Constitutional court dismisses oral-sex debt case

Spain’s Constitutional Court has dismissed a case brought by a woman who claimed her former brother-in-law forced her to perform oral sex on him two to three times a week as a way of repaying a debt.

Earlier this week, the Tribunal Constitucional said it would not hear a case escalated to the court by a woman from Mallorca. Her case had been heard by a local court in Palma de Mallorca and the regional appeal court of the Balearic Islands, both of which said no crime had been committed. 

When the appellant found herself short of money in 2019, the brother of her former partner had agreed to help, paying €15,000 into her bank account. She told the courts they had agreed that she could pay the money back bit by bit whenever she was able.

However, she alleged that the man, who was 20 years her senior, had forced her to perform fellatio and other sexual services two or three times a week in exchange for him having lent her the funds. The woman admitted visiting her ex-brother-in-law five times before breaking the arrangement. 

After breaking her end of the bargain, she claimed she began receiving threatening messages from him, noting the possibility of “revenge” and of reporting her for non-payment of debt. 

The woman reported the man to the police, but he maintained his innocence, claiming they’d reached “a deal to have sexual relations in return for lending her €15,000 without interest” and that “demanding compliance with a previously accepted deal does not constitute a crime.” 

The local and regional appeal courts agreed with the creditor, ruling that the woman had freely engaged in sexual acts with the 58-year-old, the appeals court judge saying there was no evidence of sexual abuse or coercion.

The ruling has been criticized by feminists, including Spain’s equality minister, Irene Montero. “Only yes means yes. Without consent, it is rape. Consent implies the absence of coercion and threats,” Montero said in a tweet in December 2020.

The Constitutional Court has been accused in numerous local media outlets of endorsing the notion that a debt can be paid off with sexual favors.

Russia is to toughen its child sex laws this month to automatically jail repeat paedophiles for life in harsh polar prisons.

Monsters who sexually abuse children should serve their sentences in hard labour penal colonies in the Arctic, where they could be forced to work in Siberian mines, the country's parliamentary speaker said.

The new legislation is being pushed through after a horrific case this week of a girl, five, who was abducted by a recidivist paedophile and his lover, then raped and stabbed to death.

Veronika Nikolayeva had been playing near her mother's workplace in Kostroma, and a video showed how she was snatched before being abused.

The helpless girl 'struggled and fought back' but passersby did not pay attention to her distress - and the men took her to their hostel.

Her corpse was later found in a duffle bag as the suspects, named Denis Gerasimov, 44, and Vadim Belyakov, 24, planned to dispose of her body.

Both men confessed on video to her murder.

Parliamentary speaker Vyacheslav Volodin, a close ally of Vladimir Putin, said the 'terrible tragedy' of Veronika's abuse and death showed the urgency of toughening laws.

'One of the detained men turned out to be a formerly convicted paedophile,' he said.

'Let's do everything for the law on life sentences for paedophiles to be adopted in January.'

He backed calls for even tougher measures by sending all paedophiles to polar regions to serve their sentence.

'Those convicted for such crimes should serve life sentences in the harshest conditions - in the extreme north (of Russia) or in mines.

'These b******s should undergo the hardest labour, so they remember the crimes they committed every day - and regret them.'

They 'cannot be called human', he said.

Alexander Khinstein, an influential MP in the main pro-Putin United Russia party, said: 'It is necessary to adopt our bill on life punishment for paedophile-rapists as soon as possible.'

All sex attackers released from jail should wear electronic tags, he said.

Maria Lvova-Belova, Putin's commissioner for children's rights, warned that sex attacks on children and adolescents have risen 79 per cent in the past eight years.

In this week's case, Gerasimov had been released from a sex crime conviction in March.

As the girl's body was removed from the suspects' hostel, a mob of locals demanded to be allowed to lynch the suspects.

The suspects are understood to have been in a long term, gay relationship since the younger man was underage.

The men told interrogators that the crime was 'spontaneous', it was reported. The younger one 'suggested that his partner catch the girl and make fun of her'.

When police raided the room shared by the suspects in a hostel, they found the girl's body hidden in a duffle bag, say law enforcement sources. The girl had been raped before she was killed.

Local news said that as soon as the information was made public, a mob formed. 

'Immediately after the information about the detention of (the suspects) appeared, local residents gathered by the hostel, where the child's body was found,' reported 112 news outlet. 'They demanded the (suspected) murderers should be handed over and wanted to lynch them.'

A social media post said: 'This case shows again that the surveillance system for paedophiles does not work and gives them the opportunity to commit crimes again.'

A paedophile once caught with more than 450,000 vile images of children has again faced a court for having indecent pictures.

, aged 39, had so many photos and videos back in 2014 the police could not classify them all, a court heard.

