Afghan refugee accused of repeatedly raping 11yo in Germany could avoid trial as he was underage


An Afghan asylum seeker, who has been accused of repeatedly raping an 11-year-old girl in Germany, could be set free as his lawyer maintains the refugee was younger than 14 at the time of the incident and cannot be tried.

The Afghan teenager, identified only as Mansoor Q, is suspected of raping the German girl on several occasions in April and May 2018, together with other asylum seekers. According to the prosecution, Mansoor and an Iraqi, identified as Ali Bashar, who is also on trial over a separate rape and murder case, first assaulted the victim near a supermarket in Erbenheim, a borough of the west German city Wiesbaden.

It is alleged Mansoor Q. once again attacked and raped the same girl together with Bashar’s underage brother in a wooded area in Wiesbaden soon after the first attack. According to the prosecution, the victim was also previously raped by Bashar, 22, in late April 2018, when he locked her in his room in an asylum shelter.

However the Afghan may avoid trial as his lawyer told the court he has evidence his client was under 14 – the age of criminal responsibility in Germany – at the time of the alleged attacks.

“There are some major doubts about his age: we have presented the documents that show Mansoor was actually under 14 years old at the time of the offense,” lawyer Michael Harschneck said, as cited by the German Bild daily.

His argument was dismissed by the plaintiff’s lawyer, Barbara Sauer-Kopic, who said the ID documents presented by the defense were unreliable as they “contradict one another.” She claimed she had a “medicolegal age verification assessment that clearly shows Mansoor was at least 14 years old or maybe even older.”

The legal proceedings against Mansoor are now expected to continue in early April. The German prosecutors demanded the process be held behind closed doors, citing a “special need for protection” of both the accused and his victim.

An open process “could put a stigma [on the accused] and negatively affect his …development,” prosecutor Sabine Kolb-Schlotter said.

"Negatively affect his development"???? Are you serious? He's a serial gang-rapist - what kind of 'development' do you anticipate for this monster? His picture and name should be everywhere to warn little German girls that there are monsters in the streets of Germany. German prosecutors need to start protecting German girls, not the Islamic lunatics who see them only as whores, even 11 y/os, and, as such, they have explicit permission from Mohammed, in the Quran, to do with them as they wish.

‘Key witness’
Ironically, Mansoor is also a “key witness” in another high-profile rape and murder case, which rocked Germany back in 2018.

He helped the German police to find the remains of 14-year-old Susanna F. some twelve days after she went missing and reportedly gave them information about her suspected murderer – his “friend,” Iraqi Ali Bashar.

Bashar was later detained in his homeland by Kurdish security forces after he allegedly attempted to flee Germany with his family. The Iraqi now faces three separate trials as he accused of killing Susanna F., a robbery at knifepoint, and of raping the 11-year-old.

THIS is the moment cops snare a paedo drug dealer in bed with 54,000 sick child abuse images and £160,000 in cocaine cash.

Asim Hussain was arrested after being tracked down by the Internet Child Abuse Investigation Team in Luton, Beds.

Cops began their investigation into Hussain, 32, after receiving a tip off that he was accessing child abuse images.

Officers' bodycam footage then capture the moment they raid the pervert's home in February 2017 - finding him in bed looking at his laptop.

Detectives also discovered drug-related paraphernalia and devices containing the sickening abuse pics.

Cops seized £160,000 in cash and devices which were later found to contain 54,000 sick child abuse 

They arrested Hussain over the images while he and another man, Tahir Abass, were also cuffed on suspicion of supplying cocaine and acquiring criminal property worth £160,000.

Both Asim and Tahir were sentenced to six years in jail while Asim was caged for an additional 18 months for the making and distributing indecent pictures of children.

Abass was not charged with any offences which related to child sex abuse.

Investigating officer Nicky Owen, from ICAIT, said: “Online child sex abuse is not victimless.

"The viewing and sharing of indecent images is a crime which causes real harm and severe trauma to countless children.

“As with many cases, this took an unexpected turn as we uncovered a number of other offences which took the investigation in a completely different direction.

