Child sex abuse suspect found incompetent to stand trial
Bree Burkitt
An Enoch man accused of sexually abusing a child has been deemed incompetent to stand trial Tuesday and will be treated at the Utah State Hospital in an attempt to restore him to competency.
Defense attorney Troy Sundquist requested the evaluation after a representative of the Southwest Behavioral Health Center reported that Theodore Calvin Wolf Fletcher had been diagnosed with multiple mental health disorders and was receiving mental health services from the facility since 2012.
Fletcher, who will turn 21 later this month, is charged with one count each of rape of a child and aggravated sexual abuse of a minor – both first-degree felonies. He’s also facing a third-degree felony count of dealing harmful material to a minor in addition to one count of sexual exploitation of a minor, a second-degree felony.
In a motion filed with the court, Sundquist detailed that Fletcher has previously been diagnosed with Tourette’s disorder, autism and anxiety.
“Defendant does not like to face reality and lives in a fairy tale world when it comes to reality,”
(sounds like a candidate for Congress) Sundquist detailed in the petition. “Defendant thinks he is unstoppable and can do anything . . . (he) struggles with his emotions and when approached to talk about them will shut down and run from feelings.”
Fletcher was evaluated by two forensic professionals last month who both determined that he was not competent to face trial at this time. An additional evaluation conducted by Fletcher’s own counselor with Utah Behavioral Health Services made a similar recommendation. The three evaluations are currently under court seal and unavailable to the public
Fifth District Court Judge Keith Barnes ultimately sided with the recommendations, ruling that Fletcher was incompetent to stand trial for the time being, but that he could become competent in the foreseeable future with the proper treatment. Fletcher will be transported to the Utah State Hospital in an attempt to restore competency.
A review hearing will be held on June 13. Hospital staff will provide a report to assist the court in determining whether competency has been restored or if further treatment is necessary.
“At that time I think we will have a more detailed report on his condition from the state hospital,” Little said.
Fletcher has been held in the Iron County Jail on $50,000 cash-only bail since his December arrest.
Authorities first learned of the alleged assault after an underage female victim reported during an interview at the Iron County Children’s Justice Center that Fletcher had initiated “sexual contact” with her at his home during the summer of 2016, according the probable cause statement.
The Enoch resident also allegedly took nude photos of the minor and showed her pornography, the report details.
More than 50 pornographic images depicting minors were allegedly found on printed out sheets of paper and on an iPod during a search of Fletcher’s residence.
Court documents indicate he allegedly admitted to the charges during an interview conducted by the Enoch City Police Department.

Former scout leader loses parole bid on child sexual abuse convictions
By Rick Journey, Reporter
BIRMINGHAM, AL (WBRC) -
A two-member panel of the Alabama Board of Pardons and Paroles took only seconds before announcing parole denied for 66-year-old Don Corley, a former Boy Scout and church leader in Homewood who pleaded guilty to child sexual abuse charges in 1995.
“We’re relieved. We don’t have to come here and do this anymore,” Brandon Baginski said following an emotional parole hearing.
Baginski, Jason Lee and a man who identified himself as “Victim 2” from the court case were the three youths who came forward with charge that Corley had sexually abused them.
Together with other men who said they were child victims, the three formed 30 Is 30, an organization designed to insure Corley would serve his full 30 year prison sentence without parole.
“I was victim of Don Corley from 1986 to 1992,” Lee told the board. “The system failed us for decades while Corley found more victims to prey on.”
"Victim 2" called him “a narcissistic predator, a habitual sexual predator” during his testimony.
Three people, including a lawyer from the Equal Justice Initiative, sat on the side of the hearing room designated for Corley.
“I beg you to consider positively his chance for parole,” a man who identified himself as a friend of Corley said to the board.
The other side of the hearing was full. It included victims known publicly and those who choose to remain private, family members, friends, victims’ rights advocates, prosecutors and police officers. Most wore buttons with the logo, “30IS30.” Lee said the group’s work has revealed as many as 40 people who may have been victims of Corley. At least one man present at the hearing had initially tried to file charges, but was unsuccessful due to statute of limitations in the 1990s.
“This is a man who does not need to be out in society before the end of his prison sentence,” Attorney General Steve Marshall said. His appearance before the board, his first in his role as Attorney General.
“We need to do everything we can to support the victims,” Marshall said after the hearing.
Though Corley no longer has a chance to be paroled, he will not remain in prison for his full 30 year sentence. He has received credits for good behavior in prison which has set his release date on April 16, 2020, about five and a half years shy of 30 years.
“I hate it, I rage about it,” Lee said, but acknowledged the group achieved its goal of preventing Corley from receiving parole.
Following the board’s decision, Lee, Baginski, “Victim 2” and the man who was unable to file charges huddled together in an embrace.
“This is an intimate brotherhood,” Baginski said. “It was just a hug that ‘we did it.’ We were successful.”

