Fear persists 10 years after Delhi gang rape and murder

Ten years ago the brutal gang rape and murder of a young woman on a Delhi bus horrified the world and shone a spotlight on high rates of sexual violence in India.

, 23, and a male friend boarded a bus on the evening of December 16, 2012.

Savagely attacked, tortured with an iron rod and dumped at the roadside, Singh survived long enough to identify her attackers, earning herself the nickname "Nirbhaya" -- "fearless".

But the student died from her injuries in a Singapore hospital 13 days later.

It sparked huge protests that forced authorities to promise to do more to protect women. In 2020 four of the six attackers -- one died in jail, another was a juvenile -- were hanged.

The juvenile, who was arguably the worst torturer, doing things I refuse to even describe here, served 3 years and was given a sewing machine and a shop to run. He should have died with his demonic friends for the incredible pain he caused and the horror he committed.

But a decade after the assault many women are still scared to travel at night in India's capital, a sprawling metropolis of 20 million people.

AFP talks to the victim's mother, the chief police investigator at the time, an activist, and a young woman commuter.

- The mother -

"Obviously the pain doesn't go," Singh's mother Asha Devi told AFP.

"She was in so much pain during the 12 to 13 days that she was alive," she said in her modest two-bedroom Delhi home.

"How can anybody do this to another human being? Because my daughter struggled to even breathe."



Since the attack Devi has become a prominent campaigner on women's safety, counselling survivors' families, helping their legal battles and protesting for justice.

The 57-year-old, who with her husband has set up a fund for rape survivors, sits next to a glass cabinet full of mementos of their daughter and awards for their efforts.

"My daughter's suffering gave me the strength to fight this battle," she said.

The case led to tougher punishments for rapists, more CCTV cameras and street lights, and safety marshals on some buses.

There are now also centres for rape survivors for legal and medical help.

But Devi said that sexual assaults remain all too common and that "nothing has changed" when it comes to seeking justice.

"If any incident happens, either the parents are blamed or the girl. No one questions the boy or talks about his mistake. 'Why was the girl out at night?' they ask.



"There are still so many cases, such horrific cases," Devi said. "I don't think anyone is afraid of the law."

And, apparently, there is no fear of God in India!

India registered 31,677 rape cases last year, an average of 86 a day, according to the latest official criminal statistics -- a near-13 percent increase on 2020.

Who knows how many thousands of cases were not registered. Police in many areas are still reluctant to register an FIR in rape cases.

In a patriarchal society, daughters are often considered a burden thanks to the persistence of the dowry tradition. In rural areas, where 70 percent of Indians live, the problem is deeper.

Girls who wear jeans, use mobile phones or go out with boyfriends are often seen as sexually permissive. Life for lower-caste girls and women is particularly dangerous.

The excuse often used by Jyoti's rapists and murderers was that she was out after dark and accompanied by her boyfriend, therefore she deserved to be raped and beaten. She was 23 years old.

"The change has to come first in society and families so that daughters are considered as daughters and not a burden," Devi said.

- The cop -

The chief police investigator in the case -- herself a woman -- interviewed Singh in her hospital bed.

"She understood that she had been hurt and that she would have a limited time to survive," said Chhaya Sharma, now 50.

"Don't spare them," Singh, whose attackers had left 13 bite marks on her body, told her.



"The way she was interacting with me was very confident, despite the pain and trauma she was going through," Sharma said. "She was very determined about the fact that she wanted these persons caught."

The policewoman, who has gone on to become joint commissioner of police for Delhi's eastern district, hugged her mother and promised her she would get justice for her daughter.

Often, rapists and victims are known to each other. In this case, "you're looking for a needle in the haystack".

"Out of 370 buses, we had to find the correct bus," Sharma told AFP. "We were walking a very tight rope and a very thin line."



Sharma said that when the attackers were arrested, they showed no remorse.

Of course, they felt justified in their actions, as I explained above.

