A 22-year-old Linden man will spend a minimum of 4 1/2 years in state prison and must register as a sex offender for life, Lycoming County court records indicate.
Lynn E. Kyle was sentenced to an aggregate total of 4 1/2 to 9 years in state prison by President Judge Nancy L. Butts on Aug. 18.
Kyle will receive credit for time served from Aug. 19, 2019, to Aug. 17, 2020, court records indicate.
On May 22, Kyle pleaded guilty to one felony count of involuntary deviate sexual intercourse with a person less than 16 years of age, one felony count of sexual abuse of children - child pornography, and one misdemeanor count of indecent assault of a person less than 16 years of age.
State police at Montoursville reported that Kyle engaged in sexual activity with an underage girl in Woodward Township on or about May 26, 2019. Kyle reportedly recorded the sexual acts on his cellphone.
Because Kyle was convicted of involuntary deviate sexual intercourse, a Tier III sexual offense, he must register as a sex offender for life and appear quarterly, according to the Pa. Statutes.
As part of his sentencing, Kyle was assessed by the Sexual Offenders Assessment Board, which determined he was not a sexually violent predator, court records stated. Under state law, sexually violent predators must appear quarterly to register,.
Although Kyle is not a sexually violent predator, he must still appear quarterly as per the requirements of a Tier III sexual offender under the Pa. Statutes.
In a separate case, Kyle pleaded guilty to one misdemeanor count of indecent assault for his involvement in a reported sexual assault in a van in Woodward Township.
State police said that Kyle carried a 19-year-old victim across his yard to a van where he and four other men sexually assaulted her on April 16, 2019.
But he's not a sexually violent predator? Seriously? Good grief! Gang-rape should get him 15 years by itself.
For indecent assault, Kyle was sentenced to three to 12 months in state prison to run concurrently with all other sentences.
Under all dockets, Kyle will not be eligible for the Recidivism Risk Reduction Incentive or boot camp.
A third Lycoming County criminal case charging Kyle with one felony count of materially false oral statement was dismissed.
Because he's such a nice guy?

The Grayson County District Attorney’s Office says Randy Hayes, 40, pleaded guilty to aggravated sexual assault of a child back in June. He was sentenced on Thursday to 50 years in prison.

The girl told investigators Hayes had sexually assaulted her multiple times and gave her drugs.

Cape Cod man admits to having nearly 500 images of
child sex abuse on cell phone
By Jackson Cote | jcote@masslive.com
A Cape Cod man in his 30s admitted this week to having nearly 500 images of child sexual abuse stored on his cell phone, authorities said.
Sean Gleason, who is from Dennis, used a mobile app to exchange hundreds of pictures with other users that showed the sexual abuse of infants, toddlers and prepubescent minors, according to an affidavit from U.S. Attorney Andrew Lelling’s office.
The 36-year-old man was arrested last fall after an investigation into his use of the messaging application showed he had at least 498 of the illegal images and one video of child sex abuse on his phone, the prosecutor said.
“Gleason admitted that he had been into child pornography for at least 6 years and that he views child pornography approximately twice per week,” the affidavit said. “He said that he had tried to quit but was unable to.”
Last September, federal, state and local law enforcement executed a search warrant on Gleason’s home in Dennis, according to court records.
Authorities found Gleason leaving his home, seized the man’s iPhone from his pocket and discovered around 240 images of child sex abuse on the device. A full forensic review of the phone later revealed almost 260 more illegal photographs, Lelling’s office said.
After agreeing to be questioned by law enforcement, Gleason told authorities he shared child sex abuse images with other individuals online, according to the affidavit.
He also admitted to saving or taking screenshots of the illegal pictures and storing them on his phone, court records showed.
Gleason pleaded guilty to charges of receiving and possessing child sex abuse imagery. He is scheduled to be sentenced on Dec. 18.
Both charges call for a mandatory minimum sentence of 5 years and up to a lifetime of supervised release as well as a fine of up to $250,000, according to Lelling’s office.
The case against Gleason was part of Project Safe Childhood, a nationwide initiative started by the U.S. Department of Justice in 2006 to protect children from exploitation and abuse.

