A Rawalpindi trial court on Wednesday sentenced ‘habitual’ paedophile Sohail Ayaz to death on three counts apart from awarding him three sentences of rigorous imprisonment for abducting and raping young boys and for recording and disseminating the heinous acts.

Ayaz has previously been convicted of similar crimes in the UK and Italy before being deported to Pakistan.

The Additional District and Sessions Judge Jehangir Ali Gondal on Wednesday issued a written verdict wherein the court found Ayaz and his accomplice Khurram Tahir guilty of kidnapping three children.

The court handed three sentences of the death penalty to Chartered Accountant Ayaz under section 367-A of the Pakistan Penal Code (PPC) - for deceitfully taking the victims to his house, confining them, administering them with intoxicants such as ice (crystal methamphetamine) and then raping them.

“He be hanged by neck till his death.” read the verdict.

He was also ordered to pay Rs500,000 as compensation to the family of each of his three victims.

The court further found Ayaz guilty under sections 337, 337-J and 292-C of the PPC - sodomy and participating and profiting from the recording of and sale of child pornography - and was sentenced thrice to serve life in prison, three sentences of 15 years of rigorous imprisonment and three sentences of spending seven years of rigorous imprisonment.

The court also fined him a cumulative Rs4.5 million.

Tahir was handed three seven-year (maximum permitted) prison terms and a cumulative Rs300,000 fine for abducting the victims.

The court noted that even though Ayaz is highly educated, “instead of serving humanity in useful manners, he misused his capabilities in destroying the bright future of minors.

“He had committed offences against society.”

Evil is hardly limited to the poor and uneducated!

Despite having been convicted by a court in the UK, he neither changed his conduct nor reformed himself to become a useful citizen of Pakistan, Judge Gondal observed, adding that Ayaz repeatedly raped children and exploited the innocent children of the beloved country.

“Such accused is like a malignant knot in the body of civil society and deserves nothing but a harsh surgical treatment,” the court observed, adding that children are like blooming flowers and he who crushes their innocence under his cruel feet, needs no leniency by a court of law.

Judge Gondal further termed Ayaz’s act as “inhuman, rather worse than beasts” because even beasts do not ravage the innocence of cubs. Co-accused Tahir was also admonished by the court.

A 32-year-old security guard from Nepal killed three of his children and later died by suicide in Bengaluru. Their bodies were found by his sister on Friday at the security guard’s residence in Mico Layout. The police said that Janakraj Bhist came to Bengaluru with his wife nine years ago and had been working in the city ever since. The couple had three children — Saraswati (14), Hemanti (9) and Rajkumar (3). The family was residing at the quarters in Vinyasa Vijaya Apartments in Ramanashree Layout, where Janakraj worked as a security guard. 

The Mico Layout police said that Janakraj allegedly strangled his children to death. The police said that he had played music loudly to drown out their cries. They said that Janakraj had been depressed ever since his wife, Nanda Devi, died by suicide on September 21. Preliminary investigations revealed that his neighbours knocked on the door many times due to the loud music but did not receive any response from him. 

Police sources said that Nanda Devi was severely ill since the last few years and Janakraj had been caring for her. “When she died, our investigation led us to believe she took the step as she did not want to live with the illness,” the police said. 

Deputy Commissioner of Police (South East division), Srinath Mahadev Joshi said that their bodies were found by Janakraj’s sister Apsara on Friday afternoon. After Nanda Devi’s death, Apsara was taking care of the children and would bring them lunch and dinner. When she went to his residence on Friday afternoon, she opened the door with the spare key and found their bodies. 

The Mico Layout Police have registered a case of unnatural death in Janakraj’s case and also a murder case against Janakraj. “Prima facie, it appears that Janakraj took the drastic step as he was severely depressed after his wife’s death. We haven't found a death note. Further investigation is on,” DCP Joshi added. 

The bodies were taken to Victoria Hospital for an autopsy.

