No jail time for man convicted of ‘sickening’ conspiracy to abuse children
A Sudbury man charged with several counts was released with time served after his pre-sentence custody translated to his sentence

A Sudbury man charged with several counts related to child sexual abuse materials was released with time served in Sudbury Superior Court on March 5, after his pre-sentence custody translated to his sentence.
James McGuire, 41, was not only in the possession of child sexual abuse material, but attempted to arrange with two local mothers the opportunity to sexually abuse two young children. He pleaded guilty on Oct. 29.
McGuire has been in custody since March 7, 2021, which equals 1,460 days in custody. Because of the poor conditions at the Sudbury District Jail, each actual day in custody counts as 1.5 days; that translates to 2,190 days, or six years.
OMGosh, it's a wonder they didn't give him a gold watch.
And that is exactly what McGuire was sentenced to, six years. Based on his March 7 arrest date, that meant he was released to the custody of his mother, who was present in court, shortly after court adjourned. McGuire will be living with her in another northern Ontario town.
Though there were 14 counts on the indictment — including further counts of accessing child pornography, possessing child pornography — charges of bestiality and compelling the commission of bestiality were dropped in exchange for James McGuire, 39, pleading guilty in Superior Court to:
possession of child pornography from May 2, 2019, to Feb. 27, 2021;
making child pornography from Oct. 1, 2020, to March 7, 2021;
communicating for the purpose of making arrangements involving minors from Sept. 11, 2019, to Feb. 21, 2021; and
making child pornography from Sept. 11, 2019, to Feb. 21, 2021.
After sentencing submission by McGuire’s attorney, George Fournier, and assistant Crown attorney Matthew Caputo, Superior Court Justice Robbie Gordon told the court, "it's not often I’m somewhat at a loss for words, but the facts and circumstances surrounding the offences are horrific, disgusting and sickening.
“What’s concerning to me, in addition to the full facts of the case, is that the statements that you made in the pre-sentence report indicate that you don’t really have an appreciation for what you’ve done,” said Gordon.
When asked if his appreciation for the gravity of his crimes had changed since the pre-sentence report was created last fall, McGuire stood and replied, “Yes, your honour.”
Fournier detailed the pre-sentence report for the court, created to inform the judge about any mitigating factors in McGuire's life, stating that he had “an unremarkable childhood.”
Though he does not have a strong relationship with his father, the report noted, McGuire is close with his mother. Fournier told the court his client considers himself a “loner,” and began using alcohol at a young age; he said McGuire’s alcohol consumption “played a role in these events.”
In addition to ordering three years probation, “which is as long as we can,” said the judge, McGuire also faces orders requiring forfeiture of all his digital devices and a number of firearms that were seized upon his arrest.
He is required to submit his DNA to the official databank and must register as a sexual offender for life. McGuire must also avoid any areas where children under 16 are likely to be, and can only have approved access to the internet.
He has a no-communication order with the women involved in the case (whose names can’t be revealed to protect the identity of the victims). It is unknown if either of the women have been charged in relation to the case, nor is it known if the children remain in the custody of their mothers, who conspired to let them be abused.
In agreeing to the recommendations, albeit reluctantly, Gordon said both lawyers were “experienced” counsel and have “access to information on this case that I do not (as it was presented in an agreed statement of facts).”
“It’s on the very low end of the range, but certainly in the range,” he said.
He then spoke directly to McGuire.
“I want to enforce on you the importance of participating in this counselling with an open mind to bettering yourself, because without it, you are going to find yourself in jail for many more years,” said Gordon,” you’re going to do untold harm to innocent children, defenceless children who aren’t capable of consent.
“I seriously wonder where you’ll be a few years from now,” said Gordon. “If anything like this happens again, you’re going to do 10 years and up. There’s no coming back.”
Maguire no longer lives in Greater Sudbury. He now resides in Kirkland Lake.
Alberta man facing more than a dozen charges in connection with sexual assault of children
Barrie Police and the OPP were among the police services involved in the Project Steel investigation.
The initiative was part of the Provincial Strategy to Protect Children from Sexual Abuse and Exploitation on the Internet, also known as the Provincial Internet Child Exploitation (ICE) Strategy. Law enforcement agencies worked both proactively and reactively to identify individuals involved in the creation, possession, and distribution of child sexual abuse material. Additionally, victims were identified and safeguarded, with support services provided to those affected.
“This operation demonstrates what can be achieved when law enforcement officers and digital specialists from various fields and locations collaborate in the relentless pursuit of those who prey on the most vulnerable. We will not stop. We will continue to innovate, investigate, and work with our partners to ensure there is no refuge for those who exploit children.”

One of the most notable aspects of the operation was the re-arrest of a repeat violent offender who had previously served a significant prison sentence for sexual offences. Upon analyzing seized devices, investigators discovered evidence of a sexual assault on a child in a public space, along with the online victimization of multiple unidentified children.

