a child in that case. Sexual indecency is punishable by up to six years in prison and a fine up to $10,000. Boswell faces 10 to 40 years or life in prison if convicted of rape.

Boswell was arrested a second time in May and posted a second $25,000 bond. He is scheduled to appear in court in Miller County later this month.




19 y/o charged with sexually abusing a minor in NY state

HYDE PARK, NY — State Police have arrested a Hyde Park man on accusations of giving alcohol to and sexually abusing a minor. Police said Jason A. Rugar, 19, of Hyde Park, was charged with third-degree aggravated sexual abuse, a felony, and endangering the welfare of a child and first-degree unlawful dealing with a child, misdemeanors.

State police received a complaint May 17 about possible sexual abuse in the Town of Hyde Park. An investigation found that Rugar sexually abused a child who was younger than 14, as well as provided the victim with an alcoholic beverage, police said.

Rugar was arraigned in the Town of Hyde Park Court and sent to the Dutchess County Jail in lieu of $5,000 bail or $10,000 bond.

An order of protection was requested on behalf of the victim, and it was granted by the court.





A NY father and son were arrested for separate incidents
of child sex abuse

NEWBURGH, NY — State police arrested a father and son in Newburgh for separate alleged incidents of sex abuse. The Troop F Orange County Child Abuse Unit said Jose Alfredo Enriquez-Sanchez, 29, of Newburgh, was arrested after a joint investigation with the Orange County Child Protective Services for first-degree sexual abuse, a felony, and third-degree sexual abuse and two counts of endangering the welfare of a child, misdemeanors.


Police said the investigation was into the sexual abuse of a child who was under 13 years of age and a child under 17 years old.

Enriquez-Sanchez was arraigned in the City of Newburgh Court and sent to the Orange County Jail in lieu of $25,000 bail or $50,000 bond.

During the same investigation, police said it was determined that Enriquez-Sanchez's father — Jose Alfredo Sanchez, 45, of the same address in Newburgh — also abused another child under the age of 13.

Sanchez was charged with two counts of first-degree sexual abuse and one count of endangering the welfare of a child.

He was arraigned in the City of Newburgh Court and sent to the Orange County Jail in lieu of $15,000 bail or $30,000 bond.




Illinois Upward Bound tutor facing child sex abuse charges

SYCAMORE – The former Upward Bound tutor accused of criminal sex abuse of a child younger than 17 and enticing a child younger than 16 posted $5,000 Friday to be released from the DeKalb County Jail.

Flavio C. Leanos-Macias, 25, of DeKalb, has been charged with aggravated criminal sexual abuse, criminal sexual assault and traveling to meet a minor and unlawful grooming. The most serious charge, aggravated criminal sex abuse, typically is punishable by four to 15 years in prison, followed by two years of parole.

Court records show Leanos-Macias posted $5,000 about 2 p.m. Friday afternoon. He told Judge Philip Montgomery during a bond hearing Thursday that he planned to use student loans to post bail.

Leanos-Macias, a former tutor of DeKalb High School students through Kishwaukee College’s Upward Bound program, was arrested Wednesday on a warrant with $100,000 bond attached.

Reasoning that Leanos-Macias has no criminal history, Montgomery reduced bond to $50,000, and Leanos-Macias said he could post $5,000 bail with the loan funds. Montgomery ruled that Leanos-Macias will be fitted with an electronic home monitoring bracelet, and that he have no contact with minors.

According to a news release from DeKalb police, a victim younger than 17 said Leanos-Macias had picked up the minor, who does not live in DeKalb and whom Leanos-Macias had met on the Grindr app, at his residence May 12 and brought him to his apartment in the 800 block of Edgebrook Drive, where the minor said he was sexually assaulted and driven home by Leanos-Macias the next day.

What was he doing on Grindr? I wonder.

Another minor, younger than 16, came forward Tuesday and told police he’d met Leanos-Macias on another app, Hornet, and that they’d had conversations over a 10-day span that included Leanos-Macias trying to convince the minor to engage in sexual activity.

According to the Northern Illinois University directory, Leanos-Macias is a graduate teaching assistant in the sociology department, and also is listed as a student. Montgomery ruled that the electronic home monitoring bracelet will allow Leanos-Macias to go to work and classes, should he be allowed to by NIU.

Father, Son Held for Sexually Abusing Minor Girls

Involvement of victims’ parents suspected

Hyderabad, India: In a shocking incident, two minor girls were sexually abused by their neighbour and his minor son for over a year with the alleged support of the victims’ parents.