"I felt that they did it without even feeling anything. That was the sickest part."



The case was a watershed moment, she said, insisting Delhi should not be seen as a "rape capital".

But sexual violence has remained a major issue, she said, and women still need to take precautions.

Sharma's own daughter is now studying in college, and she "knows what she has to do" to try to protect herself from danger.

Hopes were high in 2012 that women's safety would improve, said Yogita Bhayana, an activist with the People Against Rapes in India (PARI) organisation.

"I really thought this might be the last case, that Nirbhaya might be the last case," Bhayana told AFP.

"But unfortunately this did not happen and we kept getting cases and things were very slow, (legal) procedures were very slow. Even till today, every single day our helpline gets five or six similar cases," she said.

- The passenger -

Lashita is a 19-year-old student who declined to give her full name. About to get the metro home after dark from central Delhi, she said does not feel safe on the train and uses the women-only carriage.



"Groping is the new 'good afternoon' in the metro," she told AFP. Women have to be careful "because men are not going to stop", she added.

Travelling late "really bothers my parents because they obviously have safety concerns in mind," she said.

"Maybe I am delusional enough to believe that nothing bad could happen to me, but it's a sad reality that everyone has to be careful."

The answer to my question at the top - not much!  Nothing will change until men start standing up for women and children against paedophiles, rapists, and murderers. I don't see anything like that happening, do you?

‘No right to privacy from the opposite sex’: 13yo girl
takes school trans inclusion rules to UK High Court

Some British schools are trying to be more accommodating to trans students at the expense of others, a 13-year-old has alleged in court documents. She says their guidelines go against girls’ desire for privacy, dignity and safety.

The new Trans Inclusion Toolkit released by Oxfordshire County Council last February instructs that students should have access to toilets, changing rooms, dorms and similar spaces, in accordance with the gender they identify as.

A 13-year-old girl has challenged the rules, saying the council never bothered to ask non-trans students like her how they felt about them. “Under these guidelines I have no right to privacy from the opposite sex in changing rooms, loos, or on residential trips,” she said in legal papers filed with the High Court in London on Thursday.

The pushback against the controversial drive for greater trans inclusivity in British schools comes with the backing of a group called Safe Schools Alliance. It is being brought to court by several parents and a teacher on behalf of the girl, who was not identified for legal reasons.

The guidelines on gender-restricted spaces are aimed at offering all students – trans and non-trans alike – the most comfortable environment. Girls like the plaintiff, who don’t want to share a restroom or a dormitory with a biological boy, regardless of their gender identity, are supposed to be given separate arrangements.

Unbelievable! Make separate arrangements for normal kids and allow the trans kids to do anything they want! Crazy!

This ideal world expectation, however, does not always correspond to reality when it comes to the implementation of inclusivity rules. Some girls at Deanesfield Primary School in west London, for example, were ambushed with new unisex bathrooms containing poorly designed cubicles upon returning after a summer break. Rather than suffer the embarrassment, they simply stopped using the toilets.

Conservative activists see the drive for greater transgender acceptance at British schools as nothing but a leftist crusade that puts virtue signaling ahead of the wellbeing of children, including those encouraged to transition by the adults and their policies.

There is also concern that some of the students would declare themselves transgender frivolously – out of mischief, or to follow a fad – rather than due to a genuine gender dysphoria. The worst-case scenario would be boys gaining access to girls-only spaces to bully, or even sexually assault, them.

Hyderabad: Marri Srinivas Reddy, who was found guilty of abduction, rape and murder of three minor girls was sentenced to death by a special fast track court in Telangana.

SVV Natha Reddy, first additional district and session judge of Nalgonda, indicting Srinvas Reddy under various sections of Indian Penal Code and the Protection of Children from Sexual Offences Act, sentenced the convict to death.

While the offences were committed in Sitapur village of Yadadri district between 2015 and 2019, police arrested him in April last year. The proceedings of the case were completed in less than three months.

