US Supreme Court rebuffs singer R. Kelly's

challenge to sex abuse conviction

WASHINGTON (Reuters) - The U.S. Supreme Court declined on Monday to hear imprisoned former R&B superstar R. Kelly's appeal of his 2022 federal conviction on charges involving child pornography and luring underage girls to have sex with him, one of two cases in which he was found guilty of sex crimes.

The justices turned away Kelly's challenge to a lower court's decision upholding his conviction by a federal jury in Chicago.

Kelly, now 57, claimed in his Supreme Court filing that prosecutors filed the charges against him in the case after the statute of limitations had expired.

During that trial, several women testified that Kelly sexually abused them when they were minors. The jury also was shown video of Kelly molesting his goddaughter, who testified that the abuse began in the 1990s when she was a teenager.

Kelly, whose full name is Robert Sylvester Kelly, was sentenced to 20 years in prison in the case. He was found guilty of three child pornography counts and three counts of enticing minors for sex, but acquitted of seven other charges that included obstruction of justice, and conspiracy to receive child pornography.

Kelly in 2021 was convicted in another trial by a jury in New York City's borough of Brooklyn on all nine charges he faced, including racketeering and eight counts of violating the Mann Act, which forbids transporting people across state lines for prostitution. He was given a 30-year prison sentence in that case, set to largely overlap with his sentence in the Chicago case.

Kelly is incarcerated at a Butner, North Carolina federal prison and is eligible for release in 2045, according to federal Bureau of Prisons records.

Kelly filed his Supreme Court appeal after the Chicago-based 7th U.S. Circuit Court of Appeals in April rejected his challenge.

Former BBC journalist, Duncan Bartlett, has been sentenced to eight years in prison after admitting to paying for access to livestreams of children being sexually abused in the Philippines. 

The 52-year-old was sentenced at Wood Green Crown Court in north London following his guilty plea to 35 charges in August. Notably, Bartlett previously served as the BBC's correspondent in Tokyo and spent 15 years working for the BBC World Service.

According to the Metropolitan Police, Bartlett was first arrested in September 2021, after intelligence was received which linked him to accessing indecent images of children, Independent reported.

The forces seized his electronic devices which had 6,000 indecent images, and held records of payments to the Philippines to people who organised the abuse of children.

Forces reported that some of the victims have been identified and are now receiving safeguarding measures in the Philippines.

Bartlett pleaded guilty to multiple child sex offenses, including causing and paying for sexual activity with minors, producing child pornography, and encouraging others to commit similar crimes.

Detective Constable Emily Dawson who led the investigation said, "Over a period of seven years, Bartlett made multiple payments to people in the Philippines asking that they arrange children to be sexually exploited for his own gratification.

“With close liaison work with our counterparts in the Philippines, we managed to identify and safeguard some of these children while several adults were arrested.

“Bartlett’s behaviour was utterly abhorrent but thanks to the painstaking work of detectives, a case documenting his offending was put together – this left him with no option but to admit his guilt," the Independent reported.

 Abi claims in a new two-part documentary seriesthat her father molested her as a child.

Abi, whom Kelly shares with ex-wife Andrea "Drea" Kelly, detailed her alleged sexual abuse in an episode of the "Karma: A Daughter's Journey" series.

"He was my everything. For a long time, I didn't even want to believe that it happened. I didn't know that even if he was a bad person that he would do something to me," Abi, whose legal name is Joann Kelly, says in the documentary. Abi added that she "was too scared to tell anybody. I was too scared to tell my mom."

She continued: "I really feel like that one millisecond completely just changed my whole life and changed who I was as a person and changed the sparkle I had and the light I used to carry." Abi said that "after I told my mom, I didn't go over there anymore; my brother (Robert) and sister (Jaah), we didn't go over there anymore."

In a statement to People magazine, Kelly's attorney Jennifer Bonjean said, "Mr. Kelly vehemently denies these allegations. His ex-wife made the same allegation years ago, and it was investigated by the Illinois Department of Children & Family Services and was unfounded…. And the 'filmmakers,' whoever they are, did not reach out to Mr. Kelly or his team to even allow him to deny these hurtful claims."

USA TODAY reached out to reps for R. Kelly and the documentary for comment.

Buku Abi was 'a different person' after alleged abuse

In the series, Abi goes in depth with disturbing details about the alleged sexual abuse, saying the alleged instance happened when she was 8 or 9.

"I just remember waking up to him touching me," she tearfully recalls. "And I didn’t know what to do, so I just kind of laid there, and I pretended to be asleep." She added that "from that moment on, I was a different person."

Abi says, "It was hard to accept that it happened" and later she had to tell her mom. The news "completely broke her heart" she says about mom Drea Kelly.

Abi is one of the embattled artist's three children with ex-wife Drea Kelly; the two were married from 1996 to 2009.

In 2019, the "I Believe I Can Fly" singer sparked a controversy when he shared a video to Instagram and Twitter, singing and telling his estranged daughter, "Happy birthday baby. Daddy loves you. I love you, no matter what, I love you so much."

Abi started using a different name to separate herself from her father's last name and previously took to social media in January 2019 to publicly condemn Kelly, calling him a "monster" and noting that "it has been years since my siblings and I have seen or have spoken to him." Abi publicly addressed her relationship with her father amid damning allegations against her father that were highlighted in Lifetime's "Surviving R. Kelly" docuseries.

