Serial pedophile accused of molesting child at
Boys & Girls Club

Tacoma, WA - A man who says he was sexually abused as a child by a serial pedophile at the Boys & Girls Club in Tacoma has sued the nonprofit.

The abuse happened in 1984 when the plaintiff was a 13-year-old member of the club, according to the lawsuit, which identifies the victim by the initials T.W.

Attorneys Lincoln Beauregard and Evan Fuller filed the suit on T.W.’s behalf June 9 in Pierce County Superior Court, seeking unspecified damages.

The Boys & Girls Clubs of South Puget Sound issued a statement regarding the lawsuit on Thursday.

“While we have no records of the accused having any affiliation with any of our sites, these allegations are of deep concern to our organization,” according to the statement. “Since our founding in 1940, Boys & Girls Clubs of South Puget Sound has made the safety and well-being of our members our absolute (number one) priority.”

In his lawsuit, T.W. also alleges that a manager at the nonprofit learned about the abuse and participated instead of stopping it.

It doesn’t name the manager, because T.W. doesn’t remember his name, Beauregard said.

But it does name the serial pedophile: 63-year-old Charles Urlacher.

Urlacher has served unrelated prison time for two child-rape convictions and in 2011 was civilly committed to the Special Commitment Center on McNeil Island — the state’s facility for sexually violent predators.

Urlacher was “directly affiliated” with a Tacoma branch of the Boys & Girls Club and molested T.W. at the club and elsewhere, the suit states.

Beauregard said Urlacher volunteered at the club in some capacity, but he didn’t know at which of the Tacoma branches.

“I think that he worked in the wood shop,” the attorney said.

T.W. argues the nonprofit was negligent in allowing Urlacher to be in a position of trust with children.

“Investigations into Mr. Urlacher’s abuse of young children and teenagers — in addition to Mr. Urlacher’s own testimony — have revealed nearly a dozen unnamed victims that Mr. Urlacher preyed upon and sexually abused over the past several decades,” the lawsuit states. “Records indicate that it is likely there were more victims that were never identified or detected.”

Police records show one of his suspected victims was also a Boys & Girls Club member, like T.W., the suit alleges.

Urlacher told police in 1999 that he had sex with young children when he was a Boy Scout leader, according to court records, though the documents don’t specify where or when that happened.

Boy Scouts of America is not involved in the civil suit, and Beauregard said he doesn’t think Urlacher was ever criminally charged for that behavior.

It’s too late for criminal charges in T.W.’s case, which Beauregard said he doesn’t think was ever reported to police.

As awful as it seems, T.W.s sketchy memory and the lack of documentation will make it difficult for him to win this case. 






Woman, father charged with sexual abuse of child

BRADENTON, FL - A 28-year-old Bradenton woman has been charged with capital sexual battery in a case authorities say involves the woman and her father sexually abusing a child.

According to report from the Manatee County Sheriff's Office, the investigation began with allegations made against Melissa Deloach's father regarding sexual activity with a child, who is listed in a MCSO report as being between 4 to 6 years old.

Soon, information surfaced linking both Deloach and her father to sexual abuse against the child, according to the report.

Deloach also admitted to authorities that the incidents occurred with the child victim "five or six times," according to the report, between April 1, 2014, and Feb. 28 of this year.

Deloach, of 209 60th Avenue Terrace West, is being held without bond at the Manatee County Jail.

Unfortunately, this report doesn't mention charges against Melissa's father, or even his name.






Swansea man found unfit to stand trial for
child sex abuse charges

Bellville, Ill - Charges have been dismissed against a Swansea man who was charged with sex abuse of a child because he was found unfit to stand trial.

Jonathon Yon, 23, was charged in November 2013 with predatory criminal sex assault of a victim under 13 and aggravated criminal sex abuse of a victim under 13. Both charges were dismissed Wednesday, after the time for fitness ran out. This means the court had no choice but to dismiss Yon’s charges, as he wasn’t declared fit to stand trial soon enough.