The court pronounced its judgement after examining 101 witnesses and forensic evidence.

The prosecution had alleged that 29-year-old Reddy had lured minor girls. While two of the victims were raped and murdered, the third was killed as she resisted his attempts to outrage her modesty.

This is the third case of rape and murder in the state in which the fast track courts have awarded death sentence.

Reacting to the judgement state’s senior minister K Taraka Rama Rao expressed his satisfaction over the fast track courts swift judgement in sexual offence cases.

“Within a span of six months, fast track courts in Telangana have delivered justice in three ghastly crimes against women. All five accused have been sentenced to capital punishment. Kudos to the law and home department officials and judiciary who have toiled hard to ensure quick justice”, Rama Rao said.




Pakistan National Assembly passes resolution calling for public hanging of child sexual abusers


The National Assembly on Friday passed a controversial resolution calling for the public hanging of convicts found guilty of murdering and sexually abusing children with a majority vote.

The resolution was moved by Minister of State for Parliamentary Affairs Ali Muhammad Khan and passed by all lawmakers, except leaders of the Pakistan Peoples Party (PPP).

PPP leader and former prime minister Raja Pervez Ashraf spoke against the decision and said the intensity of the punishment will not result in the reduction of such crimes.

He further stated that public hangings violate the laws of the United Nations (UN) as Pakistan is a signatory of the UN Convention on the Rights of the Child.

That's remarkable! Using the UN Convention on the Rights of the Child as an excuse to not hang child sex abusers and murderers! That makes no sense!

Minister for Science and Technology Fawad Chaudhry took to social media and strongly condemned the resolution.

“This is just another grave act in line with brutal civilisation practices, societies act in a balanced way barbarianism is not answer to crimes…… this is another expression of extremism,” he wrote.

Another remarkable comment! Raping and murdering children is barbarianism; tolerating such acts and protecting the rapists and murderers is closer to barbarianism than meting out justice to such evil people.

Human Rights Minister Shireen Mazari also took to the micro-blogging website and clarified that the resolution passed was not a ‘govt-sponsored resolution but an individual act’, adding that she also opposes the decision.

Referring to the improved security situation in the country, the minister lauded the effort of all relevant stakeholders.

The minister of state for parliamentary affairs maintained that several steps have been taken to protect the youth from any kind of abuse, including the establishment of a child protection centre in the federal capital and ratification of laws such as the Zainab Alert, Response and Recovery Act.




Kerala To Set Up 28 Fast Track Courts For
Rape, Child Sex Abuse Cases
With 12,000 cases pending in the state

Kerala minister KK Shailaja said the decision to set up the special courts has been taken in the wake of rising cases of violence against women and children.

Thiruvananthapuram: Kerala has sanctioned the setting up of 28 fast track courts for speedy trial in rape cases and other cases registered under the Protection of Children from Sexual Offences (POCSO) Act.

State Social Justice and Women and Child Development Minister KK Shailaja said the state government has decided to set up POCSO courts to ensure that the culprits get the punishment they deserve. She said the decision has been taken in the wake of rising violence against women and children.

"The Union Law Ministry has recently sanctioned the opening of 28 POCSO fast track special courts in Kerala at the request of the state government. The project will be implemented jointly by the High Court, Law and Home Departments under the leadership of the Department of Women and Child Development," the Minister said.

The four courts are alloted in Thiruvananthapuram district, three in Thrissur and Malappuram districts, two each in Kollam, Kottayam, Idukki, Ernakulam, Palakkad, Kozhikode and Kannur districts.

The Minister informed that POCSO courts are jointly established by the central and state governments and according to the High Court data, 12,234 POCSO and rape cases are pending in the state.




Pakistani court suspends corporal punishment for children ‘in good faith for their benefit’

А court in Pakistan has suspended until further notice a penal code article that activists say allowed teachers to physically punish students.

