Newfoundland girl’s disappearance prompts calls for tougher laws to stop abductions




Bouchra Marbouhi says she last saw her young daughter more than two months ago, when the girl left with her father for a routine sleepover.

The five-year-old never came home, she said.

Instead, Marbouhi said she got a series of texts the next day from her estranged husband, her daughter’s father, saying he had taken the child to Egypt. The Canadian Press has viewed the messages.

“I was shocked, I started crying,” Marbouhi said in a recent interview. “I honestly felt like I was dreaming.”

There was a temporary court order in place, forbidding the father from taking his daughter outside of St. John’s, N.L. But it wasn’t enough to prevent her daughter’s disappearance, Marbouhi said.

“I trusted the system to protect (my daughter) and I found out too late that how many gaps are there — no exit checks, no coordination between courts and borders,” she said.

The girl’s disappearance underscores long-standing concerns from women’s groups and family lawyers about the ease with which a parent can take a child to another country without the other parent’s knowledge or consent.

They have called for stronger systems and policies to prevent international abductions, especially for those involving children taken to countries that have not signed onto The Hague Convention, a global agreement aimed at curbing abductions.

“We need to have some kind of red flag system at international borders,” said lawyer Pamela Cross, who is a member of Ontario’s Domestic Violence Deaths Review Committee.

“Because we know that once a child is removed to a country that has not signed The Hague Convention, getting them back from that country is extremely difficult.”

Egypt is not part of The Hague Convention.

Marbouhi said she asked her estranged husband for a divorce many times over the eight years they have been married, but he wouldn’t agree.

It wasn’t until she moved to Canada last year that she found community support in St. John’s, N.L., to help her get away, she said.

In May, a judge with the family division of the provincial Supreme Court granted Marbouhi’s request for an interim non-removal order, saying neither parent could take their daughter out of the jurisdiction. The judge granted the order because they were convinced of “an immediate danger of the child’s removal,” according to documents shared with The Canadian Press.

The document said the judge was not prepared to order who the primary parent was, or whether the child’s father required supervised parenting time.

Marbouhi said they began a schedule in which her daughter spent Friday nights with her father, and came home Saturday. He picked her up as usual Sept. 26. On Sept. 27, Marbouhi said she received the texts saying he’d taken her daughter to Egypt.

She said she immediately phoned 911.

The police went to his house and found it empty, and then confirmed with the airport that he was gone, she said.

The Royal Newfoundland Constabulary said in October it had issued a warrant for Ahmed Mohamed Shafik Abelfat Elgammal, Marbouhi’s estranged husband, on charges of abduction in contravention of a custody order.

The allegations against Elgammal have not been proven.

Attempts by The Canadian Press to contact Elgammal were unsuccessful.

Marbouhi is not a Canadian citizen or a permanent resident, and she is not guaranteed re-entry to Canada if she leaves the country.

“I’m trying to stay strong, but it’s too hard,” she said. “I need her, I need to be with her.”

The Canada Border Services Agency does not require people leaving Canada to speak with an agent the same way they must when they enter the country, said a spokesperson in an email. However, police can issue an Amber Alert, for example, and trigger an “enforcement flag” allowing border agents to stop someone, the email said.

Civil proceedings, such as family court orders, are not typically reported to the agency, said Luke Reimer.

The Royal Newfoundland Constabulary said it did not issue an Amber Alert because the child was already out of the country when she was reported missing. The force is working with “numerous agencies to confirm the safety of the child,” said spokesperson Const. Stephanie Myers in an email.

Cross said better systems of scrutiny should be in place for people crossing borders with children, especially to countries that have not signed on to The Hague Convention.

“It should be, ‘Excuse me, sir, we just have to check with the child’s other parent. Can you and the child please wait here?'” she said. “Everything can be done with great courtesy.”

Anuradha Dugal, executive director of Women’s Shelters Canada, said her organization has long been calling for better coordination between federal and provincial authorities, so documents such as non-removal orders would not just be enforced in their originating province.