Yon was originally charged along with his aunt and uncle, Tiffany and Terry Barton. Tiffany Barton, 34, was charged with indecent solicitation of a child. Terry Barton, 39, was charged with six counts of aggravated criminal sexual abuse, two counts of predatory criminal sexual assault of a child, two counts of indecent solicitation of a child, and one count of sexual exploitation of a child. The abuse dates back to at least September 2009, and happened to three female children, all of whom were under 16 at the time.

In March 2014 and June 2015, Yon was declared unfit to stand trial and was referred to the Illinois Department of Mental Health and Developmental Disabilities.

Tiffany Barton was found guilty but mentally ill on a child endangerment charge, and any other charges related to this case were dismissed as a part of a plea deal. She was sentenced to two years probation, which have since been completed.

Terry Barton pleaded guilty to indecent solicitation of a child and two counts of aggravated criminal sexual abuse and was sentenced to five years in prison.

OMG! 13 counts of child sex abuse against 3 perverts on 3 children and one guy gets a 5 year sentence! Period! That is so pathetic!






Orlando man charged with child sex abuse

ORLANDO, Fla. - A family's fight for justice has them frustrated.

An Orlando man charged with capital sexual abuse of his daughter was allowed to bond out of jail with almost no conditions on his release, 9 Investigates learned.

The victim's family doesn't understand why he was allowed to bond out especially since he lives so close to an elementary school.

The suspect was held in the Orange County Jail with no bond for five months, until he hired a private attorney.

The attorney convinced the judge that Ruben Ballester's declining health and ties to the community should be considered for a reasonable bond.

The only conditions of his release require weekly drug tests and court appearances.

Ballester, 78, had never been arrested until last November. 

He is charged with capital sexual battery and lewd and lascivious molestation.

“We want people to know,” said the victim’s mother.

A young girl, now 15 years old, told her parents that Ballester sexually abused her as a child.

Her parents said the memories were triggered recently because of an incident with the victim’s friend.

“Something in that just made her want to come out and say, ‘Dad, this happened to me.’ And immediately I didn't delay at all, called the authorities,” said the victim’s father.

The family now lives in South Florida.

An arrest affidavit details the events the young girl claims happened inside Ballester's East Orange County home, which is in a subdivision that backs up to Lawton Chiles Elementary School.

“So he's exposed to children every day,” said the victim’s father.

His private attorney made a clear case and convinced Judge Marc Lubet to release Ballester from jail on a $50,000 bond.

The motion provides insight about Ballester, who was in the Air Force and served as a U.S. postal worker for nearly 30 years.

His attorney also noted his age, saying he suffers from numerous medical issues.

What troubles the young girl's parents is that there are no conditions on his release outside of weekly drug checks. 

“Considering the two charges against him, it's mind-boggling,” said the victim’s father.

9 Investigates obtained a transcript of a controlled call between Ballester and the victim, in which he blames the victim and said, “What we did, I didn’t ask to do that.”

He referred to the alleged acts as “just experimenting,” and later said he was sorry for what he did.

“I want to see the justice done so she has some type of closure,” said the victim’s mother.

Ballester is scheduled to go to trial next month.

His attorney filed motions to suppress the controlled phone call with the victim, which was set up by law enforcement.





Wurtsboro man gets prison in child porn case

A former Minisink Valley School District bus driver has been sentenced to up to seven years in federal prison for possessing and distributing child pornography, according to federal prosecutors.

Matthew Hamill, 26, of Wurtsboro, pleaded guilty in January to one count of transportation of child pornography before U.S. Magistrate Judge Judith McCarthy in White Plains.

He was arrested in September 2015 and had been out on $100,000 bond.

Hamill traded images and videos of child pornography via email from March 2012 to March 2014, and kept images on his computer through August 2015, according to the U.S. Attorney’s Office for the Southern District of New York.

Prosecutors said an examination of Hamill’s computer found 493 child pornography images, and a search of his email found he sent 94 emails with 135 images and 14 videos.

Hamill, who graduated from Minisink in 2009, completed training to become a bus driver and monitor for the school district in 2013, according to court documents.