Cortland, NY woman charged with child sex abuse
BY SARAH BULLOCK
A city woman was arrested Thursday for sexually abusing two young children while she was caring for them, according to the Cortland Police Department.
Kimberly M. Clark, 39, of 47 Pomeroy St. was arrested at 10 a.m. at the police station at 25 Court St. after an interview with officers, according to the department.
Clark masturbated in front of the children, touched the sexual organs of one child and provided both children with marjuana, said Lt. David Guerrera.
The abuse began on Feb. 24 and continued “until very recently,” Guerrera said. Police were alerted two weeks ago to the sexual assaults occurring at Clark’s home when a family member reported the acts to the Department of Social Services, he said.
Clark told police her actions were meant to teach the children about human sexuality, Guerrera said. “She calls it ‘sex education,’” he said.
All children under Clark’s care are no longer under her supervision, Guerrera said.
Clark was charged with one count of second-degree course of sexual conduct against a child and two counts of second-degree criminal sale of marijuana, felonies. She was also charged with two counts each of forcible touching and endangering the welfare of a child, misdemeanors.
At a virtual arraignment in city court, Clark was remanded to the Cortland County Correctional Facility on $10,000 or $20,000 bond. She was released from jail this morning. Her next court date was not available this afternoon.
Child Protective Services notes some indications that a child is being sexually abused include: injury to the genital area, difficulty or pain when sitting or walking, expressing advanced sexual knowledge or sexual behavior and symptoms of sexually transmitted diseases.
To report suspected child abuse, contact CPS at 1-800-342-3720 or the Cortland Police Department at (607)-756-2811.

Bedford, Va. man sentenced to 25 years on child sex abuse charges
JUSTIN FAULCONER
BEDFORD — A Bedford man was sentenced to 25 years in prison for sexually abusing a child in 2016.
Christoper Lee Carpenter, 25, was found guilty in November 2019 after entering pleas in Bedford County Circuit Court to two counts of aggravated sexual battery and one count each of rape and forcible sodomy.
Bedford Commonwealth’s Attorney Wes Nance said the victim, who was 6 years old at the time of the offenses, told her foster mother about being sexually assaulted by her babysitter.
Male babysitters - Arrrrgh!
Carpenter was sentenced Friday. He has been in custody since his September 2018 arrest.
The victim’s therapeutic foster mother testified at a sentencing hearing the girl suffers from post-traumatic stress disorder, severe anxiety and other issues because of Carpenter. Nance said Carpenter sexually abused the girl on four occasions.
“The reality is we’re here because Mr. Carpenter destroyed a 6-year-old child,” Nance said.
Carpenter took advantage of the child, and she and her family deal with the effects of his crimes each day, Nance said. He argued for at least a 50-year sentence or higher.
While addressing sentencing aspects of the case, Nance said a rape of a child by an adult in her own home adds only one year and six months of punishment, which he added shows how “ridiculous” putting numbers toward criminal behavior is.
“Our victim in this case is going to be in a perpetual cycle of terror each day when this man is released,” Nance said.
Brad Lindsay, Carpenter’s attorney, said his client had a tumultuous upbringing and was sexually abused and physically assaulted during his childhood. Carpenter was introduced to heavy illegal drug use by family members as a juvenile and had no criminal history prior to the charges, Lindsay said.
This is what happens, all too often, when a survivor of child sexual assault does not get any psychological counselling.
Carpenter told Judge James Updike he takes full responsibility and wishes he could go back and change what he did. He acknowledged his actions caused much hurt and pain and he will always live with the regret.
“This case is real bad, it’s real bad,” Updike told the defendant.
Updike sentenced Carpenter to 65 years on the combined charges, suspended 40 years, ordered supervised probation for 10 years upon release and credited time served to go towards the sentence. Carpenter must register as a sex offender, have no contact with the victim and have no unsupervised contact with minors, according to his sentence.
Nance said after the hearing the low end of the sentencing guidelines called for 18 to 19 years. He believes Carpenter’s incarceration should be much more extensive.
“I’m extremely disappointed by the outcome received,” he said.