“What’s applied in a family law has to jive with what would be expected at the federal level,” Dugal said in an interview.

Women and children are most vulnerable when the woman leaves and takes steps to protect herself and her kids, Cross said. A court order really is just a piece of paper without a larger safety plan backing it up.

“We live in a global world now,” she said. “It’s going to take a collaborative response across all systems to improve the safety of women who do what any logical person would do and turn to the law to protect them.”

Marbouhi said she wished someone at the court — even the judge — had told her that the non-removal order came with little enforcement.

“It’s terrifying,” she said. “Any child can just disappear across borders.”

Egyptian Man Charged with Raping 20-Month-Old Girl to Face Trial

An Egyptian man accused of raping a 20-month-old girl will soon face trial over the charges, according to local media. Prosecutors say the defendant has confessed to the crime.

The man was arrested on Friday after allegedly kidnapping the baby girl on the same day as she played in front of her house in Belqas village, located in the Nile Delta governorate of Daqahliya, Ahram Online reported.

The 35-year-old then took her to a secluded area and raped her, according to investigations conducted by the prosecution. He later fled the scene, leaving her in a pool of her own blood, according to Egypt’s Youm7 newspaper.

The toddler was later found by residents and taken to a nearby hospital where she received emergency surgery for vaginal bleeding. She suffered heavy blood loss, Al Arabiya reported, citing local media.

She was later released from hospital.

The Egyptian prosecution referred the man for trial on Monday evening, according to Ahram Online. However, Al Arabiya said the prosecution has merely ordered a four-day detention for the man, pending further investigation.

The man has reportedly confessed to the crime, according to the prosecution.

Egypt's National Council for Women, Daqahliya branch, issued a statement demanding the maximum penalty for the defendant on Saturday.

Meanwhile, the girl's mother has expressed sorrow following the tragic incident.

"My daughter can’t utter the words mama and papa yet, and all of this has happened to her. My heart is burning and there’s nothing I can do for her,” she said, as quoted by Egypt Independent.

The child's grandfather said that "execution is not even enough" for the defendant.

“I don’t know how a 35-year-old person can do this to a child who is a year and eight months old, who cannot even speak yet and still wears diapers," he said.

The incident has also angered the local community, with Al-Ahram news website reporting that residents of the village had attempted to burn the defendant's house down. Many on social media have demanded nothing less than execution for the man.

The National Council for Women is set to hold a meeting to discuss providing aid to the child and her family.

Police Charge 29 People over Historic Child Sex Abuse in West Yorkshire town

Dozens of people have been charged with the sexual exploitation of teenage girls in a West Yorkshire town after police investigated historic allegations of abuse.

The 27 men and two women have been charged with a catalogue of offences including human trafficking, child abduction, false imprisonment, threats to kill, rape, inciting a child into prostitution, supply of class A drugs and making indecent images of children.

Police today said the allegations against the defendants related to non-recent sexual offences, which took place in the Huddersfield area between 2004 and 2011.

The 18 female victims were aged between 11 and 17 years old at the time the offences took place.

All those charged have been released on police bail and will appear at Huddersfield Magistrates' Court on April 12.

The majority of the defendants are in their late 20s or 30s, with the youngest aged 25 and the oldest aged 55.

All but three of those charged still live in Huddersfield, with the remaining three living in Bradford, Manchester and Dudley.

Serial Child Abductor Eludes FBI as They Seek Public’s Help

A man suspected of kidnapping a 6-year-old in Cleveland in May and attempting to snatch a 10-year-old in Elyria, Ohio, in February continues to baffle the FBI. After receiving hundreds of tips, the agency has no leads and will expand its search.

The FBI has received 325 tips about a man suspected of abducting a 6-year-old girl in Cleveland, but they’ve come up empty-handed, despite splashing the suspect’s picture across social media and advertising billboards.

Last Thursday, the FBI gave out more information about the kidnapping of the Cleveland 6-year-old girl for the first time by acknowledging that she had been harmed by her kidnapper.