He moved to North Carolina after his arrest.

Court documents show that prosecutors agreed to a sentence below the 20-year maximum federal sentence based on mitigating circumstances that included no evidence that he sexually abused children, that he’s a first-time offender and “troubling aspects” of his childhood.

Hamill will also have to pay $15,000 in restitution to victims.

Former Springfield church music director
indicted for child porn

The former music director of a Springfield church has been indicted by a federal grand jury for child porn.

The indictment alleges that Craig A. Wieneke, 31, received and distributed child pornography over the internet between Nov. 10, 2016 and June 13, 2017, according to a press release from the Office of the U.S. Attorney for the Western District of Missouri.

Wieneke was the music director at Springfield's Ridgecrest Baptist Church at the time of the alleged offense, the release said.

Wayne Barron, the executive pastor at Ridgecrest Baptist Church, told the News-Leader that church leaders fired Wieneke on April 2 because of the investigation.

Wieneke had been employed at Ridgecrest since 2013, Barron said, and he did not work with children for his job.

"We have fully cooperated with law enforcement and have been relieved to know that no alleged wrongdoing has involved any church members or church property," Barron said. "We are continuing to pray for all parties involved."

The release said Wieneke was charged in an indictment on June 13.

The indictment was made public Monday after Wieneke's arrest and initial court apppearance, the release said. He remains in federal custody.





East Stroudsburg man charged with
49 counts of child porn
  
An East Stroudsburg man was charged with 49 counts of child pornography, one count of disseminating child pornography and one count of the criminal use of a communications facility on Monday.

The suspect, Erik Decker, 21, was arraigned in front of District Magistrate Michael Muth Monday morning.

According to a criminal complaint, Monroe County District Attorney’s office Det. Briane Webbe received a Cybertip on April 6 which documented the dissemination of purported child pornography by posting child porn to a public chat room on March 1. Cybertip is a tool used by the National Center for Missing and Exploited Children.

The user posting the alleged child porn used the screen name ODTeen.

Chatstep.com, a group chat service, reported the incident to the National Center for Missing and Exploited Children, and included the flagged image of child pornography. The image depicted a prepubescent female child, approximately 8 to 10 years old, nude and lying on her back in a suggestive pose.

Pursuant to a subpoena, PenTeleData, Inc., the internet service provider who services the reported internet address of the user, identified the assigned address as uploaded by Decker.

Police executed a search warrant at Decker’s East Stroudsburg apartment on June 2, and found several computers located in his bedroom. Decker told police only he and his roommate had access to the secured wireless network in the home. Decker allegedly acknowledged using Chatstep.com, but denied knowledge of child pornography.

Police seized the computers and other related items, including a Lenovo laptop. A subsequent analysis of the laptop revealed the presence of 49 photos of child pornography, which were contained in two compressed files. The files, which were found in the computer’s downloads folder, were created on March 1.

All of the files depicted children between the ages of 5 and 12 years-of-age in a prohibited sexual act, and are child pornography, according to the criminal complaint.

Of the 49 files, 46 of them depicted indecent contact, and were graded as second-degree felonies. The remaining three files depicted nude children but did not depict indecent contact. These were charged as third degree felonies.

Decker was arrested on Monday. In a subsequent interview, he told Webbe that he was the only one who used the Lenovo laptop, and identified the user of the account on the password-protected device as himself.

He told Webbe he had visited Chatstep in the past but probably not since Dec., 2016.

When shown a screen capture of the downloads folder, Decker identified the subject of several of the photographs in that folder as himself. He continued to deny knowledge of the presence of child pornography, according to Webbe.

When Webbe confronted Decker with his findings through a forensic examination of the Lenovo, Decker requested an attorney and the interview was terminated.

Decker was arraigned on Monday in front of Magisterial District Magistrate Michael Muth and confined to the Monroe County Correctional Facility in lieu of $1,000 cash bail.

The judge scheduled a preliminary hearing for 10 a.m. on June 27.