Authorities emphasize that combatting child exploitation requires a collective effort. The Provincial Internet Child Exploitation Strategy underscores the crucial role played by parents, educators, child advocacy organizations, government bodies, and technology providers in safeguarding children. Members of the strategy urge all partners and community members to stay informed, remain vigilant, and work together to prevent exploitation before it occurs.

Edmonton man handed consecutive prison terms for possessing child pornography, luring
Judge's decision notes 'concerning issues raised about operations at the Edmonton Remand Centre'
A man caught with hundreds of child sexual abuse images on his cellphone was sentenced Thursday, with an Edmonton judge handing down consecutive sentences for three offences.
Aarron Kowalchuk, who is in his mid-30s, pleaded guilty last year to making sexually explicit materials available to a child, child luring and possessing child pornography.
He admitted that he exchanged messages about sex with a 15-year-old boy and an undercover police officer posing as a 13-year-old girl.
Court of King's Bench Justice Lynn Michele Angotti sentenced Kowalchuk Thursday to more than four years in prison.
He's been in custody at the Edmonton Remand Centre (ERC) since June 2023. He has about 18 months left to serve after enhanced credit for time already spent behind bars, plus three months of credit Angotti applied, recognizing more onerous conditions Kowalchuk faced as a mitigating factor.
The judge underlined the gravity of Kowalchuk's crimes in her decision. Court heard that a sample of the images in his collection showed children, some as young as toddlers, in degrading and sexualized poses.
"I agree with the Crown: Those who possess child pornography share accountability for the hands-on sexual abuse and its devastating impact," Angotti said.
"There are no words, not vile, filth or disgusting, that can describe how despicable child pornography is."

She also referred to a victim impact statement from the mother of a teen boy Kowalchuk communicated with, saying it was a violation that robbed the family of their sense of safety in their own community.
Judge finds 'troubling' parts of time in ERC custody
Defence lawyer Rory Ziv argued that proceedings against Kowalchuk should be stayed because conditions in the remand centre violated his Charter rights.
Kowalchuk took the stand in January and gave evidence about a diary he kept in jail, noting periods where he said he was "thrown in solitary" and days where he was allowed out of his cell for just 30 minutes, or not at all.
Shortly after going to jail, Kowalchuk's name and charges were publicly reported, and he was put into administrative segregation. That meant being placed on higher security unit with no access to the outdoors — just a "fresh air room" with a window and an exercise bike, where inmates get rotating access for an hour of exercise per day.
ERC director of programs Ian Lalonde testified that Kowalchuk needed a more secure placement because inmates charged with sexual offences, especially against children, are "at extreme risk of harm from other inmates.
"In the pecking order, they're right down near the bottom, if not the bottom," he said.
In the pecking order of humanity, they are right there where they belong! They don't deserve to be treated with any more respect.

Lalonde gave evidence that although there were some days Kowalchuk couldn't leave his cell because of operational issues, he was later housed with a group of inmates, and he had more exercise time and "meaningful social contact."
Angotti found that remand centre documentation shows he was typically allowed out of his cell longer than he recorded, and there were valid reasons for times he couldn't leave.
But the judge said parts of his time in custody are "troubling."
She noted that Kowalchuk submitted a written complaint about another inmate assaulting him with a "urine bomb" thrown onto him, and ERC staff responded that the video didn't show the incident.
Lalonde testified that when he reviewed the video before a January court date, he saw that it did, in fact, take place as Kowalchuk described.
Angotti said there's no evidence that there's been an investigation of the staff involved.
"There is no [Charter] breach.... This does not mean there are not some concerning issues raised about operations at the Edmonton Remand Centre."
Ziv said he's pleased with that acknowledgement. "She did give my client credit for harsh conditions," he said.
"Specifically, she called out the Edmonton Remand Centre in this case. There was a failure to document, there was a failure to properly orient my client to conditions at the Edmonton Remand Centre when he first arrived there, and the failure to investigate."
Kowalchuk will be restricted from going to places where children may be present after he gets out of custody, and he'll be on the sex offender registry for the rest of his life.
Edmonton teacher charged with sexual assault, child luring
An Edmonton high school teacher has been charged with sex crimes involving a child.
Dylan James Shott, 32, was arrested on Thursday after police received a complaint that he sexually assaulted a girl between February 2024 and January 2025.
The girl was not one of his students.
Shott has been charged with luring a child, sexual assault, invitation to sexual touching and sexual interference.
He was released on conditions not to have any contact or communication with anyone under the age of 16.
Shott previously taught at M.C. LaZerte High School in Edmonton.
“Edmonton Public Schools is aware of charges laid against a teacher at M.E. LaZerte School. We are cooperating with police as they investigate,” EPSB spokesperson Veronica Jubinville said in an email to CTV News Edmonton on Friday.
“The safety and well-being of students is at the core of our commitment as a school division; it’s a responsibility we take extremely seriously.”
