CEDAR CITY, UTAH – After spending nearly a year in jail, Dionna Marie Morton-Wiley received no credit for that time; 5th District Court Judge Keith Barnes on Tuesday ordered the woman to serve a minimum of one year and up to 15 years in the Utah State Prison.
Morton-Wiley, 36, pleaded guilty to two counts of sexual abuse of a child both second-degree felonies.
Barnes sentenced her to the same time for both counts and ordered the sentence be served concurrent, meaning the terms would run together. Arrrgh! Concurrent sentences are absurd!
Morton-Wiley wrote a letter to the court, claiming she accepted “full responsibility” of the charges.
Barnes rejected her plea for forgiveness, ruling Morton-Wiley had “failed” in her role as a mother to protect her child.
“Children are exposed to many different things in their lives. Life is very difficult yet the one sanctuary kids have is that they can be safe in the confines of their own home and they can feel, hopefully, a belief that their mothers are there to nurture them and do what’s best for them and clearly you failed in that department,” Barnes said.
In an emotional plea to the court, Morton-Wiley told Barnes she was sorry for what she had done and recognized she had not protected her child the way she should have.
Morton-Wiley initially faced two first-degree felonies for rape of a child for her involvement in soliciting Terry Joseph Messer to have sex with the 13-year-old victim in trade for payment of utilities in her home where he was staying at the time.
The 13 year old victim is obviously her daughter. She, the daughter, is not named to protect her identity, however, both of her parents are named, her age is given, so how hard can it be to figure out who it is? Civilized countries don't release the name of parents of sexually abused children.
Morton-Wiley, the documents indicate, even bought condoms.
Messer was convicted in February on three second-degree felonies for sex abuse of a child and sentenced to one to 15 years on each count. What kind of sentence is one-15 years? How long will he be in prison, anybody know?
Wiley’s 24-year-old former husband, (remember she's 36) Robert Anthel Wiley, also was convicted for sexually assaulting the same victim. Wiley might be her second husband, since he was 11 years old when the victim was born, so he can't be her father.
He was sentenced on two counts of sexually abusing a minor and ordered to serve a minimum of one year and up to 15 years in the Utah State Prison. There it is again, 1-15, can't they make a decision in Utah?
Wiley also was sentenced previously to up to 5 years in another case where he was found guilty for distribution of a controlled substance, both second-degree felonies.
He originally was charged for three counts of distribution of a controlled substance and later for possession of a firearm but a restricted person.
Wiley was convicted in 2012 for felony burglary charges.
The charging documents report the victim had gone to Morton-Wiley for help and the victim was told to “keep her mouth shut.”