R. Kelly’s bid to shorten his lengthy prison terms came up short on Friday, as the Seventh Circuit Court of Appeals in Chicago decided that his 2022 conviction would be upheld.

Kelly had tried to appeal the 20-year sentence on his child porn conviction in Chicago, seeking a reduction in prison time, but the court’s decision killed that bid this week after directly linking the Chicago sentence to the 30-year sentence the singer received in New York on sex trafficking and racketeering charges.

According to court documents obtained by The Daily Beast, Kelly appealed his convictions for Sexual Exploitation and Inducement of a Child on the grounds that the statute of limitations on the charges had run out, one of the charges should have been heard by a separate jury, and that 240-month sentence was “improper” procedurally.

All of those points were shot down, as it was argued that the statute of limitations extends through the lives of the victims, the jury was “properly instructed” and “discharged its duty with care,” even acquitting Kelly on seven counts, and justified his 240-month sentence as “within guidelines.” Subsequently, the court decided this week that Kelly’s six convictions would not be reversed and he would not receive a new sentencing hearing.

The disgraced R&B star is still appealing his New York conviction, claiming that the bombshell docuseries Surviving R. Kelly unfairly influenced his trial.

“We are disappointed in the ruling but our fight is far from over,” Jennifer Bonjean, Kelly’s defense attorney, tells The Daily Beast. “We will seek review from the Supreme Court and continue to pursue all of his appellate remedies until we Free R. Kelly. You can bet on that.”

Because, R Kelly needs to be freed in order to destroy another bunch of girls! Pfft!

Harvey Weinstein appeared Thursday in a Los Angeles court, where he was sentenced to 16 years in prison for raping a woman in 2013.

Judge Lisa B. Lench denied the disgraced movie mogul’s request for a new trial before victim, Jane Doe 1, only identified as an Italian model, gave an impact statement.

Weinstein — who is already serving a 23-year prison sentence in New York for criminal sexual assault and third-degree rape — then spoke to the court to plead for leniency before his sentence was handed down.

He said: “I maintain that I am innocent. I don’t know this woman.

“This is about money. This is what happens when there is a cottage industry of lawyers. She had every opportunity to report this to police.

“This is another story, and with all due respect, Jane Doe 1 is an actress. She can turn the tears on. Please don’t sentence me to life in prison. I don’t deserve it. There are so many things wrong with this case. 

“This is a setup. I beg your mercy. “

Lench then ruled that the sentence on the three counts Weinstein was convicted of would be eight years for forcible rape, six years for forcible oral copulation and two years for sexual penetration by a foreign object, all to run consecutively.

What this article fails to tell us is if the LA sentence is to run consecutively with the NY sentence!

Weinstein had initially faced more than 11 counts of sexual assault against four women which took place between 2004 and 2013 at the trial, which lasted two months and concluded in December.

It took a jury 10 days of deliberation and 41 hours of debate before it reached a guilty verdict against Weinstein.

A mistrial was declared on charges against Weinstein involving Jane Doe 2, who had been previously identified as actress and screenwriter Lauren Young, and Jane Doe 4, who is Jennifer Siebel Newsom — the wife of California Gov. Gavin Newsom.

Weinstein was found not guilty of sexual battery by restraint of Jane Doe 3, a massage therapist with ties to Mel Gibson.

During her testimony at the trial, Jane Doe 1 had said Weinstein bullied his way into her room at the Mr. C Hotel in February 2013, then forced her to orally copulate with him. She said Weinstein then pulled her into the bathroom, where he raped her.

In her victim impact statement to the court Thursday, a sobbing and trembling Jane Doe 1 said: “Ten years later, the effects of this rape are still raw and difficult to discuss. I have been carrying this weight, this trauma. This irrational belief that it was my fault.

“His selfish, disgusting actions have greatly impacted my life … Everything changed after the defendant brutally assaulted me.

“Your honor, I hope you can understand my suffering. There is no prison sentence long enough to undo the damage. I hope that you give him the maximum sentence allowable. 

“I will be forever grateful to the jury who found the defendant guilty of rape.” 

Weinstein’s Defense attorney Mark Werksman argued for a lesser concurrent sentence and said Weinstein’s “behavior” with Jane Doe 1 was “only one frenzied ordeal.” The attorney also begged for a lighter sentence because of Weinstein’s age and his deteriorating health.

“He’s a 70-year-old man with bad health, coronary disease, chronic lumbar disc fracture, arthritis,” Werksman said. “Consider the life he lived. Mr. Weinstein did a lot of good for a lot of people.”

One of Marilyn Manson’s former sexual assault accusers claims in a new legal filing that the shock rocker’s ex Evan Rachel Wood and others “manipulated” her into making false rape allegations.

“I succumbed to pressure from Evan Rachel Wood and her associates to make accusations of rape and assault against [Manson] that were not true,” Ashley Morgan Smithline says in an explosive declaration obtained by Page Six exclusively on Thursday.

The 38-year-old model, who is Jewish, previously accused Manson, 54, of forcibly raping her while cutting her with a swastika-emblazoned knife and shoving his fist in her mouth during sex.

She conducted a national TV interview about her claims on “The View” in June 2021 and filed a lawsuit against the “Dope Show” singer. Her case was then dismissed in January after she failed to find new legal counsel.

