Former Colorado church leader arrested on
child sex assault charges
Author: Janet Oravetz
GREELEY — A former church leader at La Iglesia De Restoration church in Greeley has been arrested and faces charges of sexual assault on a child after a 16-year-old girl came forward about an intimate relationship with him, according to an arrest affidavit from Greeley Police.
Nison Yovani Lemus-Alvarez, 37, faces charges of sexual assault on a child-position of trust and sexual assault on a child - pattern of abuse.
According to the affidavit, the alleged victim's mother called police in October 2017 when her daughter told her she had a relationship with Lemus-Alvarez. The mother, whose daughter was a volunteer at La Iglesia De Restoration Church, told detectives after her daughter disclosed the alleged abuse they had a meeting with Lemus-Alvarez. During that meeting, she told detectives that he admitted to kissing her daughter.
Her mother also stated there were text messages between the two "where he tells her that he loves her," the affidavit says.
However, during an interview with police, the victim stated that "the only things that happened between them was him touching her hands and giving hugs." According to the arrest report, she told the detective she had lied to her mother when she said, "the defendant had touched her part."
Following her interview, police suspended the case because the alleged victim would not cooperate. In April 2018, the alleged victim contacted police and asked them to reopen the case.
During a second interview with the victim, she told police she lied during the first interview, because, "the defendant told her not to tell anyone." She told detectives the first alleged incident happened in July or August of 2017 when Lemus-Alvarez began picking her alone. Prior to that, she told police his wife and children were with him.
In that first incident, she told police Lemus-Alvarez parked far away from the house and kissed her. According to the arrest report, she got out of the car when he tried to kiss her a second time. After that, the alleged victim told police they kissed for a "couple of months". Lemus-Alvarez told her "he had fallen in love with her," the affidavit says.
Eventually, the victim told police they engaged in inappropriate touching that did not include sexual intercourse. Lemus-Alvarez was arrested July 10 and is being held at the Weld County Jail on $75,000 bail.
He has also been removed from his leadership role at La Iglesia De Restoration.

Maryland elementary school coach, teacher gets 30 more years for child sex abuse, child porn
by Don Parker/ABC7
UPPER MARLBORO, Md. (ABC7) — A former elementary school teacher and basketball coach was sentenced to 30 years in prison Friday after pleading guilty to state charges of sex abuse of a minor and child porn.
The 30-year sentence on state charges in Prince George’s County comes three days after Christopher Speights, 35, of Capitol Heights, was sentenced by a federal judge to 35 years on related child pornography charges.
In a plea agreement in the federal court, Speights admitted to filming himself sexually exploiting boys and secretly filming boys while on basketball trips. He said he later blackmailed the boys to get them to send him more photos.
He also admitted posing as a teenage girl online to solicit boys and girls to send him sexually explicit images of themselves.
Speights served as a substitute teacher and basketball coach at Bradbury Heights Elementary and coach of a traveling basketball team, the South County Steelers.
In December 2016, Maryland State Police said they received a cyber tip from Dropbox that a user allegedly possessed child pornography. An investigation later revealed that Speights was the owner of the account, according to the Prince George’s State's Attorney's Office.
Speights still faces charges in Worcester County on related charges.
Cardinal Theodore McCarrick facing new allegations of child sexual abuse
Nick Muscavage, Bridgewater Courier News
Two more accusers have stepped forward with allegations they were sexual abused by Cardinal Theodore McCarrick, in addition to an initial accuser who alleges McCarrick sexually abused him as a minor 47 years ago.
In a report published by The New York Times earlier this week, a man claims McCarrick took advantage of him while he was studying to become a priest in the 1980s, when McCarrick was bishop of the Diocese of Metuchen.
Robert Ciolek said McCarrick "began inviting him on overnight trips, sometimes alone and sometimes with other young men training to be priests," according to the report.
The bishop would "assign" Ciolek to share his room, which had only one bed, and requested he “come over here and rub my shoulders a little,” that extended into unwanted touching in bed, according to the report.
Days later, in a story also published in The New York Times, another man, who identified himself only by his first name James, said McCarrick began abusing him when he was 11 years old.
James, of Tenafly, recounted instances during which McCarrick asked him to turn around while changing into his clothes and, when he did, McCarrick allegedly dropped his pants as well and exposed himself to James when he was child.