He was again caught accessing 118 images on his devices 18 months ago - including images of children being abused.

Wilby avoided prison seven years ago and walked out of Plymouth Crown Court with another suspended jail term.

Judge William Mousley said: "The pain and distress caused to these children is discernible within these images."

And, yet, you let him walk. 450,000 images means that child sex abuse images were his life. He had no time for anything else. Yet, you thought he was a good candidate for rehab. How absurdly stupid!

He added that the defendant was a realistic prospect of rehabilitation and had himself sought therapy soon after his arrest.

Right! Right after talking to his lawyer, I expect.

The judge said: "You have taken steps yourself to address your behaviour and so with some some hesitation the sentence of imprisonment which I must impose is one that will be suspended."

Judge Mousley handed Wilby an 18-month prison sentence suspended for two years with sex offender treatment and probation supervision.

He was fined £6,000 and the devices used to access the images have been confiscated.

Wilby, of Townshend Avenue, Keyham, pleaded guilty to three counts of possession of indecent images of children in each category of seriousness on June 8, 2020.

Jason Beal, for the Crown Prosecution Service, said police had linked vile images to his IP address and searched his home.

He added that officers found 118 files, mostly videos, in a cloud storage system. The barrister said Wilby provided his password to police.

UK Justice Secretary and Deputy Prime Minister Dominic Raab has vowed to put the “fear of God” into domestic abusers by addressing loopholes in the current legislation that allow “too many” offenders to avoid punishment.

Writing in The Telegraph, Raab committed to extending the time limit for victims of domestic violence to report crimes from six months to two years. He argued that the existing strictures had allowed “too many cases” to evade the courts simply because a victim was too afraid to come forward quickly, leaving them “timed out.”

The extension of the timeframe for prosecution is part of a package of measures being introduced by the deputy PM to combat violence against women and leave the “door to justice open to thousands” of people who’ve been domestically abused in the UK.

For many, the fear of being out alone after dark, or that they may be beaten in their own home, is a grim everyday reality. We must turn that situation around.

Figures cited by Raab show that the number of victims unable to prosecute an alleged offender because they ran out of time rose from 1,451 in 2016-17 to 3,763 in 2020-21. 

The more time a couple spends together, the greater the test of their relationship. Some people are not ready for a real relationship, one that costs each partner in many ways. Men, who cannot deal with their feelings often resort to violence.

The changes he plans to institute are aimed at restoring confidence in the judicial system among women and to “instil the fear of God into the mind of anyone” who might consider abusing them, he said. They were made in response to a damning quasi-government report into the effectiveness of police engagement with women and girls, published last March, that spoke of an “epidemic” of gender-based violence.

He is, of course, talking about the fear of the government, not the fear of God. The fear of God would work much better, but there is little appetite for God these days.

Under the new legislation, the non-consensual taking of photographs or videos of breastfeeding mothers will now be a crime punishable by up to two years in prison. The move comes after Labour MP Stella Creasy raised concerns about having been photographed breastfeeding her baby on public transport.

Only a pervert would take photos of a mom breastfeeding her baby. MP Creasy seems to want to be able to breastfeed her baby in full view of perverts, as long as they don't take pictures. A simple baby's blanket would afford privacy and avoid the temptation.

Responding to the government’s announcement, Nicole Jacobs, the domestic abuse commissioner for England and Wales, praised the rule changes as an effective way to “remove another barrier to bringing perpetrators to justice.”

The legislation will come into effect through amendments to the Police, Crime, Sentencing and Courts Bill, which is currently making its way through Parliament.

Suspended Sentence for Priest's Sex Abuse of 12 y/o Boy 50 Years Ago

Convicted: An elderly Newcastle Anglican diocese priest has been convicted of child sex offences in the 1960s.

A NEWCASTLE Anglican priest was given a three month suspended jail sentence after pleading guilty to indecently assaulting a 12-year-old boy in 1967.

Reverend Bruce Shaw, 72, was working at a spiritual retreat at Stroud in 2016 when he was charged with the offence which occurred when he was sole teacher and principal at a Victorian primary school.

Wangaratta Magistrates Court was told Shaw was 23 when he invited two young family friends to his rural property for the weekend, and insisted the 12-year-old sleep in his bed.

Six years later Shaw completed his training and became an ordained priest.

He was given permission to officiate in Newcastle Anglican diocese on June 13, 2013.

In a message to clergy this week Newcastle Bishop Peter Stuart said Shaw’s permission to officiate was suspended when the diocese learnt of the charge against Shaw, and his permission had been revoked.

“The diocesan professional standards committee will give further consideration to this conviction in due course,” Bishop Stuart said.