On Thursday, the Islamabad High Court suspended Section 89 of the Pakistan Penal Court,  (court, or code?) which deals with the power parents, teachers, and legal guardians have over children. The section in question says that “Nothing which is done in good faith for the benefit of a person under twelve years of age… is an offence by reason of any harm which it may cause.”

The decision came as the result of a petition by famous pop singer and human rights campaigner Shehzad Roy, who set up an organization for education reform.

He argued that Section 89 is an “unconstitutional colonial-era law” that allows the use of violence in order to discipline students. This provision has drawn criticism from human rights groups in the past, since the problem of corporal punishment remains persistent in Pakistani schools.

In 2017, Pakistan’s Sindh region adopted a law protecting children from being subjected to corporal punishment in all types of schools, as well as at work and in care centers. Several bills tackling corporal punishment of minors have been introduced in the nation’s parliament in recent years.

Roy’s lawyer told the court that his plea was partially inspired by the death of a student last September. A teenager in the city of Lahore was allegedly beaten to death by a teacher for failing to memorize a lesson.

Section 89 has been suspended until further notice. The government now has until March 5 to reply to Roy’s petition.




'My name is Karly': Sex trafficking victim joins police on front lines in battle against exploitation

Durham Regional Police operate in several communities in eastern Greater Toronto Area (GTA).

Karly Church, 31, escaped the dangerous world of domestic sex trafficking when a police officer found her in a hotel room, and her two traffickers were arrested.

Six years later, Church now works as a crisis intervention counsellor with Victim Services of Durham Region, east of Toronto. She also teams up with Durham Regional Police detectives in the field to help underage girls and young women caught up in the heinous crime.

"I want to instill hope," Church says. "I want them to see that there is a way out, and there is the ability that they can reach any goal that they have for themselves. That you don't have to be stuck, that there are people who care."

Human trafficking is a fast-growing crime in Canada and one of the most difficult to beat.

According to Statistics Canada's latest figures, reports of the "most serious violation" of laws around human trafficking soared from a couple of dozen across the country in 2010 to 340 in 2016.

And, of course, those are only the ones they know about.

StatsCan adds that, "human trafficking is difficult to measure, due in part to its hidden nature. While there has been an increase in the number of human trafficking incidents reported by police in recent years, human trafficking remains highly underreported."

The majority of reported cases are in Ontario, and 93 per cent of the victims are female. Approximately 72 per cent of female trafficking victims are under the age of 25, and can be as young as 12 years old.

And the conditions police find victims in can be horrific.

"There are incidents with girls getting waterboarded, eating their own feces, being brutally raped," says Detective Dave Davies, who runs the Durham Regional Police Human Trafficking Unit.

"The hardest ones are the ones that are young — the young ones that have never had sex before and they lose their virginity to some John, or they end up getting pregnant. Those are real scenarios that we've dealt with."

The Durham Regional Police are one of the first in Canada to work directly with a human trafficking survivor, and they say Church is their secret weapon. With six detectives attached to the Human Trafficking Unit, most of them undercover, the police have nicknamed her Number Seven.

I wonder how she feels about that - being named after the phenomenally attractive 'Seven' from one of the Star Trek series?

"She's a part of our team," says Detective Davies.

The collaboration between the Durham Regional Police Unit and Victims Services of Durham Region is about building relationships and trust with the victims. Church and Davies say it's working.

Since Church got involved, the number of local police investigations has doubled and so has the number of victims she is supporting. In 2018, Victim Services of Durham Region helped 120 human trafficking victims, and in 2019 that jumped to 240.

This is an excellent idea and Durham Police are to be congratulated for implementing it. So many victims of sex trafficking are rescued but then end up back on the streets because it's the only thing they know, or the easiest way they can think of to make a few bucks.

Officers immediately launched an inquiry with the suspect arrested and released under investigation while inquiries continue.

Detectives have contacted over 100 families whose children would have attended the nursery during the investigation period. It is understood around dozen families may have been directly affected.