Indian Government Official Arrested for Sexually Abusing 50 Children

The man had been abusing the kids for 10 years, selling child porn via the dark web

India’s Central Bureau of Investigation (CBI) arrested a junior civil engineer on Tuesday, Nov. 17, for allegedly sexually abusing 50 children over a period of 10 years. The accused, named Rambhawan, is a government employee in the northern Indian state of Uttar Pradesh (UP). He was also accused of filming his acts and selling child sexual abuse material (CSAM) on the darknet. 

Government data shows that at least 100 children are sexually abused every day in India. Watching and sharing CSAM is a criminal offence, inviting a five-year jail term and a fine of up to INR 1 million ($13,490).

Officials from the country’s top government investigative agency told the media that the abused children were aged between five and 16 years. The survivors came from Banda, Chitrakoot and Hamirpur districts in UP. The CBI also believes that Rambhawan was working in collusion with other unknown persons. 

A raid at the accused’s house unearthed eight mobile phones, INR 800,000 ($10,763) in cash, a laptop, web-camera, sex toys and a “large volume” of CSAM. The CBI officials also stated that Rambhawan was in touch with several individuals, both Indian and foreign nationals, for the purpose of sharing child pornography. It’s believed that Rambhawan used cloud storage services of mega-nz and box.com to store CSAM. 

Mega-nz recently shared data of a suspended user with the New Zealand government for a child abuse investigation. International media has previously reported how mega-nz is a preferred choice among criminal groups or communities for sharing files such as revenge porn or hacked files. The service gives the users end-to-end encryption as well as large free plans of storage. 

Rambhawan works at the Irrigation Department in UP, and is a resident of UP’s Chitrakoot district.

Another interrogation revealed that the man used to bribe the survivors with electronic gadgets to buy their silence. Over the years, he is said to have created a large collection of photographs and videos, and even shared them via social media.  

The Protection of Children from Sexual Offences Act (POCSO) under the Indian law protects children from such kinds of incidents. However, incidents of child sexual abuse and CSAM have been on the rise. 

According to the National Commission for Protection of Child Rights data, there was a 95 percent increase in online child porn traffic during the nationwide COVID-19 lockdown in India. In the southern Indian state of Kerala, police noted a spike in child pornography cases during the lockdown and initiated “P Hunt 20.2” operation to crackdown on the criminals. Child abuse has routinely emerged from private as well as government-run child care institutions—with 40 percent of them having no measure to protect the children. 

Early this year, a report by the National Center for Missing and Exploited Children in the U.S., and India’s National Crime Records Bureau had found that the Indian states of Maharashtra, Gujarat, Uttar Pradesh and West Bengal are the top states for uploading CSAM. 

Last month, the CBI registered a case against a man in Mumbai for allegedly exploiting children of different nationalities by selling their sexually explicit images online. The survivors were based out of the U.S., Europe and South Asia, among other regions. Early this week, it was reported that as many as 52 teachers in the northern Indian state of Himachal Pradesh have been booked under the POCSO over the last decade. 

Recently, Manforce, an Indian pharma company known for its condom range, launched a campaign amid the surge in CSAM during the pandemic. The same month, the Delhi High Court ordered Facebook and Google to remove a woman’s revenge porn images online after they were posted by her ex-boyfriend. The woman was a minor when the photos were taken.

Earlier this year, on 16th March 2020, BACA reported on the dithering police that failed to take action after a 17-year-old Christian teenager who is both deaf and mute, was kidnapped from her home, then forcibly married to a Muslim neighbour under a sham Islamic marriage.

Police at Sanda Police Station, Lahore failed to take action despite registering a First Information Report (FIR) 405/2020 on 17th March, in which they listed the crime of kidnap of a minor – though at the time no suspects were identified.


Several attempts to garner a police response by Komal’s parents failed to start any investigation. In fact, it was only two months later on 17th March 2020, when a local MP Tariq Gill got involved that police initiated a trace on the last call received from Komal by mother Rubina (45 yrs), just before Komal went missing.