Wangaratta magistrate Ian Watkins said the victim reported the crime to police in October, 2015. Mr Watkins said the report was prompted by publicity around the Royal Commission into Institutional Responses to Child Sexual Abuse.

The delay in reporting of nearly five decades was “not all that unique for offending of this nature”, Mr Watkins said.

The court heard Shaw was “probably grappling with his own sexuality” when the incident occurred.

'Grappling' is a great description. A would-be priest ought to be 'grappling' with God over such things rather than 'grappling' 12 year old boys. When he realized that he was a paedophile, did he apologize to the boy? To God? Apparently, he felt it qualified him for ministry.

In the 1990s the victim wrote to Shaw who admitted the act and sought forgiveness.

Mr Watkins said he had no doubt the victim would have had lasting memories of what occurred and it was a matter of extreme concern that the victim was only 12 years old, but Shaw admitting responsibility after the victim wrote to him would have helped.

“The interaction you had with him in the 1990s where you admitted responsibility and sought forgiveness would have gone some way to healing the pain,” he said.

Shaw’s sentencing came after counsel assisting the Royal Commission into Institutional Responses to Child Sexual Abuse recommended adverse findings against former Newcastle Anglican bishops, senior clergy and senior lay people after a public hearing in Newcastle in August about the diocese’s response to child sexual abuse allegations over decades.

In a statement after the recommended findings were released Bishop Stuart said final submissions to the royal commission “continue to recount the horrendous experience of children of the diocese and their families”.

“The submissions also point to a failure by the diocese to appropriately respond when people came forward to seek assistance,” Bishop Stuart said.

Recent Newcastle diocese Synod meetings had shown “very clear support to face the past and shape a healthy future”, he said.

“The people of the diocese have spoken with a strong voice that our church must respond well to survivors of abuse and must be a safe place for children.”

Ex-Marist Brother Predator gets Suspended Sentence for Child Sex Abuse

A former Marist College Canberra teacher and convicted child molester who sexually abused two boys at the school in the 1980s has avoided more time behind bars.

The Marist Brothers of the Schools, commonly known as simply the Marist Brothers, is an international community of Catholic Religious Institute of Brothers.

Gregory Joseph Sutton, 65, pleaded guilty to two charges of indecent assault and was handed a suspended jail sentence of two years and two months in the ACT (Australian Capital Territory) Supreme Court on Tuesday morning.

Justice John Burns said Sutton's offences involved "a gross breach of trust".

"The actions had a long-term effect on his victims and also on their families."

The court heard Sutton had already spent more than a decade in a NSW prison for 67 sex offences committed against children.

Prosecutors said those offences included 23 involving sexual intercourse, 46 indecent assaults, seven acts of indecency and one gross act of indecency.

Sutton had been arrested and extradited from the United States in 1995 to face the charges. At that time, he admitted abuse against numerous victims, including boys in the ACT.

But he did not face justice for the two Canberra offences until the territory in 2013 removed a limitation which required some child victims to report crimes within 12 months of their occurrence.

Sutton was one of four men police charged with fresh offences in 2016 as part of an investigation into historical child sexual abuse in territory schools.

Some of the assaults were alleged to have been committed against a male student in Sutton's classroom in 1980. 

A police statement of facts, tendered in court at Sutton's committal in August, said the teacher had model trains set up in his office, which attracted students. 

On one occasion, Sutton allegedly placed a chair in front of his classroom door before he approached the boy and touched his genitals.  

Sutton then said: "You'd better not tell anyone what happened ... This is our secret."

He touched the boy inappropriately on two more occasions in the classroom in the days that followed. The third time the boy allegedly said to him: "No, this is – it's just not right," before pulling away and telling Sutton, "No". 

A child has to explain right from wrong to a Marist Brother. What does that tell you?

Justice Burns said in his remarks he was satisfied Sutton had come to understand what had motivated his offending and said it was unlikely he would reoffend in a similar manner.

The judge noted Sutton had served an "onerous" prison term that had largely been spent "in strict isolation".

He also took into account the significant delay in the offences coming to court, though noted that was not the fault of the prosecution or victims. 

He took it into account in terms of the defendant, but not in terms of the victims. Sutton could have confessed to these crimes in 1995 when he admitted the others, but he chose not to, now the judge has rewarded him for that decision. 

"I have no doubt the victim would have pleaded guilty to these offences in 1995, had that been possible at the time."

But why was it not possible? Because of the statute of limitations? He still could have confessed and given the victims some small sense of closure even if he couldn't be sentenced for it.

But he said no sentence other than a term of imprisonment would be appropriate.

And then he put him on probation! Is that imprisonment in the judges books? Not mine!

Sutton will serve a good behaviour order for more than two years.