"He didn't take her to have a tea party," FBI spokeswoman Vicki Anderson said. "He did things to her that we're not going to go into. But she was harmed. We're happy she's alive but they didn't play Barbies."

The Cleveland girl was held for roughly 17 hours with her attacker. She described the room she was held in as having a picture of a deer on the wall and told authorities that she heard a female voice asking her abductor if he wanted anything to eat.

Anderson said that they do not believe the woman was aware that the child was being held in the home, but it should intensify the search.

"Someone knows him," FBI spokeswoman Kelly Liberti told the Plain Dealer. "Someone was in the house with the girl."

That kidnapping is believed to be connected to an attempted abduction of a 10-year-old girl in northeast Ohio. On February 24, it is believed that the suspect went into the girl’s home and unlocked several doors and windows, the Plain Dealer reported. The next night, he tried to pull the girl out of the window by her legs. She was able to fight off her attacker and ran to her father for help.

A part of the difficulty the FBI has experienced is that they were unable to get a clear image of the suspect. The only pictures of him were taken by a surveillance camera in an alley near the home of the Cleveland girl a week before her kidnapping. The low quality of the image was not helped by the fact that he wore a hat, hood and sunglasses.

A composite sketch was also released, but it “looks like half the guys in Ohio,” Anderson told the Plain Dealer.

They also have photos of his vehicle but were unable to get a license plate number. This leaves the FBI struggling with more ambiguous information that has made finding solid leads difficult. They’ve narrowed the vehicle down to a dark colored 2002 or 2003 Chevy Malibu, but unfortunately that is also not an uncommon car.

The most distinguishable feature on the car is a lighter colored panel on the front driver’s side and an after-market spoiler on the back.

Who puts an after-market spoiler on a Malibu? There can't be that many vehicles that fit that description, and there must be thousands of people who have seen it. The FBI should be focusing attention on that spoiler and a photo of it should accompany the photo of the perv.

Law enforcement has reached out to chop shops and salvage yards to see if anyone had come across a similar vehicle, but they’ve had no luck so far.

There is a $20,000 reward for the abductor’s capture, and the FBI is encouraging anyone with information to come forward before the kidnapper tries again.

"Whoever he is, he's very dangerous," Liberti said. "And he's dangerous to anyone with a child."

Real or Not, Clown Threats are Bizarre and Disturbing

Teens charged with ‘terroristic threats’ after creepy clown abduction posts on Facebook

Four teenagers in Georgia have been charged with making “terrorist threats” after allegedly posting Facebook messages threatening to abduct children while dressed as clowns.

The arrests come in the wake of a craze of creepy clown sightings that have spread fear amongst children and parents alike, and prompted police to establish if any real threat exists amidst the hoaxes. Reported sightings also sparked a spate of school closures.

La Grange police were inundated with calls from concerned parents after a Facebook page, which has since been removed, included threats to dress like a clown and drive around in a white van to nearby schools and abduct children.

Two 18 year olds from Georgia, Steven Goddard and Zaria Dallas, and 17-year-old Tristian Bonner from Alabama were arrested for terroristic threats, according to WXIA. A 16 year old was arrested for terroristic threats and disrupting public schools in relation to the threats.

A series of bizarre and threatening clown sightings have been reported in recent weeks, predominantly in the southeastern states of Georgia, Alabama, Kentucky, and North and South Carolina.

The spate of sightings kicked off at the end of August after it was reported people dressed as clowns were trying to lure children into the woods in South Carolina. Police have warned they will prosecute people behind the Facebook pages and hoax sightings.

An 11-year-old girl was arrested at a school in Athens, Georgia, on Friday for carrying a knife. She told police she needed the weapon to protect herself and her family against the clowns.

Last week, a school in Flomaton, Alabama, was put on a ‘soft lockdown’ after some high school students received threatening messages from a ‘Flomo Klown’ Facebook page.

Police later arrested Makayla Smith, 22, along with two juveniles who were reportedly connected to the page.