Police have arrested the father-son duo and also taken parents of the girls into custody for questioning. 

The victims are aged eight and 10 years.

The victim’s 13-year-old brother and some others were also being questioned by the police for their alleged involvement in what is being suspected as a child sex abuse racket.

Police suspect that the parents of the girls knew about the abuse going on at their house in Mylardevpalli, a locality on the southern fringes of the city.

The police have arrested Jaffar (40) and his minor son on charges of rape, intimidation and under various sections of Protection of Children from Sexual Offences (POCSO) Act.

Jaffer reportedly developed friendship with the victims’ mother and was sexually abusing the sisters with her help.

The victims’ mother is a security guard in a private firm, and their father works at a factory. The family originally hails from Uttar Pradesh and have been living here for the last 16 years.

A friend of the main accused, the minor brother of the girls and his friend were also suspected of being involved.

Authorities had sent the victims for medical examination. They were later moved to a rescue home for counselling and rehabilitation. Officials said the minor girls were in a state of shock.

Balala Hakkula Sangham (BHS), the organisation working for protection of child rights, said the parents were involved in the crime. The BHS demanded that the authorities ask the couple to prove that they are the biological parents of the victims.

BHS President Anuradha Rao suspects it to be a child trafficking racket. She said only a thorough probe could unravel all the details of the crime.

Man gets 10 years probation for child sex abuse, son suicides

An 83-year-old man initially charged with the continuous sexual abuse of a child under the age of 14 instead plead guilty to a lesser charge and received probation in Randall County Court in Texas, on Wednesday.

  Donald Floyd Seager, 83, plead guilty to the charge of lesser included aggravated sexual assault of a child and received 10 years probation. This was the second time that Seager was indicted on charges of the sexual assault of a minor.

“After consultation with our victim and professionals involved in our case, it was decided that the result that was offered to Mr. Seager was the best for all parties involved,” said Robert Love, assistant district attorney for Randall County. “What the case and evidence will allow you to do, and what you would like to do, are different things.”

A 2014 court document filed by the Randall County District Attorney’s office expressed an intent to pursue charges against Seager for 29 sexually-related offenses against 11 children.

Court documents and statements claim that Donald Floyd Seager, along with his son, Ian David Seager, 59, sexually assaulted the victim, who is a family member, over a 5-year period. The statement alleges that Ian Seager would offer alcohol and drugs to the victim and Donald Floyd Seager would offer ice cream and money.

Donald Floyd Seager was indicted on two charges on Dec. 4 of 2013: Aggravated sexual assault of a child, and continuous sexual abuse of a victim younger than 14. The first charge occurred on Mar. 24, 1989, and that case against Seager was dismissed in April of 2015.

“It was just barely outside the statute of limitations and it was dismissed,” Love said.

Although normally the statute of limitations extends 10 years from when the victim turns 18, the amended statute of limitations law only came into effect in 1997. Seager’s attorney, Cristy Jo McElroy, was able to get the first dismissed since the assault happened in 1989 and the new statute of limitations did not apply. McElroy did not return multiple calls for comment.

There should be no statute of limitations for child sex abuse!

The second indictment for the continuous sexual assault of a minor under the age of 14 concerned the abuse of one victim by both Seager and his son, Ian. The son was initially indicted on five counts of sexual assault of a child and one count of indecency with a child.

“Ian (Seager) committed suicide on the evening before our trial began in 2015,” Love said.

Donald Floyd Seager’s plea deal includes 10 years probation and $1,000 fine.

“The plea bargains are the most difficult part and they are never what anybody wants,” Love said. “Unless he violates his probation or the judge revokes his probation he will not serve time.”

But surely, Mr. Love, you could have done better than that. A year or two off the streets would probably spare a child or two. Now he is on the honor system - and pedophiles don't have any honor. You have to wait until he abuses another child, and gets caught, before he gets any jail time. 

Love said that Seager will have to register as a sex offender and cannot live within 1,000-feet of a school, day care or church. He cannot do drugs and has to report weekly to a community supervision officer, instead of reporting monthly, which is customary in the supervision of a sex offender, Love said. Seager must attend and complete a sex offender counseling program and cannot view any pornography. He is not allowed to go within 1,000 feet of where children gather, such as schools, pools or video arcades. He is prohibited from contacting any person under the age of 17 and cannot use the internet to access obscene material or commercial networking sites.

And, of course, he will obey all those rules because he has to call his probation officer once a week!

Seager was not listed on the sex offender registry as of Apr. 25, By the terms of his probation he must register as a sex offender within seven days of being found guilty.