“I’m pleased that through this particular case we are being given a platform to showcase the work we do within our team and will hopefully send a strong message to any would-be offenders that we will do all we can do bring such perpetrators to justice.”

Ms Owen told of the mental trauma she has to endure in her job hunting sordid paedophiles.

She said: "There's not much that shocks me anymore. I've seen the worst things imaginable.”

Ms Owen explained how she’s seen thousands of child abuse and revealed the emotional toll her work has on her and her team.

She added: “There's a particular girl... Her face always pops into my mind. It's just blank and empty and accepting of what's happening. No child should have that facial expression."

A 44-year-old man has been slapped with a three-year eight-month prison sentence after being found guilty of aggravated child sexual abuse and aggravated rape. The offences were found to have occurred between summer and autumn last year.

On Wednesday the Oulu District Court convicted the defendant, Muso Asoev, and said that it based its ruling and sentencing on the trust that the victim -- a 10-year-old child -- had placed in the accused.

OMG! What would the judge have given him if he weren't in a position of trust? 44 weeks? 44 days? A gold watch? For AGGRAVATED RAPE and CSA!!! That's an invitation to rapists across Europe and Asia - come to Finland, we don't mind if you rape our children! Our courts will be very gentle.

The court also ordered Asoev to pay the victim 9,500 euros for distress arising from the offence and an additional 1,500 euros for pain, suffering and other afflictions.

The court said that the trust the child placed in the accused played a role in its sentencing. The man had no previous criminal record.

Other suspected child sex offences
Wednesday's verdict is the first of several cases of suspected child sex abuse under investigation in Oulu that came to light late last year.

At the time police said they suspected eight men of child sex abuse committed over a period of several months. Police said they believe that one of the suspects may have purchased sexual services from a young person.

According to investigators the suspects include Finnish nationals as well as foreigners. They said that the suspects approached their victims online and speculated that some of the suspects and victims knew each other otherwise.

Separately, South Korean police announced the arrests of four people Thursday on suspicion of secretly taking videos of about 1,600 guests in hotel rooms and posting or streaming them on the internet.

The Korean National Police Agency said mini-spy cameras were set up in TV set-top boxes, hairdryer cradles or electrical outlets in 42 rooms in 30 hotels in central and southeastern South Korea.

A police statement accused the men of earning about 7 million won ($8,276 Cdn) in total by posting or live-streaming the video on an overseas-based internet site between last November and early March.

If convicted, the two main suspects could face up to seven years in prison, according to police.

One of the suspects allegedly installed the cameras after entering the hotels as a guest. The other was accused of launching and managing the now-shuttered website. The other two were allegedly involved in buying the spy cameras or funding the internet site's operation, according to police.




Ontario Judge rejects 'sexsomnia' defence

A judge rejected the defence of 'sexsomnia' in a Brockville courtooom on Monday. Justice Moore finds 38-year-old Ryan Hartman guilty of sexual assault. 

The assault stems from an incident in 2011 in which a 30-year-old Ottawa-area woman was raped. 

This is the third trial for Hartman following two appeals. In this new trial, Hartman admitted to the crime, but claimed he has a sleep disorder and has no memory of the incident.

Ryan Hartman has already been convicted of raping the woman seven years ago.

His new defense claims he was sleepwalking and didn't realize what he was doing. That defense is called sexsomnia.  It's been used rarely in Canada but successfully a few times.

The victim says the attack changed her life and she can't move on until she has justice. Her name and identification are protected under a publication ban.

The tattoo on her wrist tells a story; a simple word, “survivor,” that carries a powerful message. “This absolutely horrible thing happened to me,” she says, “but I've overcome it and I’m fighting and I am a survivor.” 

The details are as clear as though the assault happened yesterday.  But it was really in 2011 at a house party in Brockville as the victim, now 30, lay sleeping on an air mattress with her boyfriend beside her.

"We got pretty drunk," she admits, "Our friends encouraged us to spend the night, so they set up air mattress in kitchen."

She says she didn’t want to stay there, so she set her alarm for a couple hours ahead and fell asleep.  Moments before the alarm was to go off, she woke up to a searing pain in her buttocks.