Past abuse by Sutton and John William Chute at schools associated with the Catholic Marist Brothers organisation, including Marist College Canberra, was closely examined during the ACT hearings of the child sex abuse royal commission.

The royal commission found the organisation moved Sutton and Chute to different schools when it received complaints they were inappropriately touching children.

The commission found Marist Brothers' actions enabled Sutton and Chute to continue to access children throughout the 1980s and early 1990s.

So, were the Bishops, etc., who moved these perverts around enabling them to source new meat ever charged with complicity? Most of them are probably dead now, but will face, or have faced, a higher court.

No-one at The Irish News has taken credit for this article which is unfortunate, because I have no-one in particular to criticize for this poorly written piece. To begin with the article was titled 'Former Doctor..." when, in fact, he is still a doctor, just suspended from practicing. There's another more serious problem which you will find below.

AN ANAESTHETIST has avoided going to jail after his nine-month sentence for making indecent images of children was suspended.

The judge said Piotr Dziurdzik (47) did not require an immediate custodial sentence because he was "not dangerous".

The former doctor with the Causeway Hospital in Coleraine, Co Derry, was found with nearly 3,000 images of child sex abuse.

On Wednesday Judge Sandra Crawford said she did not believe the offending required an "immediate custodial sentence" and told Dziurdzik: "This finely balanced decision is based on your genuine remorse and the significant steps that have been taken to address your offending."

Dziurdzik has already been suspended by the General Medical Council and expects to be 'struck off'. He hopes to return to his native Poland but is not expected to resume his career in medicine.

He pleaded guilty to 33 offences including 27 of making indecent photographs of children, committed between 2012 and last year.

Among the indecent images were more than 200 in the most serious categories.

Here is the other problem; he was, apparently, sentenced for making child pornography. Yet, the judge gave him a suspended sentence and believed that he is no threat to children. Making child pornography requires the committing of child sex abuse unless it is done on Photoshop or some similar application. 

More than 200 images were in the most serious categories, which, again, one would think would require some very serious child sex abuse. Yet, he was never charged with child sex abuse, from what I can determine! Why? The writer of the sorry article, which, I'm sure now did not originate with The Irish Times, needs to explain that, but he doesn't even ask why. He doesn't ask if Dziurdzik actually assaulted or caused to be assaulted any children in the 'making of child porn'. He doesn't ask who the children are. He doesn't speak up for the children! Hardly anybody does!

More spiritual than psychological?

In addition to his concurrent sentences of nine months on each count, suspended for two years, Dziurdzik was also made subject of a ten-year sexual offences prevention order.

Prosecutor Michael Chambers had told the court that when confronted by police Dziurdzik readily admitted: "Yes, true", and said: "It happened on occasion I was watching adult sites, there was links to sites we're talking about. It's not my area of interest."

Mr Chambers said when later interviewed by police Dziurdzik described his offending as "a paradox...
 knowing something is forbidden" and likened it to "Adam and Eve... the forbidden apple".

This is exactly what I have been preaching for at least a year now, that pedophilia is more about the destruction of innocence or the violation of the sacred, than about sex. It may be more spiritual than psychological.

The vast majority of the images were of girls, although some showed small boys. The age range of the children was substantially between eight and 12, although some were as young as five or six.

Dziurdzik, who claimed he was often drunk when viewing images, was also said to be "shocked by the age range" of the children being abused and "taken aback" by the number of images he had amassed.

Francis Rafferty, defending, said Dziurdzik's behaviour was both "disgraceful and appalling" but not once had he tried to minimise his role.

The court was told that he had expressed "huge regret" that the girls in the images had to suffer for his offending to take place.

Given all of that, he added, it would be "rare for the courts to witness a more precipitous fall from grace".

It was also clear from reports, said the lawyer, that at no time had Dziurdzik "come across as 'Poor me, look at what I've lost'."

Since he was arrested Dziurdzik had lost his home and had moved into rented accommodation where he had come under threat from paramilitaries, the court was told.

He had been living with his partner and her stepdaughter who was taken into foster care. They have since gone back to Poland where his partner is "considering their future".

"He does not feel sorry for himself or make no attempt to minimise his behaviour, the gravity of the offences, and the requirement of others to suffer so this offending can take place," the lawyer said.

Mr Rafferty also said that for the past year the anaesthetist has been seeking professional help from specialists in the field of sexual offending.

UK Pedophile Snagged with 137k Obscene Photos of Children Spared Jail to have his own Kid

A pedophile who was caught red-handed with around 137,000 pictures and 4,336 videos of children has been spared prison time for the most surprising and controversial of reasons – because he wants to become a father.

