Convicted child rapist due in court after more alleged sexual offenses in Queens
QUEENS (WABC) -- A convicted child rapist who was paroled two months ago after 18 years in prison is now accused of a string of sexual offenses over the last few days in Queens.
Friday morning, he woke up behind bars yet again and was set to go before a judge.
He's accused of a string of sexual offenses over the last few days in Queens including on Jamaica Avenue for groping a 10-year-old girl and threatening to kill her.
Eyewitness News' cameras were rolling as he was walked by the NYPD out of the 102nd Precinct in Richmond Hill after being formally charged for a handful of offenses in Queens from Monday of this week up until Thursday for lewd behavior.
A previous mug shot shows the suspect from the sex offender registry. It was back in in 2007 when he was arrested for raping a 13-year-old girl and served nearly two decades behind bars.
Garrison had been arrested a total of 13 times.
He's now facing new charges of sex abuse, public lewdness, and acting in a manner injurious to a child.
Man gets 27 years in prison for sexual assault, abuse of child
An Elgin man was sentenced Friday to 27 years in prison for sexually assaulting and abusing an 11-year-old girl.
Jacob Gutierrez, 35, of the 200 block of Douglas Avenue, was sentenced by Kane County Judge John Barsanti.
A Kane County prosecutor asked for a 65-year prison term.
Barsanti convicted Gutierrez of four counts of predatory criminal sexual assault and two counts of aggravated criminal sexual abuse in January. Gutierrez maintains he is innocent. On Friday, Barsanti denied his request to reverse the conviction.
The victim was 11 years old at the time and had an intellectual disability, according to the prosecutor who spoke at the sentencing hearing Friday. The prosecutor submitted a victim impact letter from the girl’s grandmother that stated the girl now has thoughts of hurting herself as a result of the assault.
Gutierrez knew the girl. The assault and abuse started happening in 2018. He was charged in 2023.
The sentence is 24 years for the predatory criminal sexual assault, and he will have to serve 85% before being eligible for parole. Once done with that sentence, he must serve three years for the sexual abuse. He will have to serve at least half of that portion of the sentence. He received credit for the two years he has been in jail since his arrest.
He could have been sentenced to as many as 240 years on the predatory criminal sexual assault charges.
Gutierrez will have to register for life as a sex offender.
He will get out in his mid-to-late 50s, still able to rape little girls. He should have gotten the 65-year sentence.
Man again found guilty of child sex abuse after past non-unanimous conviction overturned
A 53-year-old was once again convicted on sex abuse charges Thursday related to a 2013 case that had to be retried due to a non-unanimous jury decision in the previous trial.
Abinacer was originally convicted on similar charges back in 2014 on an 11-1 jury decision; however, the Oregon Supreme Court ordered that the case be retried.
Who was the one jerk who refused to declare him guilty? They should be investigated.
According to investigators, a mother first reported the case in 2013 when she walked into her daughter’s bedroom to find the girl and Abinacer on the bed.
She took her daughter to the hospital and then to CARES Northwest, where the sexual abuse survivor disclosed that it had been going on for several months.
“The Washington County District Attorney’s Office commends the bravery of the victim in enduring the legal process for a second time,” the DA’s Office said. “This office also thanks the Washington County Sheriff’s Office for its work on this case and the former employees of CARES Northwest who participated in the trial.”
Abinacer is scheduled to be sentenced again on March 27. He previously had been sentenced to 375 months in prison.
Salinas man sentenced to over 22 years for child sex trafficking
SAN JOSE, Calif. —
A Salinas man has been sentenced to 270 months in federal prison for child sex trafficking of multiple young boys, per a federal court document.
Daniel Philip Aguirre, 33, pleaded guilty on Oct. 30, 2024, to conspiracy to commit sex trafficking of a minor, sex trafficking of a minor, coercion and enticement of a minor, distribution of child pornography and possession of child pornography. He was also ordered to pay $19,100 in restitution.
“This defendant preyed on and exploited children and subjected them to nightmare scenarios. We are grateful for the courage shown by these victims in coming forward. Thanks to the work of our federal and state law enforcement partners, Aguirre will spend over 20 years in federal prison for his heinous conduct,” said acting United States Attorney Patrick D. Robbins.
Per the plea agreement, between 2014 and 2017, Aguirre used social media to recruit and entice adolescent boys for sexual exploitation and abuse.
In May 2014, he enticed a 14-year-old into illegal sexual acts with a San Jose child. Amyl nitrates, known as “poppers,” were used to keep the child intoxicated.
Between April and Sept. 2017, Aguirre admitted to sex trafficking another 14-year-old while having an illegal sexual relationship with the child. He also used the victim to make and distribute child pornography, per the plea agreement.
Aguirre admitted to allegations that he sexually abused two other boys online and in person between 2013 and 2015.
Various child sexual abuse materials were found on devices belonging to Aguirre during a search warrant at his home in 2022.
“This individual is the absolute personification of a predator and has cruelly impacted the lives of countless innocent children,” said Homeland Security Investigations San Francisco Special Agent in Charge Tatum King. “This sentencing is the direct result of dedicated HSI agents, in partnership with state and local law enforcement and the U.S. Attorney’s Office, who prioritize a victim-based approach combined with aggressive investigative work and prosecution to remove threats to the children of our community.”
At the sentencing, the government and the Court commended the victim, who initially reported his abuse to the Carmel-by-the-Sea Police Department in 2020. Three other victims came forward to being sexually abused by Aguirre after.
Aguirre was also sentenced to serve 15 years of supervised release and ordered to forfeiture devices containing child sexual pornography that were seized at his home.
