Judge Marc Whiten was fuming when he was forced to toss all sex abuse charges against a man because the mothers of the victims refused to allow their daughters to speak to authorities.

A fed-up Bronx judge was forced to toss all charges Thursday against a man accused of sexually abusing his step-daughters after the victims’ relatives refused to let them cooperate with authorities.
“While it would appear that those children would have been better raised by cats or dogs or crawled on their own in a forest, the fact is, without cooperation, the people are left with no other option and this court with no other option either,” fumed Judge Marc Whiten in Bronx Supreme Court, before dismissing the case.
“It is unfortunate that such a circumstance can exist, if there is any possibility that these charges are true," Whiten went on. “But other than this circumstance, this matter is dismissed. Goodbye.”

Ivory Anderson, 31, was arrested in July 2015 after one of the girls told police that he repeatedly raped her in an apartment on Webster Ave. in Claremont from May 2006 to Sept. 2008, according to court records.
She had been between 9 and 12 years old at the time of the alleged abuse.
Another girl had told cops that Anderson groped her in the same apartment several times from Sept. 2008 to June 2010, when she was between 9 and 11 years old.
The News is withholding the names of both girls.
Whiten slammed the victims’ families for not working with authorities to take the case to trial.
“Apparently, the mother or mothers who allegedly had them and brought them onto this earth felt there was no need to cooperate with such a tragedy happening in their child’s lives,” said Whiten as he granted the district attorney's office’s begrudging request to throw out charges against Anderson.
Prosecutors said that they had pleaded with the mothers to bring the victims forward — but could not convince them to cooperate before the six-month deadline expired for securing an indictment from a grand jury.
Subpoenas sent to the homes of the victims went unanswered, prosecutors said.
“The complaining witnesses have proved themselves to be uncooperative despite various attempts from our office to reach out to them and bring them in,” said prosecutor Christina Arno.
Anderson had pleaded not guilty to all of the charges.
He covered his face Thursday as he left the courthouse.

A perverted Indiana dad will not spend a second in jail, even after admitting to molesting his 6-year-old daughter with cancer.
Jeremy Schwer, 41, pleaded guilty Tuesday to felony child molesting after he sexually abused his young daughter while she was recovering from a brain tumor in 2013.
While the deputy prosecutor Courtney Curtis wanted Schwer locked up for at least nine years in prison, the Marion County Superior Court judge sentenced the pedophile to only 12 years of probation.
The light sentencing comes after Schwer’s estranged wife, who filed for divorce, asked the court not to send the creep to prison because she needed financial support for her children, the Indianapolis Star reported.
Schwer was charged in 2015 after his wife called the Indiana Department of Child Services and reported her husband’s despicable acts against his daughter.
After the then-5-year-old was diagnosed with a brain tumor in 2013, the monster dad made her touch his “peepeeluca” — the family’s word for genitals, and also touched hers, court records revealed.
The girl had been losing her memory and ability to speak when she was first diagnosed in August 2013, according to her YouCaring page.
At one point during her cancer treatment, Schwer told his daughter to sit on his “cat tail.”
This went on every night he slept in her bed for about two years until the girl told her mother. Schwer’s affidavit showed he told his daughter not to tell anyone or else he would go to jail — a punishment he avoided on Tuesday.
Along with his probation, Schwer will also have to register as a sex offender and move out of his family’s home.
Curtis said she “completely” disagrees with Schwer’s light sentencing, as the perv father has already been out of jail for the past year and has not helped financially support his estranged family.
“This is the most horrific circumstance of a child molestation case that I’ve ever seen,” she said.
Schwer’s attorney, John Campbell, said the sex offender father has promised to devote his life to supporting his family, WBIR reported.
After months of treatment, the victim, now 7, no longer has any growth on her tumor and is expected to make a recovery.
This is just wrong! The girl is horribly abused at the worst possible time and she gets not one hint of justice. What a dreadful sentence.
I may have to start an America's Worst Father contest. Shwer certainly qualifies.