Richard Arrowsmith from Church Gresley, Derbyshire, was arrested in February after police received a tip-off that an IP address linked to the 41-year-old’s Sky account had been used to download illegal photos and videos of children.

Authorities seized Arrowsmith’s computer, external hard drive, laptop, mobile phone, and USB sticks in April.

Police found 400 videos in Category A, the most extreme category. In total, 1,692 movies and photos were found ranging from Category A to C. An additional 4,336 videos and 137,000 pictures remain uncategorized.

Arrowsmith pleaded guilty to possessing the indecent images and videos when he appeared at Derby Crown Court, stating that he had viewed and downloaded the media for “four or so years.” However, he stressed that he had never distributed or made any images or videos, the Derby Telegraph reported.

Although the 41-year-old faced up to five years in prison for his crimes, Recorder Martin Butterworth let him off with a 10-month sentence, suspended for two years, after hearing about his desire to start a family – an odd request to grant the defendant, considering he is now banned from working with children and must register on the sex offenders’ list.

“I am taking into consideration your previous good character, you have a wife who supports you, a steady employment and your hopes to start a family in the near future,” Butterworth told the defendant in court, despite admitting that Arrowsmith’s crimes were “not victimless” and “encourage serious abuse of sometimes very young children.”

Butterworth also took note of the defendant’s otherwise clean record, stressing that he had no previous convictions and that he pleaded guilty “at the earliest opportunity.”

Arrowsmith was ordered to pay just £250 (US$311) and carry out 160 hours of unpaid work. He was also given a curfew that restricts him from leaving his house between 7 pm and 5 am.

Good grief! What is with the paltry fine and the nighttime curfew? Why was he not ordered to attend counseling sessions. There is no mechanism set in place for Arrowsmith to overcome his perversion, bu the judge thinks it's a good idea for him to start a family. I think the judge needs some counseling.

Dark Justice - ‘Pedophile Hunters’ Film Moment They Capture would-be Child Abuser

A vigilante group of ‘pedophile hunters’ in England have filmed the moment they ensnared a would-be child abuser attempting to meet up with a fictitious 13-year-old girl he had been grooming online.

Simon Bagley, 42, was given a 12-month suspended jail sentence by Newcastle Crown Court and placed on the sex offenders’ register for five years.

Members of child safety group Dark Justice posed as Charlotte, 13, and struck up an online relationship with Bagley on social networking site hi5.

A series of text messages were then exchanged in which Bagley asked the girl, “Would you like me to be your first boyfriend?” and “Would you like [me] to take your virginity?"

When asked by those posing as Charlotte if he would be happy to be her boyfriend despite her being “only 13,” Bagley replied: “If it would be fine with you.”

He arranged to meet with her at Times Square in Newcastle and was confronted by members of the group as he dismounted his bicycle. Bagley was then quoted some of the lines he used to groom the girl in his text messages and shown screenshots of what he had sent.

Two men from Dark Justice appear to be present at the confrontation, with Bagley apparently dazed and dumbfounded in front of the camera.

One of them asks: “You’ve come to meet a 13-year-old girl for sex?" The culprit, however, can manage only the confused response of, “Why would I come on my bike?”

Two police officers then arrive on the scene and listen as members of Dark Justice repeat excerpts from his text conversations with Charlotte. Bagley, whose own lawyer labelled him “pathetic and vulnerable,” later claimed he had set up the meeting to warn the girl about the danger of online predators.


Judge Paul Sloan QC said in his sentencing of Bagley: “You wanted pictures of her in her school uniform. You went to meet the girl at Times Square and were shocked when you were confronted by members of Dark Justice.”

“You then told police that you were only there to teach Charlotte about dangers, something I simply don’t accept,” the judge told the court. "If this was more than an attempt then you would be given an immediate custodial sentence.”

Qatar Convicts Dutch Woman Who Says She was Raped

Doha: A Doha court on Monday convicted a Dutch woman of adultery and handed her a one-year suspended sentence after she reported being raped while on holiday in Qatar.

The 22-year-old woman, known only as Laura and who was not in court, was also fined 3,000 Qatari riyals and will be deported once she pays the fine, court officials said.

She had denied the charge against her.

The male defendant, said by a court official to be Syrian and named Omar Abdullah Al Hassan, was sentenced to 100 lashes for the illicit sex and 40 lashes for consuming alcohol.

Hassan, who was also not in court, will undergo a medical examination to see if he is fit enough to withstand the punishment.

He will not serve any time in jail but will also be deported once he has been punished.

The Dutch ambassador to Qatar, Yvette Burghgraef-van Eechoud, who was present in a packed courtroom, told reporters the embassy would help Laura leave Qatar.

“We will do everything to get her out of the country as soon as possible to where she wants to go,” said Eechoud. The envoy added that she expected Laura to leave Qatar within the next few days.