Shortly afterwards, another Facebook page named ‘Bingerman Clownferd’ emerged which carried threats to target schools in the Montgomery area.

Meanwhile, Troy Police Department in Alabama said Monday that two teens were arrested in connection with a similar page. No charges were filed but the related Facebook page was removed.

Police say they have been inundated with reports of clown sightings but, in most cases haven’t been able to find the perpetrators. A large number of alleged sightings are believed to be hoax calls.

In Georgia, two people in their 20s were arrested after allegedly making false 911 calls of clown sightings in Hogansville, a city close to La Grange. In Maryland, Annapolis police confirmed Tuesday that reports of clown sightings in the area were made up by children.

Suspicious clowns were also allegedly spotted in Kentucky, with photos emerging on Facebook of apparent sightings.

Whether or not these threats are real, and I'm pretty sure nearly all of them are not, the MO can be copied by real pedophiles who are not above anything that will satisfy their perversion. Consequently, it has to be stopped and stopped quickly. I applaud the police forces for taking this seriously.

'We Beat the Odds': Abducted 6yo Girl Found Alive & Chained to Tree, Man in Custody


A six-year-old girl who was abducted from her North Carolina home has been found alive and chained to a tree. A convicted sex offender has been arrested and charged with first-degree kidnapping.

Police found Steffany Lenneth Lopez-Castro chained to a tree in a wooded area in New Hanover County on Thursday morning, about 2 miles (3.2km) from where she was taken from the driveway of her home the previous night, local CBS affiliate WNCN reported.

After locating the girl, police flagged down a nearby driver, asking if he had bolt cutters. The man gave officers a battery-operated saw to cut the child free.

The child was taken to a local hospital for evaluation and is said to be doing well.

“We beat the odds today, it’s safe to say,” Sheriff Edward McMahon said during a news conference. “We worked tirelessly, relentlessly through the night and I am glad to say, thank the Lord, we found her this morning alive and well.”

McMahon said the community assisted in the successful search and rescue operation, after coming forward with various leads.

Douglas Edwards, a 46-year-old registered sex offender, has been taken into custody and charged with first-degree kidnapping.


Edwards was arrested while riding a moped about 7 miles from the scene on Thursday morning, after being under surveillance for the entire night. Authorities said he did not know the child before her disappearance.

The 46-year-old was convicted of first-degree sexual offense and indecent liberties with a minor in 1996. That victim was also six years old, according to the North Carolina Sex Offender Registry. Edwards spent 16 years in prison for the crime and was released in May 2012.

Madeleine McCann was Probably Not Taken Far, Mother Says

Kate McCann has said she believes that her daughter’s kidnapper did not take her “a million miles” from the Algarve.

Three-year-old Madeleine McCann disappeared from the family’s holiday apartment in Praia da Luz in Portugal in May 2007.


Her mother, who is an ambassador for the charity Missing People, said her research had led her to believe that abducted children were not usually taken far from the scene.

She told the Sun: “That’s where she last was and I don’t think she’s been taken a million miles from there. I’ve always said Praia da Luz is the place where I feel closest to her.”

McCann, 47, of Rothley, Leicestershire, said she and her husband, Gerry, would never give up hope of finding Madeleine.

“The urge to look for Madeleine absolutely hasn’t changed at all. You hear all the time about people who have been missing for years being found. There have been so many cases like that.

“We will never give up. You couldn’t settle if you thought about giving up. I want an end, an answer. Whatever that it is.”

She said child rescue alerts – a scheme of early warning messages that she helped to launch – could have mobilised people at the time of Madeleine’s disappearance.

Praia da Luz, Portugal

Since 2011 the Metropolitan police has been assisting in the Portuguese investigation into Madeleine’s disappearance. The McCanns have previously praised the “meticulous and painstaking work” of detectives, and have again offered thanks to the police.

Last year the number of officers working on the case was reduced. The Home Office said in June that the investigation had cost £10m, with a further £2m budgeted for the year ahead.