Smithline also had a People cover story, in which she shared graphic details of Manson’s alleged abuse.

Now, Smithline claims those public appearances and the lawsuit itself were all a farce.

The Los Angeles native says in her declaration that either Wood’s girlfriend, Illma Gore, or Ashley Walters — Manson’s former assistant who also previously sued him — contacted her in 2020.

The women allegedly proposed that Smithline participate in group meetings with others who claimed to be “victims” of Manson, whose real name is Brian Warner, including Wood.

Smithline claims she was asked in the meetings whether she had been “whipped, chained, tied up, branded, cut, assaulted while sleeping, beaten, or raped” by Manson, and she allegedly responded, “No, this did not happen to me, and this was not my experience.”

However, she claims Wood, 35, told her that “just because she could not remember” those things “did not necessarily mean that it did not happen,” alleging it was possible she had “repressed” memories due to her alleged trauma.

Smithline believes Evan Rachel Wood, Manson’s ex-fiancée, had ulterior motives.

R. Kelly dodges ‘life sentence’ in child porn case

R. Kelly dodged an effective life sentence Thursday when a Chicago judge tacked on just one extra year to his 30-year punishment behind bars.

The 56-year-old disgraced R&B singer was sentenced in his Illinois case to 20 years in prison — with 19 to run concurrently with his existing, 30-year sentence out of Brooklyn.

That means he’ll only serve one extra year behind bars.

Why the concurrent sentence? Was Kelly charged with sexually abusing his Goddaughter 3 times, or just with making child porn? You can't make child porn without child sexual abuse. Did this little girl's life get ruined for free?

Chicago prosecutors had asked that Kelly be slapped with 25 years, to be served consecutively with the Brooklyn case — which would’ve meant the “I Believe I Can Fly” singer would be eligible for release in 2066 at age 99.

A Chicago jury last year convicted the perv, whose real name is Robert Sylvester Kelly, on six of 13 counts — three of them for producing child porn in connection with videos of himself abusing his 14-year-old goddaughter, and three of enticement of minors for sex.

Kelly spoke at the start of Thursday’s hearing, answering US District Judge Harry Leinenweber when he asked if he had reviewed evidence for any inaccuracies.

“Your honor, I have gone over it with my attorney,” Kelly said. “I’m just relying on my attorney for that.”

Two accusers read statements aloud in court, asking the judge to harshly punish the convicted sexual predator.

“I have lost my dreams to Robert Kelly,” a woman who addressed the court under the pseudonym “Jane” said. “I will never get back what I lost to Robert Kelly. … I have been permanently scarred by Robert.”

“When your virginity is taken by a pedophile at 14 … your life is never your own,” she continued.

Another accuser had addressed Kelly directly, speaking under the pseudonym “Nina.”

“Now you are here … because there is something wrong with you,” she said, as her voice quivered. “No longer will you be able to harm children.”

Kelly was acquitted of charges that he had rigged the not-guilty results of a 2008 child porn trial, in addition to being cleared of three counts of conspiring to receive child pornography and two enticement charges.

Defense attorneys argued that Kelly should be slapped with a 10-year sentence, served concurrently with his current prison term.

Last month, Cook County, Illinois, Judge Lawrence Flood dropped additional sex abuse charges in connection with alleged abuse of three minors and one woman by Kelly at the advice of a prosecutor.

State’s Attorney Kim Foxx said she was comfortable with the dismissal of the state charges because the three-time Grammy winner was set to spend decades behind bars.

What kind of reasoning is that? 

The move prompted accuser Lanita Carter to rail that “justice was denied” for her.

“I have spent nearly 20 years hoping that my abuser would be brought to justice for what he did to me,” Carter said.

Another sexual misconduct case against Kelly is pending in Minnesota.

Kelly, who illegally married the late singer Aaliyah when she was just 15 after falsifying documents, was the target of widespread outrage and criminal charges after the 2019 Lifetime docuseries “Surviving R. Kelly” detailed his penchant for abusing minors.

DISGRACED singer R Kelly has been sentenced to 30 years after being found guilty of orchestrating a scheme to recruit women and underage kids for sex.

The singer, born Robert Sylvester Kelly, was convicted of nine criminal counts last September, including violations of the Mann Act and racketeering.

Judge Ann M Donnelly told the former R&B hitmaker that “the public has to be protected from behaviors like this,” before handing him a stiff sentence.

“These crimes were calculated and carefully planned and regularly executed for almost 25 years. You taught them that love is enslavement and violence,” Donnelly told the singer.

He declined to make a statement before he was sentenced due to pending litigation, according to his attorney.

When asked by the judge if he wished to make a statement, Kelly said, “Yes, your honor, that is my wish.”

Kelly, who was in court wearing black eyeglasses and a khaki shirt, kept his head down as Judge Ann M Donnelly began to go over the sentencing guidelines.

The first victim to make a statement during his sentencing was Angela, who called Kelly a "Pied Piper who lured children with his money and celebrity."

“With every addition of a new victim, you grew in wickedness. You used your fame and power to groom and coach underage boys and girls for your own sexual gratification,” she said.

"Today we reclaim our names. We are no longer the preyed-upon individuals we once were,” Angela said, adding: “I pray that God reaches your soul."

Another victim, identified only as Jane Doe No. 2, described in detail how Kelly would return sweaty from basketball games with his friends before making her perform oral sex on him.