During the investigation two suspects were identified Ali Mubashir and Mohammed Azeem who had had been before the home of Komal at around the time she went missing. Local police called Mr Azeem’s telephone number and got through and he agreed to meet for questioning, but then absconded and become non-traceable for the duration of the two months with Mr Mubashir.

Then on Good Friday (10th April) a call was received by the mother of Komal, Rubina (44 yrs) who heard strange mutterings on the phone that sounded like her daughter.  She reported this to the police who began a trace on the number.

Two weeks later the trace identified a man named Kashif Ghulam Rasool, who was also a local neighbour and a search began for the fugitive.  Unfortunately his phone was now switched off and he had also been found to have absconded.

On 12th of May 2020, Rubina Patras filed a subsequent bian (statement) and nominated 5 persons involved in the abduction of her daughter Komal. The subsequent bian stated that on 16th March 2020, close relatives of Rubina Patras, Mubarik Masih and Saleem Masih witnessed a distressed Komal sobbing in a van along with five unknown men.

Through discussions with local neighbours it soon became very clear who the five men were because they had all disappeared from the community at the same time that Komal disappeared.  So Rubina was able to inform local police of community suspicions that Muhammed Azeem, Mubashir Ali and Ali Abbas were involved in the kidnapping.  One man was still unidentified.

On identification of the culprits, police raided the home of Muhammad Azeem on 24th May and through interrogation they were also able to arrest Mubashar Ali and Ali Abbas, who were in the same house located in Deepalpur, District Okara.  The men denied any knowledge of Komal’s whereabouts but police kept them in their custody.

Following further searches for Kashif at his home, the paternal uncle of Kashif turned up at Sandha Police Station on 5th June. and brought Komal before the police.  He informed police that the teenager was legally married and produced a sham Islamic marriage certificate, a forged birth certificate that stated Komal was 18 years of age (the legal age of consensual marriage).  The uncle also brought a certificate of conversion to Islam.   He told the officers that Komal would be allowed to speak to her parents, but under no circumstance should she be returned to the family.  She was the property of Kashif who was her legal husband and after the meeting Komal should be returned to him.

Following the orders of Kashif’s uncle the police invited the parents of Komal,  Patras Masih (55 yrs) and Rubina to meet with their daughter.  The parents said that Komal was in an obvious distressed state and wept while she communicated in sign language with them.  She informed the parents she loved them, that she wanted to return to them and longed for their protection and that she had been regularly raped by a gang of 5 Muslim men.  When the parents demanded for their daughter to be returned to them, police denied them permission to take her with them.  Member of Provincial Assembly, Tariq Gill who had visited the police with the family demanded for her release and a further police investigation.

On 6th June 2020, Komal was required to attend the Health Department of the Government of the Punjab and underwent a medical examination by Dr. Tauqir Asifa.  In her medical report she confirmed  the physical and sexual abuse of Komal and identified significant wounding on her right forearm and multiple scars were found on the left foot.

Later the same day, Komal went to the District Education Officer (Special Education) Lahore, to meet with a government officer who understood sign language a statement was thus derived at via Tahir Hussain Gazzi.  It is listed that Komal said:

“I was cleaning the floor of my house at around 1:30 pm.

“Suddenly Kashif Ghulam Rasool and her mother Raqiya came and dragged me out of my house by my arm. I’m deaf-mute so I could not make any noise to catch attention of family members.

“They took me into a car and drove me to the other side of the River Ravi.

“On 19th March they took me to Jamia Nameea Lahore and was converted to Islam, Kashif made me do it. Kashif Ghulam Rasool forced me to marry him.

“After that my husband took me to different places to avoid arrest by the police and he often beat me.”