Acting Detective Chief Inspector James Stock said: “On July 29 police received an allegation of a serious sexual assault at Jack and Jill Childcare in Torquay.

“A suspect was arrested on the same date and later released on police bail with strict conditions.

“As part of this, over 250 hours of CCTV from within Jack and Jill Childcare have been reviewed.

“As a result of CCTV inquiries, a number of children aged two years and over have been identified as potential victims of further contact offences.




Disgraced Walsall, UK, cop sacked for stealing Carling handed 13-year jail term for child sex offences

A "despicable" former police officer was sacked by the West Midlands force for stealing cans of Carling lager has been jailed for child sex offences.

Ross O‘Grady originally pleaded not guilty to eight charges of sexual assault against three victims between 2014 and 2016.

But the 47-year-old, of High Street, Brownhills, later pleaded guilty to five offences during a trial at Wolverhampton Crown Court. He was sentenced to 13 years in prison and placed on the sex offenders' register for life on Wednesday, October 30.

O’Grady was dismissed by West Midlands Police on June 10, 2016, for gross misconduct relating to an unrelated theft matter. He claimed he had been suffering from post-traumatic stress disorder and needed the cans of Carling for medicinal purposes because he saw “dead babies, murdered bodies and guns in his face” when he tried to sleep.

The police investigation found that some of the offences were carried out while he was a serving police officer. Det Sgt Sam Kirk, from the force's public protection unit, said: "O’Grady’s behaviour was despicable. He held a position of trust and he abused this by committing these heinous crimes.

“I commend the bravery of his victims, it has been an extremely traumatic time for them. There is no place in society for this kind of behaviour and O’Grady must now serve time behind bars."

In spite of admitting more molestations than he can count

A Chatham man convicted of sexually abusing a young boy has been released from prison.

Ronnie Inghelbrecht was sentenced to seven years behind bars in November of 2012 for sexual assault and two counts of possession of child pornography. A 2011 investigation discovered Inghelbrecht was in possession of 68,500 images and 1,246 videos of child sexual abuse that were stored on three computers and media devices. Inghelbrecht was convicted of sexually abusing a boy between May of 1987 and June 1991.

The Parole Board of Canada decided not to release Inghelbrecht early on March 14, 2019 because his risk to re-offend was too high. The parole board said Inghelbrecht had not made enough “progress” because he admitted to attempting to obtain child pornography in 2016 while he was incarcerated and was caught with pictures of prepubescent boys in his cell that had been cut out from magazines and newspapers. He admitted the images were for self sexual gratification.

Inghelbrecht also admitted to the parole board that he was at high risk for reoffending and there were several other victims but he had “no idea how many.” Inghelbrecht himself has previously said he thought it would be best if he remained in prison for the remainder of his full sentence to work on “self-improvement” and “participate in sex offender maintenance programming.”

The 56-year-old Inghelbrecht is a registered sex offender, has a lifetime weapons ban, had to submitted a DNA sample, and is not allowed to have contact with children for the rest of his life.

It is not known where he will be released or if police in that community have been notified that he is a registered sex offender.

Police in Chatham-Kent have been investigating to ensure there are no more victims. Police received new information a few months ago and started another investigation.

Bikie (Biker) attacks child sex offender in watch house

SA Police is reviewing its security practices as CCTV footage of a bikie attacking a child sex offender at the Adelaide City Watch House is posted online.

A watch house is a house containing police holding cells, I think, for children. They have come under shocking criticism recently for violence against children.

Rebels bikie member Bradley Daniele posted the footage to social media of him allegedly attacking child sex offender Hamzeh Bahrami.

Police on Tuesday morning confirmed a 26-year-old man from Mawson Lakes had been reported for the assault which took place at the Adelaide City Watch House in April.

In the footage, a man can be seen showering in a cubicle before he is confronted and assaulted by another man.

After about 20 seconds, a police officer walks into the room and deploys pepper spray into the shower cubicle in a bid to stop the attack.