The ambassador added that she had spoken to Laura Sunday and said that “under the circumstances she was doing fine”.

Back in the Netherlands, Laura’s mother said she had not yet spoken to her daughter but was “so happy” at the news of her release.

“I do not know yet when she gets home, but this is not most important,” she told the Dutch television NOS website. “The most important is that she gets home … I am so happy,” she said.

Bert Koenders, the Dutch foreign minister tweeted that he was “relieved” that Laura could soon go home.

Laura was arrested on March 14 and has since been held in custody. Her lawyer previously said the incident happened after she had visited a Doha hotel.

“She went dancing but when she returned to the table after the first sip of her drink, she realised that she had been drugged,” Brian Lokollo has said.

“She really didn’t feel very well,” he added.

The woman remembers nothing more until the following morning when she woke up in a totally unfamiliar apartment “and realised to her great horror, that she had been raped”, he said.

The defendant had insisted that their night together had been consensual and that the woman had even asked for money.

Adultery, or illicit sex, is treated as a serious crime in Qatar.

But the case provoked an international outcry with many appalled by the treatment of an alleged rape victim and an online campaign using the #freelaura hashtag to try and draw attention to the Dutch woman’s imprisonment.

I think it might have worked, too. This is as good an outcome as is possible under Sharia. And for the man to be convicted without witnesses, well that was unexpected.

Qatar is a big tourist destination and jail time would have damaged that business. Also, it could be that Qatar is actually moving into the 2nd millennia.

A 'high powered' New Malden IT consultant who watched a Filipino child sex show and downloaded photos of girls as young as eight being raped has avoided jail.

Priyangshu Kakati, 38, paid to watch webcam sex shows involving a girl called Lolita and downloaded 72 indecent images of children in 2012.

He was caught when officers from the child exploitation unit, investigating the abuse of underage girls in the Philippines, traced his computer IP address.

They arrested Kakati in 2014 and confiscated two laptops where the images were discovered.

Defence barrister Michael Reilly argued that Kakati was in a 'completely different place' emotionally when he downloaded the photos after the breakup of a long term relationship.

He said: "He was coming out of a relationship that had gone badly wrong. He developed a habit of going on chat rooms.

"It was a sex show that involved someone called Lolita. He paid for that sex show and accepts he did that willingly.

"But, by giving them his credit card details, they sent him things as a mechanism to get him to part with further money."

Mr Reilly added that since his arrest Kakati's family had arranged him a marriage and he was working as a 'high powered IT consultant' who 'takes home £4,000 a month'.

Mr Reilly also said if Kakat were to go to prison the IT team he manages in Finland would be at risk of losing their jobs.

During sentencing Judge Jones said he would not take into account Kakati's team of workers and asked why he had not deleted the indecent images when he received them?

Judge Jones also referred to a police report that stated Kakati 'minimised his behaviour'.

But he also said Kakati should receive full credit for pleading guilty in April this year to the five counts of making indecent images of children.

He said: "The images were downloaded some while ago and more recent images were not found on your computer.

You're in work and I'm told there would be repercussions on others [were you to go to prison]. I have put that out of my mind when sentencing you."

Kakati, of Windrush, New Malden received an eight months prison sentence suspended for 18 months.

He was ordered to pay £1,200 in court costs and a £100 victim surcharge.

He will also be on the sex offenders register for 10 years.

Strangely enough I am not outraged by this decision. Perhaps because I just read a dreadful report on the state of British prisons. It appears Kakati has already turned his life around, there being 2 years before his arrest where he did not download or view child pornography. So, because he seems to be of little danger to children, I wish him the best. However, I am concerned that being depressed is being used as justification for paying to watch a little girl being raped.

Judge Marc Whiten was fuming when he was forced to toss all sex abuse charges against a man because the mothers of the victims refused to allow their daughters to speak to authorities.

A fed-up Bronx judge was forced to toss all charges Thursday against a man accused of sexually abusing his step-daughters after the victims’ relatives refused to let them cooperate with authorities.

“While it would appear that those children would have been better raised by cats or dogs or crawled on their own in a forest, the fact is, without cooperation, the people are left with no other option and this court with no other option either,” fumed Judge Marc Whiten in Bronx Supreme Court, before dismissing the case.

“It is unfortunate that such a circumstance can exist, if there is any possibility that these charges are true," Whiten went on. “But other than this circumstance, this matter is dismissed. Goodbye.”

Authorities couldn't indict Ivory Anderson on charges of sexually abusing his step-daughters because the victims' kin refused to cooperate.

Ivory Anderson, 31, was arrested in July 2015 after one of the girls told police that he repeatedly raped her in an apartment on Webster Ave. in Claremont from May 2006 to Sept. 2008, according to court records.