“I felt special because someone who was special to the world was interested in me,” she said, adding: “I hope you go to jail for the rest of your life.”

After her client was handed a 30-year sentence, attorney Jennifer Bonjean said Kelly is "not a predator" and said he was "prepared" for the stiff sentencing.

“He has regrets, and he is sad. He disagrees with the characterizations that have been made about him.”

Prior to his sentencing, the I Believe I Can Fly singer's lawyer blamed his "hypersexual" behavior on being repeatedly sexually abused by his sister as a child, as she pleaded with the judge for a lighter sentence.

Two psychologists who evaluated Kelly wrote in reports submitted with the memo that his older sister sexually abused him and his brothers for years, and started when the singer was only six.

This trauma, Bonjean argued, likely contributed to his "hypersexual" behavior and impaired his cognitive ability.

Kelly is functionally illiterate and has the cognitive ability of a student of elementary school level, Bonjean wrote.

'SEXUAL PREDATOR'

The charges were based on the argument that the entourage of managers and aides who helped the singer meet girls — and keep them obedient and quiet — amounted to a criminal enterprise.

During his trial, several accusers testified in lurid detail, alleging the star subjected them to perverse and sadistic whims when they were underage.

Following the jury's verdict last September, women's rights attorney Gloria Allred, who represented several of Kelly's victims, described the musician as the worst sexual predator she had pursued in her 47-year career of practicing law.

One of Kelly's victims, Lizzette Martinez, told TMZ she believes the feds' recommendation of 25 years in prison is "too low," and instead, he should spend life in prison.

"The situation is that he's destroyed so many lives for so long that I think 25 [years] is too low, to be honest with you," Martinez said.

"We deal with residual side effects. Like we have to live with this forever. You know, it's not something that just goes away. Lock him up and throw the key away or put him under the jail forever."

Kitti Jones, another one of Kelly's victims, told TMZ that she has no issue with the prosecutor's recommendation but said: "no amount of time will give her, and others, back their time or remove their trauma."

Meanwhile, Kelly's ex-wife Drea Kelly, who was married to the disgraced star for 13 years, said her "heart breaks" for her kids, who are forced to live with their dad's shame.

She told Good Morning Britain in September: "Well, I sit in a very difficult place cause, unlike the rest of his victims, I also share children with him. "I was married to him."

Drea, who shares three kids with the disgraced R&B singer, told the show how she wears two hats, that of a survivor and a mother.

She said: "My heart definitely goes out to the survivors and the courage that it takes to even come forward and tell the story.

"But my heart breaks as a mother because this is now the legacy that my children will have to deal with and their children's children."

Drea, real name Andrea, was married to R Kelly from 1996 to 2009.

KELLY'S DOWNFALL

The disgraced singer was first accused of having sex with underage girls in the 1990s, and his illegal marriage to late singer Aaliyah in '94, when she was 15 at the time.

In 2002, Kelly was indicted on child pornography charges but was acquitted in 2008 at a trial in Chicago.

It was not until the #MeToo movement renewed scrutiny of his actions that a new wave of charges arrived — and a conviction was stuck in New York.

Federal prosecutors wrote in their sentencing letter that Kelly showed no remorse and, for decades, “exhibited a callous disregard” for the effects of his abuse on victims.

“He committed these crimes using his fame and stardom as both a shield, which prevented close scrutiny or condemnation of his actions,” prosecutors wrote of Kelly.

“And a sword, which gave him access to wealth and a network of enablers to facilitate his crimes, and an adoring fan base from which to cull his victims.”

Kelly is scheduled to face another federal trial alongside his former employees in Illinois.

A GLAMOROUS horse-breeding heiress accused of having sex with a teenage boy four times in a day is being held in a fearsome jail.

Savannah Daisley, 48, has swapped her £5.6million mansion in Sydney's waterfront for a grimy cell one of Australia's most notorious jails after being denied bail.

She allegedly had drunken romps with the 14-year-old over the course of 24 hours in May last year.

Daisley, a health entrepreneur and Instagram influencer, was charged this week with four counts of aggravated sexual intercourse with a boy between 14 and 16 years old.

The mum-of-two has been in custody since June 27. She has now been refused bail after appearing in court.

Daisley has been sent to the Silverwood Women's Correctional Centre, home to some of Australia's most infamous female offenders.

They include Jessica Camilleri, who beheaded her mum, serial child killer Kathleen Folbigg, Sharyn Ward, who slowly murdered her nine-year-old through starvation, and terrorist plotter Alo-Bridget Namoa.

The cell where she'll live for the next six months is in stark contrast to her home in the city's exclusive lower north shore, with its stunning views of Sydney Harbour.

Her father is Ross Daisley, a famous breeder of thoroughbred racehorse Choisir, which became an international champion after winning at the prestigious Royal Ascot and Newmarket races in 2003.

Mr Daisley had offered to pay a $10,000 (£5,667) bail but a judge ruled it wasn't in the public interest for her to be released from custody.

The child abuse occurred on four occasions in 24 hours on May 20, 2021, according to police allegations.

Police said they have evidence that the founder of detox business Smart Cleanse admitted to kissing the teenager after they legally tapped Daisley's phone.

The lifestyle entrepreneur, who has 40,000 followers on Instagram, will remain behind bars until her next court date on August 23.

Daisley denies all charges, but has not yet formally entered any pleas.