Police on Tuesday morning said the victim did not require medical treatment and as the matter was before the courts, could not provide further information.

South Australian Police Commissioner Grant Stevens explained how the footage made its way onto Daniele's social media page.

"… I can say we provided a copy of that video footage to his solicitor yesterday, as we are required to do," he told ABC Radio Adelaide.

"So I suppose you can sort of link the dots there in terms of how it found its way to social media. This is the consequence of that, once they have possession of that they're essentially allowed to do with it as they choose."

He said police would now look at reviewing its practices to make sure inmates were not exposed to unnecessary risk. "There is a policy in place that allows for small groups of prisoners over extended periods to shower," he said.

"This would be normal practice, but we are reviewing our practices to make sure we're not exposing people to any unnecessary risk. … we are looking at whether or not there's been any offences committed in uploading footage that depicts what you might call a private act, someone showering."

SA Police Minister Corey Wingard addressed the release of the footage and said it was part of normal disclosure arrangements. "The footage was provided to the accused man's defence team as part of normal disclosure arrangements when a matter is before the court," he said.

"I have been advised that police are investigating whether any crime has been committed in posting the footage online. I condemn violence and abuse of any nature, especially when it's against children."

Alleged victim pleaded guilty to assault on 10yo

The alleged victim of the attack, Hamzeh Bahrami, 33, pleaded guilty to the sexual assault of a young girl in a public toilet in Blair Athol, north of Adelaide, earlier this year.

He faced the Adelaide Magistrates Court in August and pleaded guilty to an aggravated count of indecent assault.

In exchange for the guilty plea, prosecutors dropped two counts of engaging in sexual intercourse with a person without consent, which carries a much higher maximum penalty of life imprisonment.

In May, Bahrami pleaded guilty to another three aggravated counts of indecent assault and one count of false imprisonment in relation to the same incident.

Police have previously said the victim, a 10-year-old girl, had been playing on a playground at a Blair Athol reserve at about 6:00pm on April 3, when she was approached by Bahrami.

They said he lured her into a toilet block and sexually assaulted her multiple times.

'I will do this over and over again'

In a message accompanying the footage on social media, Daniele said he shared the video because he would not stand for the abuse of children.

"One thing I will not stand for is kids being abused physically or mentally and I will do this over and over again if I had the chance," he said in the post.

"I think it's time people stop judging bikies and people start to worry about the real issues in life like getting pedos (sic) off the street.

"I know everyone is not gonna agree with violence but that little girl never had a voice and I'm sure if you had a heart you would do the same thing.

"If I go to jail for this I will not loose (sic) any sleep."

Like Canada, Australia practices minimal incarceration. The consequences are that the perpetrator learns nothing, the victim feels very vulnerable again, and more children are exposed to danger. Daniele's brutal behaviour may be illegal, but, at least it gets the message across that child sex abuse is not tolerable and there will be consequences.




John Allen: UK paedophile care home owner
on trial for sex abuse

A "predatory paedophile" who owned a group of children's homes has gone on trial accused of historical sexual offences against boys in his care.

Mold Crown Court heard John Allen, 78, who ran a number of Bryn Alyn community children's homes in and around Wrexham, had a "longstanding propensity to abuse young boys".

He denies 20 charges relating to eight complainants dating from 1976 to 1992.

The court heard he had two previous convictions for child sex abuse.

Prosecution barrister Eleanor Laws QC said: "The children were often troubled and highly vulnerable and if they did complain they were often ignored or disbelieved.

"Most of them had to learn to live with his prolific abuse but it took its toll", she added.

The jury was shown a police interview with one of the complainants who alleges he was sexually abused by Mr Allen as a child.

"He would take me in his car and drive into some woods where it was dark or pull over," he said. He'd put his hand on your knee and try to put his hand in your pants."

He described how Mr Allen bought him gifts before the alleged abuse began. "He took us to Wrexham town centre and bought a record player and some records. I assumed he was just trying to settle us in."