She had been between 9 and 12 years old at the time of the alleged abuse.

Another girl had told cops that Anderson groped her in the same apartment several times from Sept. 2008 to June 2010, when she was between 9 and 11 years old.

The News is withholding the names of both girls.

Whiten slammed the victims’ families for not working with authorities to take the case to trial.

“Apparently, the mother or mothers who allegedly had them and brought them onto this earth felt there was no need to cooperate with such a tragedy happening in their child’s lives,” said Whiten as he granted the district attorney's office’s begrudging request to throw out charges against Anderson.

Prosecutors said that they had pleaded with the mothers to bring the victims forward — but could not convince them to cooperate before the six-month deadline expired for securing an indictment from a grand jury.

Subpoenas sent to the homes of the victims went unanswered, prosecutors said.

“The complaining witnesses have proved themselves to be uncooperative despite various attempts from our office to reach out to them and bring them in,” said prosecutor Christina Arno.

Anderson had pleaded not guilty to all of the charges.

He covered his face Thursday as he left the courthouse.

Indiana dad who admitted molesting his cancer-stricken 6-year-old daughter avoids jail

A judge gave Jeremy Schwer probation rather than jail time despite the pervert admitting to molesting his 6-year-old daughter, who is recovering from cancer.

A perverted Indiana dad will not spend a second in jail, even after admitting to molesting his 6-year-old daughter with cancer.

Jeremy Schwer, 41, pleaded guilty Tuesday to felony child molesting after he sexually abused his young daughter while she was recovering from a brain tumor in 2013.

While the deputy prosecutor Courtney Curtis wanted Schwer locked up for at least nine years in prison, the Marion County Superior Court judge sentenced the pedophile to only 12 years of probation.

The light sentencing comes after Schwer’s estranged wife, who filed for divorce, asked the court not to send the creep to prison because she needed financial support for her children, the Indianapolis Star reported.

Schwer was charged in 2015 after his wife called the Indiana Department of Child Services and reported her husband’s despicable acts against his daughter.

After the then-5-year-old was diagnosed with a brain tumor in 2013, the monster dad made her touch his “peepeeluca” — the family’s word for genitals, and also touched hers, court records revealed.

The girl had been losing her memory and ability to speak when she was first diagnosed in August 2013, according to her YouCaring page.

At one point during her cancer treatment, Schwer told his daughter to sit on his “cat tail.”

This went on every night he slept in her bed for about two years until the girl told her mother. Schwer’s affidavit showed he told his daughter not to tell anyone or else he would go to jail — a punishment he avoided on Tuesday.

Along with his probation, Schwer will also have to register as a sex offender and move out of his family’s home.

Curtis said she “completely” disagrees with Schwer’s light sentencing, as the perv father has already been out of jail for the past year and has not helped financially support his estranged family.

“This is the most horrific circumstance of a child molestation case that I’ve ever seen,” she said.

Schwer’s attorney, John Campbell, said the sex offender father has promised to devote his life to supporting his family, WBIR reported.


After months of treatment, the victim, now 7, no longer has any growth on her tumor and is expected to make a recovery.

This is just wrong! The girl is horribly abused at the worst possible time and she gets not one hint of justice. What a dreadful sentence.

I may have to start an America's Worst Father contest. Shwer certainly qualifies.

A former Eton College student who made and shared graphic child pornography images has avoided jail time, despite Britain's promise to crack down on pedophiles.

In January and February 2015, then-17-year-old Andrew Picard sent a message to an undercover officer via Skype which read: “Do you want to see pics of boys and girls your age nude?” The Daily Mail reports.

Police traced Picard’s IP address to his computer at the prestigious boarding school which contained more than 2,000 pornographic images and videos of children, some involving rape and beastality.

Particularly disturbing images featured children as young as two 
being raped and forced to have sex with dogs.

On Thursday, the now-18 year old was sentenced to 10 months in prison, with 18 months suspended, and ordered to seek mental health treatment, the Telegraph reports. Judge Peter Ross said prison would “undo” the extensive counseling Picard has undergone since his arrest.

Some have questioned whether Piccard, the son of a lawyer, would have received such a light sentence if he had not come from a privileged background.


Pedophile crackdown - 'not realistic'?

The conviction of entertainer Rolf Harris, the report into former presenter Jimmy Savile, claims of a Westminster child abuse cover up in Margaret Thatcher’s cabinet, and an investigation into 1980s pedophile rings have led to British authorities promising to introduce harsher crackdowns on sexual abusers.

Speaking in March 2015 about the pedophile ring inquiry, Home Secretary Theresa May warned that people did not fully appreciate “the scale of that abuse” and suggested the problem of pedophilia is “woven, covertly, into the fabric of our society”.