She launched her detox programme in 2014, along with a Smart Cleanse cooking channel, a Smart Cleanse detox book and digital courses.

In the past, she has alluded to her previous struggles with alcohol on her Instagram feed.

Harvey Weinstein's lawyers asked the judge in his New York City rape case to step aside Wednesday, a day after he threatened to jail the disgraced movie mogul for texting in the courtroom.

Weinstein's lawyers sent a letter to Judge James Burke saying his comments Tuesday raised questions about his impartiality. Burke has not ruled on the request.

Burke admonished Weinstein as jury selection was getting underway, asking: "Is this really the way you want to end up in jail for the rest of your life, by texting in violation of an order? Is it?"

Burke cut off Weinstein before he could answer. Weinstein's lawyers said in their letter Wednesday that their client, who's been seen clutching an iPhone, was using it before court was in session.

The defence further argued that Burke failed to adequately safeguard Weinstein's right to a fair and impartial jury, in part by rejecting a request to halt jury selection for a "cooling off" period after prosecutors in Los Angeles filed new sex crimes charges against him on Monday.

In addition to Burke's recusal, they demanded the trial be stopped until negative publicity from the new charges dissipates. Weinstein's lawyers also want more time for individual questioning of potential jurors and asked for permission to have his jury consultant sit with his lawyers during such questioning.

"Faced with extreme and unfairly prejudicial negative publicity both pre-trial and now during jury selection, [Burke] has refused the defendant's requests for additional necessary procedural safeguards," Weinstein's lawyers wrote.

Judges seldom step aside from cases over such requests, but Weinstein's lawyers could also be making an issue of Burke's comments and rulings to set the stage for a possible appeal.

The recusal request came during a second day of jury selection that ended with 30 people invited back next week for additional questioning. In all, 66 prospective jurors have advanced to the next stage in what is expected to be a lengthy selection process.

On Tuesday, the first group of prospective jurors were given questionnaires asking, among other things, if they could ignore media coverage and decide the case based only on evidence heard in court.

About 120 prospective jurors are being summoned to court each day.

Allred not excluded
As Wednesday's group was assembling, Weinstein's lawyers took aim at one of his chief critics, trying to get prominent attorney Gloria Allred barred from the courtroom for the trial.

Allred represents one of the accusers in the criminal case, Mimi Haleyi, and two other women who are expected to testify, including actress Annabella Sciorra.

Weinstein's lawyers argued Allred shouldn't be allowed to watch trial testimony because they're considering calling her as a witness, but Burke rejected the request, saying there was too much uncertainty over whether she'd take the stand to remove her.

Allred later accused the defence of trying to interfere with her ability to represent the women and said having her testify might not do them much good. She told reporters outside the courthouse that if called as a witness, she couldn't be compelled to reveal any confidential communications with clients.

Weinstein is charged in New York with raping a woman in a hotel room in 2013 and sexually assaulting Haleyi in 2006. If convicted, he could be sentenced to life in prison.

As his New York trial was getting underway Monday, Los Angeles prosecutors announced new charges in a separate case against Weinstein. Those charges accuse Weinstein of raping one woman and sexually assaulting a second on back-to-back nights in 2013. Weinstein has not entered a plea in that case, which will be tried later.

The 67-year-old former studio boss behind such Oscar winners as Pulp Fiction and Shakespeare in Love has said any sexual activity was consensual.

No delay granted
Weinstein's lawyers unsuccessfully tried to delay jury selection Tuesday in light of the Los Angeles case, asking for a "cooling-off period" to allow the publicity to subside.

Burke expressed confidence that the jurors would know that Weinstein is presumed innocent until proven guilty, and he pressed on.

During Tuesday's court session, potential jurors were introduced as a group to Weinstein and were read a list of names that could come up at trial, including actresses Salma Hayek, Charlize Theron and Rosie Perez.

New pools of prospective jurors will be summoned to court each morning in the coming days. A second round of jury selection will take place next week, when potential jurors who survived a first round of cuts come back to be questioned further.

Jurors were also told the trial will last about six weeks once testimony begins.

French author Gabriel Matzneff accused of child sexual abuse in new book

An 83-year-old French author has been accused of child sexual abuse in a book by an alleged victim that has provoked controversy over attitudes to sex with minors in France.

Vanessa Springora, 47, a publisher, recounts how she allegedly had sex in the mid-1980s, at the age of 14, with Gabriel Matzneff, an award-winning author then nearly 50.

Her book, Le Consentement, or Consent in English, to be published next week, follows a torrent of allegations of sexual violence and sexism in France, triggered by the #MeToo movement and accusations of rape and sexual assault against Harvey Weinstein, the Hollywood producer.

She does not accuse Mr Matzneff of forcing her to have sex, explaining that she was captivated by the older man’s charisma.

“How can you admit that you were abused, when you cannot deny that you consented?” she writes. “At 14, you’re not supposed to find a 50-year-old man waiting for you at the school gate, you’re not supposed to live in a hotel with him or find yourself in his bed”.

France sets no legal age of sexual consent. Last year parliament dropped a proposal to make 15 the age at which a minor could agree to have sex with an adult.

Ms Springora’s book, presented as a novel, refers to Mr Matzneff by his initials, GM, but she has not sought to hide that she was writing about her relationship with the author.