"It is difficult for the Archdiocese of New York to make a statement in this matter as we have not yet been contacted by either the gentleman bringing the complaint or his attorney, so all we know is what we saw in the paper today," said Joseph Zwilling, director of communications for the Archdiocese of New York. "We do hope that this individual comes to us, as we would like to work with him to resolve this situation, and to bring a sense of resolution and peace to him."
"As was demonstrated with the other accusation against McCarrick a month ago, we have a process in place that takes these allegations seriously, and the person bringing the allegation is treated with dignity, compassion, and respect," he added.
Ciolek, who lives in Monmouth County and is laicized, received $80,000 in a settlement from the Diocese related to his allegations, according to the story.
It was in James' Tenafly home where years of sexual abuse began, Patrick Noaker, James' attorney, told NorthJersey.com. When James was 11, as he was changing out of his bathing suit, McCarrick, then 39, walked into the room and took his own pants off.
"McCarrick came into the boy’s room and he was naked," Noaker said. "McCarrick told him to turn around and said 'See, we’re the same.'" McCarrick, through a spokeswoman, told the Times he had not yet been notified of the accusation, so he could not respond.
The second instance of sexual abuse also occurred in Tenafly, Noaker told NorthJersey.com. "He used the same entrĂ©e," Noaker said. "Under the guise of checking to make sure he was developing properly. He said 'Do you remember? We’re the same. We both have one of these.'"
McCarrick is the retired archbishop of Washington, D.C, who also served as the Archbishop of Newark. and the founding Bishop of Metuchen.
Noaker also represents the victim who initially stepped forward and went public with his allegations against McCarrick. Noaker said his male client, who is remaining anonymous, was 16 and 17 years old at the time the abuse occurred. He's now 62.
He described to My Central Jersey the abuse, which the Archdiocesan Review Board found "credible and substantiated."
"There were two sexual assault events," said Noaker, with Lawyers Helping Survivors of Child Sex Abuse. "Both of the events surrounded the Christmas Mass at St. Patrick's Cathedral, for which he (McCarrick) would have had some responsibility because of course it was the Cardinal who was going to conduct the Mass."
When the first victim came forward, there were no allegations of abuse with minors found as part of the review process. But, allegations that McCarrick engaged in sexual misconduct with adults while he served in New Jersey were reported for the first time.
Church officials said that a review of church records has found no other allegations of abuse of minors during McCarrick's time in the diocese, which includes Hunterdon, Middlesex, Somerset and Warren counties, or the archdiocese, which includes Union County.
But the prelates reported that the review found previously unreported allegations that McCarrick engaged in sexual behavior with adults that the Metuchen diocese and Newark archdiocese received three allegations of sexual misconduct with adults decades ago; two of these allegations resulted in settlements, officials said. A diocesan spokeswoman added that the allegations were reported to law enforcement officials at the time they were made; they had not previously been reported publicly.
72-year-old Omaha man sentenced to prison in
child sexual-assault case
By Jay Withrow / World-Herald
A 72-year-old La Vista man, sentenced Friday in connection with a child sexual-assault case, likely will spend the rest of his life in prison.
Anthony E. Munson was sentenced to 20 to 30 years for first-degree sexual assault of a child and 20 to 30 years for attempted sexual assault of a child. Sarpy County District Judge Stefanie Martinez said the sentences will run one after the other.
Under state sentencing guidelines, the terms will be cut in half, but that still means Munson wouldn't be eligible for parole for 20 years. He would have to register as a sex offender if he were released.
Thomas Brantley of the Sarpy County Attorney's Office said he's not too concerned that Munson's prison sentence essentially is a life sentence. "The victim has lived with this for a long time,'' he said.
Munson was arrested in November in connection with the sexual abuse of a child between Oct. 12, 2004 and Oct. 12, 2005. La Vista Police Chief Bob Lausten said Munson was responsible for similar incidents as recently as 10 years ago and as far back as 30 years ago.
Munson was a Boy Scout leader through St. Columbkille Catholic Church in Papillion, Lausten said. Police have spoken to church leaders and Boy Scouts officials about Munson, he said. Officials suspect that more children may have been affected, he said.
Brantley said Munson had targeted other children, but the statute of limitations had run out on those cases.
John Hascall of the Sarpy County Public Defender's Office said Munson has been "very remorseful." He said Munson was victimized as a youngster and never receive counseling.
"He's very sad about what his life has become,'' Hascall said.