The complainant said he told people including his mother and a social worker what was happening but nothing ever came from it.

The trial continues.

A drug-affected driver claims he doesn't know how a stash of child sex abuse images were downloaded on his cellphone, but admits they are his responsibility. 

Tristan Abraham, 30, was jailed in May for dangerous driving, driving while disqualified and driving while under the influence of drugs, but it wasn't until later that police uncovered his fixation with child sex exploitation.

In the Palmerston North District Court on Tuesday, Abraham was sentenced to 12 months' intensive supervision after pleading guilty to a charge of possessing objectionable material.

Police searched his car after a collision earlier this year and found eight photographs of girls, aged 9-13, naked or posing in a sexual way, stored on a phone. Another image showed a 10-year-old girl performing a sex act on an adult male. 

Abraham was released from prison on October 23 on the driving charges, and judge Stephanie Edwards said he was at low risk of being found with objectionable material again. 

At a previous appearance, Edwards told the court child sex abuse images were illegal in New Zealand to protect the "sexual safety" of children. Production of this material involved the exploitation of vulnerable children for commercial gain and those who downloaded it fuelled future exploitation. 

Defence lawyer Mike Ryan said Abraham had several phones which were used for a "variety" of purposes, but he denied knowledge of the inappropriate images. "Four or five phones were found by police after the crash. He's accepting responsibility for what was found on the phone."  

Is it usually drug dealers who use a number of cell phones? 

Ryan said his client had obtained a forklift licence and had expressed a desire to stop offending. Judge Stephanie Edwards said Abraham suffered from stress and anxiety, and had an extensive history of substance abuse.

At the time of the car crash, he was using methamphetamine daily. But a stint behind bars had opened his eyes to abstinence, the judge said. "Addiction to methamphetamine has increased rapidly over the past 12 months and was at a peak at the time of the offending." 

Abraham, who had an abusive upbringing, had an untreated brain injury which occurred in a childhood trauma. 

The sentence involves reports updating the judge on Abraham's rehabilitation every couple of months. 




NSW school principal charged with sexually
assaulting nine-y/o girl granted bail

A school principal accused of sexually assaulting a nine-year-old girl has been granted bail in a New South Wales court.

Police arrested the man, aged in his 40s, at a home in the Illawarra region at 4:45pm on Sunday, following an investigation by detectives from the State Crime Command's Child Abuse and Sex Crimes Squad.

The man, who cannot be named for legal reasons, was taken to Wollongong Police Station and charged with two counts of sexual intercourse with a child under the age of 10 and with intentionally sexually touching her.

Police allege the man sexually assaulted the girl on two occasions at homes south of Sydney.

He applied for bail during a brief appearance via video link in Wollongong Court on Tuesday.

Prosecutors told the court they had strong evidence against him, including a letter written by the girl detailing the alleged abuse. The prosecution said she had handed the letter to her mother and it was passed on to police.

They argued he should be denied bail due to the nature of his previous work at a school and his access to children.

Accused supported by family, court told

The man's lawyer, Madeleine Hughes, told the court he has the support of his family, who posted a $40,000 bail surety for his release.

Ms Hughes said the man had "a low risk of reoffending" because if he was found guilty of the allegations, it would be the "end of his career".

Logic and common sense don't ever stop a paedophile from offending! 

His family also agreed to supervise him.

In arguing for the man to be released on bail, Ms Hughes said he has significant community ties, is of prior good character and has several positive testimonials from friends.

Paedophiles are often quite gregarious and very popular in their community. They groom everyone around them into thinking they are stellar people instead of the creeps and perverts they really are.

Magistrate Roger Clisdell said the man does not pose an unacceptable risk to the community and granted him strict conditional bail.

So, Roger, how do you think the little girl he molested feels about him being loose (somewhat) in the community? Why do his rights trump hers? Was the girl represented in the hearing? Apparently not!

He was ordered not to go near a school, playground or childcare centre and is required to report to police daily until he is due to face court again in January.