Mr Matzneff, who has written and spoken openly about his attraction to male and female minors, told the weekly magazine L’Obs that Ms Springora’s book was a “hostile, nasty, denigratory work intended to hurt [him].”

Despite acknowledging having sex with minors, including young boys in the Philippines, Mr Matzneff was named an “officer of the arts and letters” by the government of President François Mitterrand in 1995. He has won prestigious awards.

In the past, French literary figures have defended him against condemnation, prompting comparisons with Roman Polanski, the film director whose French citizenship protects him from extradition to the United States over a 42-year-old charge of underage sex.

Bernard Pivot, the former host of a TV show about books on which Mr Matzneff became embroiled in a row with another author over underage sex in 1990, said attitudes have changed in France.

“In the 70s and 80s, literature came before morality; today morality comes before literature. Morally, this is progress,” he tweeted.

Paris Public prosecutor to investigate Matzneff for child sex abuse

French authorities have opened an investigation into allegations that the once celebrated author Gabriel Matzneff, who has written widely about having sex with underage partners, raped a child in the 1980s.

The Paris public prosecutor said in a statement on Friday that the inquiry against Mr Matzneff would focus on “rapes committed against a minor” under the age of 15.


Owing to the time elapsed since the alleged events took place, they may fall outside of the statute of limitations meaning they cannot be prosecuted, a person briefed on the investigation said. But the public prosecutor said it intended to open a comprehensive investigation into Mr Matzneff’s sexual history.

Sexual assault lawsuit against Kevin Spacey dismissed after 2nd accuser's death

Actor Kevin Spacey agreed to the dismissal of a sexual harassment lawsuit against him after the accuser died.

(UPI) -- A lawsuit accusing actor Kevin Spacey of sexual assault was dismissed Monday, months after the anonymous massage therapist who filed it died.

"Contrary to some news reports, Mr. Spacey paid no money to 'settle' the lawsuit," Spacey's attorney Jennifer L. Keller told The Los Angeles Times. "The plaintiff's estate simply decided to dismiss the lawsuit with prejudice, meaning it cannot be [refiled] and we agreed to the dismissal."

Monday's action comes after the the plaintiff's son successfully petitioned a probate court in November to become special administrator, The Hollywood Reporter noted.

The plaintiff, identified in court records as "John Doe," had accused Spacey of forcing him to grab the actor's genitals twice during a massage at a private Malibu residence in 2016. The case was filed in U.S. District Court in Los Angeles in 2018 and allowed to continued in May after Spacey objected that the plaintiff's identity was concealed. In September, Spacey's legal team filed a notice of the plaintiff's death.

Court documents filed Monday said attorneys for the special administrator and Spacey "stipulate and agree to the dismissal with prejudice of this action, including all claims stated against all parties, with each party to bear his or its own attorneys' fees and costs."

In October, the Los Angeles County District Attorney's office said Spacey wouldn't face criminal charges in the case.

In July, prosecutors in Massachusetts dropped a different case against Spacey in which he was accused of sexually assaulting a teen busboy in a Nantucket bar in 2016.

Monday's news comes days after another accuser, author Ari Behn, the ex-husband of Norway's Princess Martha Louise, died by suicide.

Millionaire Author John Grisham Says Not All Men Who Watch Child Porn Are Pedophiles

My favourite fiction writer, needs to research child sexual abuse images like he researches his books. He has much to learn on the subject and yet, he makes a good point.

Crime writer John Grisham has said America is unjustly jailing too many citizens for viewing child pornography. In an interview with The Telegraph, Grisham, who earned $17 million last year and tied for 6th place in Forbes' ranking of top-earning authors, attacked the widespread incarceration of those who watch child porn.

"We have prisons now filled with guys my age. Sixty-year-old white men in prison who've never harmed anybody, would never touch a child," he told The Telegraph's Peter Foster in an interview to promote his latest novel, Gray Mountain.

"But they got online one night and started surfing around, probably had too much to drink or whatever, and pushed the wrong buttons, went too far and got into child porn."

Grisham, who is well known for legal thrillers such as A Time to Kill and The Firm, has sold more than 275 million copies since his 1989 debut. Grisham first joined Forbes' top-earning author ranking in 2000, with a $36 million annual paycheck. He has made an estimated $200 million before taxes and fees in the last 14 years.

"I have no sympathy for real pedophiles,” he said, speaking to The Telegraph from his office in Charlottesville, Virginia. "God, please lock those people up. But so many of these guys do not deserve harsh prison sentences, and that's what they're getting."

"There's so many 'sex offenders' - that's what they're called - that they put them in the same prison. Like they're a bunch of perverts... We've gone nuts with this incarceration," he added, citing an anecdote of a law-school pal who he says accidentally viewed porn that was apparently incorrectly labelled as child porn.

John needs to learn that child sex abuse images, or child porn, are not victimless no matter who watches them. Children have to be sexually abused for them to be made, and there needs to be an audience, or clientele, that wants them. There is no shortage of them. Terre des Homme estimated some years ago that there were 750,000 people online at any given moment looking for child porn. That number is almost certainly more than a million right now.

Having done this blog for more than 7 years now, I can tell you that very few people meet the criteria Grisham lays out. Most people arrested for child porn have hundreds, or thousands, or tens of thousands of images and videos. 

But there are a few who may meet Grisham's criteria, and yet, how does one explain watching, or downloading, even one child sex abuse image? Teen victims, I could maybe understand, but prepubescent children are not the least bit sexy except to a pedophile. 