NCA deputy director Phil Gormly signalled that pedophilia needs to be targeted by both police and legislators.

“This is a challenge for law enforcement and a challenge for policy makers,” Gormly was quoted by the Express in July 2014. “We are not going to be able to arrest our way out of this problem.

According to a police estimate released in October 2014, 50,000 men view and share images of child sex abuse in Britain.

National Crime Agency (NCA) general director Keith Bristow said it’s “not realistic” to expect that everyone who accesses a child porn image will be brought through the justice system.

“I don’t think I can be more candid than say, if there are 50,000 people involved in this particularly horrible type of criminality, I don’t believe that all 50,000 will end up in the criminal justice system being brought to justice,” Bristow said. “Our responsibility is to focus on the greatest risk and tackle those people.”

20 Year Old Has Sex With 11 Year Old - No Jail Time

A female babysitter who romped with a 'sex-mad' boy aged just 11 was spared jail after the child's father said his son saw it as a "notch on his belt".

Jade Hatt, 21, was looking after the youngster as he had a day off school when she stripped off, removed his clothes, then straddled him and had sexual intercourse.

But the boy's father, who had a previous sexual relationship with the woman, stood up in court to defend Hatt, and described her as immature. 

He said his son is "sex mad" and was "fully up for the experience", seeing it as a "notch on his belt". 

The court heard the incident in November lasted around 45 seconds, following which the boy admitted he had not enjoyed it as he knew it was wrong. 

Hannah Squire, prosecuting, told Swindon Crown Court: "The defendant was friends with the boy's father, with whom she had had a brief sexual relationship. 

"He would ask her to babysit; she had babysat his 11-year-old son on six or seven occasions. On one of those occasions this offence took place.

"It was during the day and the boy was off school. The defendant arrived at about 11.30am.

"The boy was laying down, Jade Hatt sat on top of him, sat astride him, took off her clothes and removed his.

"In his words she started bouncing on his private parts. Sexual intercourse took place.

"According to him it was fairly brief: about 45 seconds. She told him she enjoyed it, he said he had not as it was wrong." 

She said the boy's dad noticed he had a love bite on his neck and texts from Hatt were diverted to his phone, revealing what had taken place.

Police were called and when arrested, she told officers the boy had told her he was 15, even though she knew his age as his father had told her. 

Hatt, from Swindon, Wiltshire, pleaded guilty to sexual activity with a child.

Rob Ross, defending, said his client was a small, immature, woman and the victim was very advanced for his years. 

Reading from a statement from the dad he told the court: "He said 'I know he told her he was 15. He looks older than his years. 

"He is sex mad. He would have been fully up for this experience and in many ways sees it as a notch on his belt and is totally unaffected by it." 

Mr Ross said petite Hatt 'clearly doesn't operate at the level of a 20-year-old' and was honest with the police about what had taken place. 

He said she was vulnerable and had a hard upbringing, spending two years in hospital with leukaemia between the ages of five and seven.

Passing sentence Judge Tim Mousley QC said it was an exceptional case allowing him to step outside the rigours of the sentencing guidelines. 

He said: "Having read everything before me, it was quite clear he was a mature 11-year-old and you were an immature 20-year-old so that narrows the arithmetic age gap between you.

"I have read the comments of the boy's father to the police where he doesn't consider you a typical 20-year-old.

"I have also read what he has said about the effect on the victim."

Just how credible is the boy's father? Having had a sexual relationship with the girl, knowing what she was like, he still put her in charge of his "sex-mad" son. One has to question who really is sex-mad here; it could well be everyone except the boy who clearly felt guilt at the act - that does not match my definition of sex-mad.

I am not without sympathy for this girl, but the dynamics of this case stink. I think Hatt probably needs some help and could suffer horrendously in prison. I would also like to see the boy get psychologically evaluated to see if, in fact, he is really unaffected by it. I would also like to see the father assessed as to his fitness to be a father.


He imposed a six month jail term suspended for two years with supervision and said she must register as a sex offender for seven years. 

Judge Mousley also imposed a sexual harm prevention order banning her from having unsupervised contact with young boys for two years.

The judge has been heavily criticised after he refused to send the paedophile.

The NSPCC slammed Judge Tim Mousley QC for sending a 'deeply worrying signal' to the general public about child sex abuse.

But Rob Ross, Counsel for Hatt, said the judge was absolutely right to do so because it was 'an exceptional case'.

Ross said Judge Tim Mousley would not have been swayed by the fact the offender was a woman babysitting a boy.

Isn't that the whole point?

Rob Ross criticised the NSPCC for a 'knee-jerk' reaction to the case.