A lot of people are, but, ultimately, it's your fault.

Alabama sex offender who sexually-exploited
5-year-old boy on video gets 50 years in prison
By Carol Robinson crobinson@al.com
A Birmingham man has been sentenced to decades in federal prison for sexually exploiting a 5-year-old boy and capturing the wrongdoing on video.
Larry Dean "Magic" Garrett Jr., who was also convicted 18 years ago of another sexual offense against a child in Michigan, was sentenced by U.S. District Judge Madeline H. Haikala to 50 years in prison on one count of sexual exploitation of a child, according to an announcement by U.S. Attorney Jay E. Town and FBI Special Agent in Charge Johnnie Sharp Jr. There is no early parole in federal prison.
Authorities said Garrett - who performed magic tricks - lived in the same Birmingham apartment complex as his young victim and the victim's mother in 2016 and was known to have spent time with the child, according to evidence.
A friend of the child's family, who also lived in the same apartment complex, testified that he knew Garrett, now 38, downloaded movies and requested one from him. When the man, identified in court records as "A.J," opened the files on the computer memory card that Garrett gave him, he discovered the sexually-explicit video involving the child. He showed the video to members of the child's family, and they provided the video to police.
Garrett chose to represent himself at his 2017 trial.
In the Michigan case, according to Alabama's Sex Offender Registry, the victim was a 13-year-old boy and Garrett was convicted of second-degree criminal sexual conduct.
"There must be a standing reservation in the pits of hell for those who sexually abuse children," Town said. "Fifty years behind the bars of a federal prison is exactly where a repeat child sex offender like Garrett needs to be."
"Sexual exploitation of a child is one of the most abhorrent crimes prosecuted at any level and we must do all that we can to protect our children from this sort of abuse,'' Town said. "Thanks to the FBI's tireless work on behalf of an innocent and particularly vulnerable victim, and to the child's family and friends who showed great courage in their willingness to assist law enforcement, Larry Garrett will never have another opportunity to harm a child."
"Garrett's sentence not only delivers justice for his victims but puts an end to his opportunity to exploit children," Sharp said. "I also hope that this 50-year sentence will serve as a deterrent and a warning to those in our communities who prey upon children that their conduct will not be tolerated, and that the FBI and our partners will work tirelessly to bring them to justice. I commend the agents who investigated Garrett for their professional and thorough investigation."
Wouldn't that be nice.... if only!
Alaska man sentenced for 'images showing the
sadistic abuse of small children'
By Leroy Polk
ANCHORAGE (KTUU) - An Anchorage man was sentenced Thursday to almost a decade behind bars, after the judge presiding over his case said his habitual downloading and viewing of child pornography "places [children] at risk."
Cody James Cogley, 28, of Anchorage, was sentenced today by U.S. District Judge Ralph R. Beistline to nine years in prison, followed by a 30 year term of supervised release, for two counts of possession of child pornography.
KTUU reported on Cogley's arrest last year, when he reportedly send child sexual exploitation videos to their undercover detectives.
Cogley's sentence stems from a number of factors, not only his possession of child porn, described by prosecutors as "images and videos of child pornography, including additional images showing the sadistic abuse of small children."
That content, as reported by the district attorneys, included " a video of a child performing a sexual act on an animal, a video of a naked three to five-year-old child suspended by her feet being sexually assaulted, and a video of a toddler being physically and sexually assaulted."
In addition to the porn itself, prosecutors noted a document found on Cogley's computer, titled “The Pedophile’s Handbook." Prosecutors say that file "contained chapters about how to abduct and molest children."
Chapter titles included “Introduction, Pedophilia,” “Children,” “security,” “Finding Children,” “sex with Kids,” and “Penetration Training,” prosecutors said in a release. Judge Beistline said that there was no direct evidence that Cogley had "engaged in hands-on behavior, however, the handbook
located on his computer was 'evidence of a possible trend in that direction.'"
At the time of his arrest in December of 2017, APD noted that Cogley's vehicle, a 20-foot Ford Econoline van, had its seats removed and windows blacked out with spray paint.
"He was going to buy a bed [for the van]," said MJ Thim, spokesperson for APD. "Putting that all together, we believe he could have committed crimes against children."
At the time of his sentencing, the judge told him, "Clearly you are what we call a pedophile. [...] You have a strong attraction to children, which places them at risk.”