As I have stated many times, sin is progressive. As a Christian, I'm sure John knows that. And, so many times I have presented stories of people who have started viewing adult porn and slowly, or rapidly, progressed to more and more violence, and younger and younger victims. 

With that in mind, the UK, because their prisons were filling up with child porn viewers, has taken the attitude only jailing the worst offenders while putting milder offenders on parole and directing them to get counselling. Some, they sentence to relatively short sentences, if they complete the counselling program. 

It will be a while before we find out if the program is an improvement over long-time incarceration. Certainly, there are many stories where it hasn't worked, but there is no feedback from those on whom it has worked.

It is far better that, in my view, that if we err, we should err on the side of protecting the children. The consequences of child sexual abuse are devastating and often life-long.

Todd Bentley declared ‘not qualified’ for leadership

after review of ‘ungodly and immoral behavior’

A team of evangelical leaders including host of the nationally syndicated Line of Fire radio program, Michael Brown, declared Fresh Fire USA leader Todd Bentley “not qualified” for leadership Thursday after an investigation found allegations of  “ungodly and immoral behavior” against him “credible.”

“Based on our careful review of numerous first-hand reports, some of them dating back to 2004, we state our theological opinion and can say with one voice that, without a doubt, Todd is not qualified to serve in leadership or ministry today,” said the leaders in an official statement shared by Brown on Facebook.

“There are credible accusations of a steady pattern of ungodly and immoral behavior, confirmed by an independent investigator’s interviews dating from 2008 up through 2019, along with other testimonies dating back to 2004. And while we only took into account first-hand reports, there are many other second and third-hand reports repeating the same accusations, often from people in different parts of the country (or, world) who had no connection between them, other than their interaction with Todd,” the statement said.

Other leaders on the panel with Brown were: Joseph Mattera, overseeing bishop of Resurrection Church, Brooklyn, New York, who also serves as convener of the U.S. Coalition of Apostolic Leaders; James W. Goll, founder of God Encounters Ministries in Franklin, Tennessee; Jane Hamon, co-pastor of Vision Church at Christian International in Santa Rosa Beach, Florida; Bishop Harry Jackson, senior pastor of Hope Christian Church in Beltsville, Maryland; and Don Finto, pastor emeritus at Belmont Church in Nashville, Tennessee.

Stephen Powell, an estranged protégé of the popular and controversial faith healer, first highlighted sexual misconduct allegations against the Fresh Fire USA leader last summer that included international encounters.

Powell, who leads the Lion of Light Ministries, alleged that Bentley has a “perverse sexual addiction” that drove him to prey on interns in 2013 and beyond.

He said he got a mandate from God to call wayward Christian leaders to repentance while alleging that Bentley “has an appetite for a variety of sexual sins, including both homosexual and heterosexual activity.” He also accused the evangelist of indulging in an open marriage with his wife, Jessa, and further criticized Bentley’s restoration process stemming from moral failure in 2008.

In their statement Thursday, the religious leaders said as a part of their investigation into the allegations they sought to hear Todd's side directly, “but he declined to answer a list of 60 questions compiled by the investigator after initially agreeing to respond.”

“Todd required the investigator to submit the questions through his attorney, after which he ceased communicating with Dr. Brown or the investigator,” the statement said.

“Sadly, we see no signs of true, lasting repentance. Instead, we see a steady pattern of compromised behavior, including credible accusations of adultery, sexting (including the exchanging of nude pictures or videos), vulgar language, and substance abuse,” the panel said.

“In our view, this disqualifies Todd from public ministry until such time that he has demonstrated true, lasting fruits of repentance, which would include: the breaking of these long-term, sinful habits; public acknowledgment of his sin, without equivocation, including asking forgiveness of those he sinned against; and submission to local church leadership until trust had been rebuilt. This would likely take a period of years,” they continued.

Bentley responded defiantly in a Facebook Live broadcast Thursday, arguing that he does not have a drug or sexual addiction but did admit to texting and sexting. He also noted that he stepped down from his public ministry six months ago and started a private “marketplace” company.

 He also said Brown had promised to exonerate him in the investigation which he called a “sham.”

“Dr. Michael Brown has spun this to be what it wasn’t,” Bentley said while claiming that he was threatened with blackmail prior to the revelations over the summer.

The 2 men who were featured in "Leaving Neverland" who accused Michael Jackson of molesting them as children have just won a huge legal victory ... because a California appeals court has just given them the right to sue for sexual abuse.

A trial judge threw out the cases of James Safechuck and Wade Robson, on grounds they waited too long to file their claim. When they filed their lawsuits, California law did not support their claim, because the statute of limitations required them to file before they turned 26. At the time they filed, Robson was 30 and Safechuck was 36.

But, a new law took effect on January 1, 2020, which allows sexual abuse victims to sue until they're 40. A California appeals court just ruled the new law allows both Robson and Safechuck to have their cases tried -- presumably before a jury.

It's a huge reversal of fortune. Up till now, the MJ Estate has been able to fend off these claims based on the statute of limitations, but that's all changed as of New Year's Day.

Under the ruling, the 2 men can go to trial against MJJ Productions and MJJ Ventures ... and according to the law, they could win if they prove the allegations and show the people who ran the company knew or should have known they were in peril. As for the MJ Estate, there are different rules, and both Safechuck and Robson are barred by the statute of limitations.