On the same day, Kashif his mother Raqiya applied for pre-arrest bail in the court of Additional Sessions Judge Lahore, Ch. Zulfiqar Ali.  Without any hesitation the Muslim judge granted bail to both of them against the surety bonds of 30,000 PKR each. Raqiya had been very friendly to the family of Komal and had been helping in the investigation, much the same as the caretaker involved in the Soham Murders in the UK. During police investigation she flatly denied being involved in the kidnap, despite being recognized by Komal and her phone number being called during the kidnap of Komal. Oddly she even the parents of Komal when they visited her house on discovering her number was listed in Kashif’s mobile. She later that evening beat Komal too because she had made calls that would later lead to her arrest.

Some time later, Qari Muhammad Saeed of Dar-Ul-Aloom Jamia Naeemia, Lahore, gave a statement to the police that on the 19th of March Komal was converted to Islam and legally married. In a statement to  Investigation Officer (IO) Ibrar Hussain, he said:

“This conversion took place by writing Qalma Tayba on a paper.

“Komal was brought to me for conversion. Komal told me through signs that she can read and write and so I wrote Qalma Tayba on a piece of paper for her.

“Komal followed me in writing Qalma Tayba on another piece of  paper and in this way Komal entered into Islam.”

Patras Masih has spoken with BACA about the poor policing they suffered, he said:

“The Investigation report presented by IO Ibrar Hussain clearly favored the culprits. In his report he took statements from Muslims in the house that my daughter was repeatedly raped.

“They stated that Komal seemed very happy and content in her marriage and denied other men entered the house. 

“Instead of doing a fair investigation and recording the facts he recorded these false statements as true. This delayed the return of my daughter and led to more beatings and rapes and has slowed down the process of justice.”

In the office of Deputy Inspector General of Police Lahore, an application was filed to reinvestigate the matter by MPA Tariq Gill. The application was denied by the office however, BACA’s solicitor Sumaira Hussain who is leading this case will be seeking an investigation into police conduct through the courts.

A protest was held in front of Lahore Press Club when the biased and despicable police negligence that led to an extension of the torturous treatment towards Komal. To reduce community anxiety and to bring an end to the protest DSP Javed Sadiq of Central Investigation Agency confirmed to the parents of Komal that from now on a fair investigation will ensue, after calling them to his office on 4th November 2020.

Komal is with her family in a secret place while she is recovering from a very brutal and violent attack.




New police team will investigate case involving the alleged abuse of a Class IV student in Kannur after eight months of getting nowhere

THIRUVANANTHAPURAM: In the wake of the High Court directive, Kerala Police has reconstituted the Special Investigation Team (SIT) to probe the sensational Palathayi child sexual abuse. 

The team leader IG (crimes) S Sreejith has been replaced. As per the reports, the new team will be led by IG EJ Jayaraj. 

Last month, the HC directed the police chief Loknath Behera to reconstitute the SIT as the family of the victim approached the court seeking to replace Sreejith as they were unhappy with the probe led by him.

Justice PV Kunhikrishnan had issued the order while disposing of a petition filed by the mother of the Palathayi child abuse case victim, seeking to reconstitute the SIT probing the case by appointing a new officer not below the rank of IG of police to conduct a proper investigation. 

The police have not made any breakthrough in the case involving the alleged abuse of a Class IV student of a school in Palathayi in Kannur nearly eight months after it first came to light.

Expressing distrust in the investigation, the victim's mother had earlier said her minor daughter will not get justice from the investigation team led by Sreejith. Though seven months have passed since the team launched the investigation, there was no headway in the case. 

The delay in completing the investigation was deliberate and aimed at providing undue advantage to the accused, she had said, adding that it goes against the POCSO Act which provides for expeditious investigation and trial.

She had also added that the investigation team did not record the statement of the child by audio-video means as specified under Section 26(4) of the Act and was manipulating statements in the name of the victim.

K Padmarajan, a school teacher and local BJP leader, is the accused in the case. According to the complainant, the accused sexually abused the girl, studying in Class IV, when she went to the washroom of the school.

Policing in India can be a very dirty business.