“I had fallen asleep with my arms wrapped around my boyfriend,” she quietly explains, “and woke up in pain and realized I was being assaulted.”

A stranger, who had been at the party, had crawled into bed beside the couple - and began assaulting her. She says she leaped up, turned on the light and saw a man named Ryan Hartman lying on the mattress.

At his first trial, 38-year-old Ryan Hartman denied touching the woman but was ultimately convicted.  He appealed the conviction and lost.  The case then went to the Ontario Court of Appeal with a new lawyer and a new defense called sexsomnia.  A new trial was ordered and the decision was rendered in court on Monday.

“I will never believe he was sleeping when it happened,” the woman says.

For her, this new defense makes her feel re-victimized.  Seven years in, she is still seeking justice.

“It has been hard.  Some days I feel like it ruined my life,” she says, close to tears. She’s become obsessed with time and recently understood why.

“I had set my alarm,” she recalls of the night she was assaulted, “and the assault happened minutes before my alarm was supposed to go off.  If I had set my alarm a little earlier, maybe this might not have happened.”

Sexsomnia is rarely used as a defence in sex assault cases in Canada but there have been acquittals in the past. 

Blair Crew is a professor of law at the University of Ottawa and teaches sexual assault law.

“Sexsomnia is sexual acts that are committed when a person is in a state that is similar to sleep-walking. So, typically a person will claim to have no control or volition over their actions and experience shock when they wake up as to what they are alleged to have done or they have no memory of what they did when they are fully awake.”

Crew says there was a high profile case in Ontario in 2003 involving a gardener in Toronto who relied on this defense.

“He was acquitted initially,” he says, “but the Ontario Court of Appeal sent it back saying the question should have been whether or not this should be classified as a mental illness.  Ultimately the defense was accepted but they found he was not criminally responsible and treated sleep sex as a mental disorder.”

“People unfamiliar with sleepwalking can't believe this defense is actually viable,” he says, “and certainly from this survivor's point of view, there is no question she was raped.”

Blair Crew says there's a concern that this defense will embolden other sexual offenders who believe they too can commit an offence, and then claim afterwards they were sleeping when it happened.




Nova Scotia man charged with making arrangements to commit a sexual offence against a child

Halifax Regional Police have charged a Dartmouth man with making arrangements to commit a sexual offence against a child.

Their investigation begin last July when they received a tip saying a man was communicating with women in HRM in relation to committing the offence.

They say they got a second tip in December about the same man.

On Wednesday, investigators with the Internet Child Exploitation (ICE) Unit searched a home on Dartmouth's Breeze Drive, seized an electronic device and arrested a man.

Samer Elmir, 37, appeared in Dartmouth Provincial Court yesterday.

Anyone with information on child sexual abuse is asked to report it to police at 902-490-5020 or through Cybertip.ca, Canada's National Tip Line for reporting online sexual exploitation of children.

Melbourne woman, 18, charged with child sex abuse and producing child porn after police rescue baby

Police were forced to rescue a baby before charging an 18-year-old with child sexual abuse and pornography offences.    

The woman, from Lalor in Melbourne's north, was arrested by police and charged with using a carriage service to produce and transmit child pornography, and the sexual touching of a child under 16 and sexual penetration of a child under 12.   

The dramatic arrest followed a tip-off from authorities working for the National Crime Authority in the United Kingdom.

The teenager faces a maximum penalty of 20 years behind bars, while the infant was found safe at another premises in Victoria.

Jayne Crossling, the Australian Federal Police Detective Superintendent, dished out high praise to a handful of investigators who worked on the case from the Victorian Joint Anti-Child Exploitation Team (JACET).

'I want to praise the commitment and collaborative effort of the Victorian JACET members who had to deal with this material, and then carry out complex searches and inquiries to identify and locate this woman and infant,' she said.

'Investigators regularly have to deal with the most abhorrent aspects of society, and I can't praise them more highly for what they do in matters such as this.

'In doing so, they significantly alter a child's life by removing them from an extremely harmful and distressing situation.'