Safechuck alleges Jackson abused him hundreds of times when he was a child ... kissing his genitals, rubbing and sucking Jackson's nipples as the singer masturbated and anally penetrated Safechuck with his finger.

As for Robson, he claims the abuse included fondling, kissing, giving and receiving oral sex and one incident in which MJ attempted to engage in anal sex with him.

The folks who manage Jackson's Estate have said all along the claims are bogus and filed by disgruntled former MJ fans who are barred by the statute of limitations. The Estate lawyer, Howard Weitzman, told TMZ in the past he's confident the claims will be dismissed.

Graphic new photos of Jeffrey Epstein’s autopsy have again raised doubt that the wealthy pedophile killed himself inside a New York prison. According to one coroner, Epstein’s injuries are consistent with murder.

Photos shown on CBS’ 60 Minutes on Sunday show the inside of Epstein’s cell, following his death in August. In them, multiple bedsheets have been fashioned into two nooses. A note on the sex offender’s bed gripes about the conditions at New York’s Metropolitan Correctional Center (MCC).

Photos of Epstein’s body show a thin, bloody line across the middle of his throat. According to former New York City Medical Examiner Dr. Michael Baden, who observed the autopsy, the wound is more consistent with murder than suicide.

“This noose doesn’t match the ligature furrow mark. It’s wider than this,” Baden told 60 Minutes. “Most hangings, especially free hangings, the ligature slides up to beneath the jawbone, the mandible. Here it’s in the middle of the neck.”

Epstein’s neck was fractured in multiple places, including the hyoid, a small bone near the Adam’s apple. “I have never seen three fractures like this in a suicidal hanging,” Baden said, adding, “Going over over a thousand jail hangings, suicides, in the New York state prisons over the past 40, 50 years, no one had three fractures.”

His injuries also included bruised wrists, an abrasion on the arm, a muscle injury to the shoulder, an injury to the back of the neck, and a cut on the lip. However, it is unclear if any of these injuries were inflicted by hospital staff trying to resuscitate Epstein.

New York’s chief medical examiner, Dr. Barbara Sampson, ruled Epstein’s death a suicide in August, and stands by that decision. However, that ruling did little to quiet speculation that the millionaire sex offender was murdered. Epstein’s connections to the rich and powerful – including Bill Clinton, Donald Trump, and British Prince Andrew – would likely have been brought up during his trial, leading some to believe that these people had strong motive to silence Epstein.

Epstein had pleaded not guilty to sexually abusing and trafficking multiple girls as young as 14. Back in 2008, a sweetheart deal with Florida prosecutors saw Epstein skate on similar charges, serving just 13 months in a minimum-security facility (and he was permitted to leave during the day for 12 hours, 6 days a week, to go to his office).

Speculation was further stoked when it was revealed that security cameras at the MCC allegedly malfunctioned on the night of Epstein’s death. In addition, two prison guards who were supposed to check in on the high-profile prisoner every 30 minutes have been charged with conspiracy and falsifying records, after it emerged that they slept through their shift on the night.

Only one prisoner at MCC, Philadelphia mobster Louis Turra, has succesfully committed suicide in the last 40 years. Judge Richard Berman, who presided over Epstein’s sex trafficking case, said in November that it was “unthinkable” that an inmate as high profile as Epstein could die behind bars without guards noticing.

Epstein was the only defendant in his case. With his death, the case is shut and the alleged victims denied closure. However, some of the alleged victims still carry on with civil cases against the deceased pedophile’s estate.

Spanish second division team Malaga have suspended coach Victor Sanchez after explicit footage emerged online of the former Real Madrid and Spain star exposing himself. Sanchez has said he is the victim of an extortion attempt.

In the widely-circulated video clip, Sanchez, 43, is seen exposing himself while wearing a Malaga T-shirt. 

The club say they have now moved to suspend the coach while an investigation takes place.

"In relation to the events that have recently been discovered, and which have not as yet been verified, Malaga CF immediately suspends coach Victor Sanchez del Amo from his duties until a full investigation is carried out,” a statement read.

"We will disclose further information once the facts have been clarified."

Sanchez, who has been in charge at the struggling second-tier club since April of 2019, claimed he is the victim of an extortion attempt.

“I wish to inform that I am the victim of a crime against my privacy through harassment and extortion,” he said on social media. 

"The matter is in the hands of the police and I am following their instructions…

“Sharing intimate content of any person without their consent is a crime, whether on social media or in any other way, according to Article 197 of the criminal code.

"There are sentences for those who share personal content without the consent of the affected person.

"Thanks for your understanding and support," he added.

That version of events did not seem to sit well with club owner Abdullah Al Thani, who tweeted a poem-like message on Tuesday night suggesting he was skeptical of Sanchez’s explanation.

A former right midfielder, Sanchez enjoyed a playing career which began at Real Madrid, helping them to win the Champions League in 1998.

He then left for a spell at Racing Santander, before spending seven years at Deportivo La Coruna and then having a stint in Greece with Panathinaikos.   

He began his coaching career as an assistant at Getafe, later taking his first head coach role at former club Deportivo. He then spent less than two months in an ill-fated spell as boss at Olympiacos in Greece, before taking over at Real Betis and then Malaga.

Malaga are currently 16th in the Segunda Division, just one point above the relegation places.