The school administration the man works for is yet to release a statement or comment on the matter.

Former MP John Hemming wins libel damages from woman branded a fantasist who made unproven allegations of rape and child sex abuse against him

A former Liberal Democrat MP is to receive libel damages from an alleged fantasist who made unsubstantiated rape claims against him.

John Hemming, 58, has scored a major High Court victory against Esther Baker, 36, who has tormented him for four years with unproven claims of child sex abuse.

A judge has barred Miss Baker from trying to uphold allegations of rape and sexual abuse she has made against Mr Hemming in court papers.

Miss Baker insisted her allegations were correct but the judge ruled that her 'denial that her allegations of rape and sexual abuse by the defendant (Mr Hemming) were untrue' should be struck out of the documents. 

Miss Baker, who in 2015 won the crucial backing of Labour deputy leader Tom Watson over her hotly contested child sex allegations, launched a libel action against Mr Hemming claiming he had defamed her, including calling her a 'fantasist'.



The former politician, who has consistently denied her accusations, counter-sued her for defamation, accusing her of 'malicious and deliberate lies'.

In a preliminary court hearing last month both sought to have each other's claims dismissed.

Yesterday Mr Hemming emerged the substantial winner with a ruling by one of the country's senior judges, Mrs Justice Steyn, which could bring the whole set of proceedings to an early end next month.

She said: 'It follows from the decision I have made in respect of the counterclaim that the Claimant (Miss Baker) cannot contend that the Defendant (Mr Hemming) raped her or anyone else, or that he sexually assaulted her or stalked and defamed her to cover it up.'

And the judge ruled that unless, by December 17, Miss Baker amends her reply to the defence filed by Mr Hemming against her claim, her claim will be completely struck out.

She ruled that he was entitled to damages – to be assessed later – on his claim against Miss Baker, a betting shop worker recently made bankrupt. She represented herself in court.

The complex judgment ran to more than 13,000 words. 

Mr Hemming was the member for Birmingham Yardley between 2005 and 2014. 




Rapist-murderer of children to hang in rare case after India’s Supreme Court dismisses appeal

Almost a decade after two men abducted, raped and killed two children in the Indian city of Coimbatore, death sentence passed on the surviving perpetrator got ultimate confirmation by the nation’s top court.

R Manoharan is to die by hanging after the three-judge court dismissed in full on Thursday his petition to review his death sentence. In a 2:1 vote, the court ruled death is more appropriate punishment than a life behind bars for the “shocking” and “cold-blooded” crimes he had committed.

The October 2010 case horrified India with the callous brutality of Manoharan and his accomplice, Mohanakrishnan. The latter, who worked as a taxi driver, abused the trust of the wealthy Jain family, which occasionally used his services when their regular driver was not available.

Mohanakrishnan picked up two siblings, the 7-year-old brother Hrithik and the 10-year-old sister Muskan, ostensibly to take them to school. But the two men, who were both 23 at the time, abducted the siblings for ransom.

But they apparently got cold feet and, instead, decided to get rid of the children, but not before raping the little girl. They then gave them poisoned milk, which failed to kill the siblings, and later tied them up and dumped into a canal, killing the battered helpless victims by drowning.

Both men were quickly identified and arrested, but only Manoharan ever stood before the court for the crimes. His accomplice was shot and killed by the police in early November, when he was brought to the crime scene and reportedly tried to escape.

The surviving killer-rapist was sentenced to death in 2012, and remained on the death row since as his appeals went up the judicial branch. It reached the Supreme Court in August this year.

Capital punishment was kept by India’s penal code after the nation became independent, with the assassin of Mahatma Gandhi and one of his co-conspirators becoming the first to be hanged in 1949. Deaths sentences have only rarely led to executions in the past decades, even less so for crimes not related to terrorism. The only such person to be executed in the 21st century was a convicted rapist of a 14-year-old girl, who was hanged in West Bengal in 2004.