Saratoga County couple sentenced in
child sexual abuse case
BALLSTON SPA - Together in life, together in court, separate in prison.
Michael and Jeanne Mosher, husband and wife, were sentenced Wednesday for sexually abusing five children over a period of seven years. The youngest was less than 10 when the abuse began.
Two of the victims offering powerful impact statements Wednesday.
"How can you consider yourselves even remotely human?" one asked. "For you, hurting us was as easy as breathing."
The girl went on to tell the Moshers that she no longer fears them. "From this point on, you will always be nothing. You won't haunt my dreams. I won't be afraid when I go to bed at night."
As the children spoke, the Moshers rarely looked up. Once, Michael wrinkled his brow, appearing like he couldn't believe what his victim was saying.
"You are a disgusting excuse for a human. I can't believe you would force yourself on someone. Let alone a child," his young victim told him.
When the judge gave the Moshers an opportunity to speak, they declined. Passing on their chance to apologize.
It appeared Jeanne Mosher held a written apology in her hand, but never shared it.
Judge Jim Murphy called them out on that, saying the couple showed no remorse.
As an agreed upon plea, they were both sentenced to 40 years to life in prison for predatory assault of children.
"There's not a more appropriate conviction as these defendants are predators in every sense of the word," said Jennifer Buckley, assistant district attorney.
The judge pointed out that Mrs. Mosher would sometimes give the children over the counter drugs like Benadryl and Nyquil before the attacks.
"If that's not co-conspiratorial, premeditated and evil, I don't know what is," said Murphy.
As the Moshers were led away in handcuffs, they again passed up the chance to say they're sorry.
Jeanne Mosher Jeanne nodded her head when NewsChannel 13 asked her if she had planned to apologize in court.
One of their victims telling the couple before they were sentenced, "You're not sorry you did it, you're sorry you got caught."
Both Moshers will be 78 when they first become eligible for parole.

Junius residents arrested on child sexual abuse charges
By MIKE HIBBARD
JUNIUS — Two town residents have been arrested in an ongoing child sexual abuse investigation by the Seneca County Sheriff’s Office.
James A. Mahaney, 46, of Odell Road, was charged Saturday with three counts of predatory sexual assault against a child, two counts of first-degree criminal sexual act and two counts of first-degree sexual abuse. Mahaney was previously charged Friday with first-degree rape.
All of the charges are felonies. The predatory sexual assault charge, a class A felony, is punishable by up to life in prison.
Sheriff’s office investigators said the charges stem from multiple incidents. Mahaney is accused of engaging in sexual intercourse with two female victims, ages 3 and 6, between January and March of this year.
The rape charge alleges that Mahaney engaged in sexual intercourse with a 3-year-old girl on the evening of March 7.
Jacqueline E. Cady, 32, also of Odell Road, was charged Friday with endangering the welfare of a child, a misdemeanor. She is accused of allowing Mahaney to engage in sexual activity with a child.
Police said Cady was taken into custody Thursday during an investigation of possible child abuse. Mahaney was taken into custody the next day.
Mahaney was arraigned Saturday in Junius Town Court and remanded to the Seneca County Jail without bail. Cady was arraigned in town court Friday and remanded to jail in lieu of $3,000 bail or $6,000 bond.
Sheriff’s office investigators said complete class A “stay-away” court orders of protection were issued to both Mahaney and Cady for the protection of both alleged victims as well as a third child. The sheriff’s office was assisted in the case by Seneca County Child Protective Services and the Child Advocacy Center of the Finger Lakes.
Police said the investigation is continuing.
