A child molester who claimed to have suffered a miscarriage of justice has had his latest appeal thrown out.

Garry Nancarrow exposed boys to alcohol and pornography and told one victim he'd kill his entire family if he ever disclosed the abuse.

Police extradited him from Australia and in 2018 a jury found Nancarrow guilty on six sexual abuse charges. The charges related to the repeated abuse of boys between 1972 and 1986.

Nancarrow was jailed for 4 years and 9 months. He appealed the conviction and has repeatedly protested his innocence.

He went to the Court of Appeal, unsuccessfully appealing his conviction, and then to the Supreme Court. Now the Supreme Court has dismissed Nancarrow's appeal, too.

Nancarrow had argued the trial judge and prosecutor had through error or omission behaved in ways that caused a miscarriage of justice.

He told the Supreme Court the trial judge failed to provide a "relevance and repetition warning" about previous consistent statements from complainants. He argued the prosecutor linked counter-intuitive evidence to the facts of the case.

Nancarrow also claimed the trial judge failed to give the jury adequate directions and said "prosecutorial misconduct" caused a miscarriage of justice.

But in a new judgment, the Supreme Court said Nancarrow was rehashing the same claims he presented at the Court of Appeal.

"The Court concluded that ultimately none of the alleged flaws in the trial, including a number no longer pursued, caused a risk of a miscarriage of justice."

The impact and trauma of Nancarrow's offending was described when he was sentenced after his 2018 Auckland District Court trial.

Judge Nevin Dawson said Nancarrow was known to the families of three male victims, and children were regularly left in his care.

He would manipulate situations to get the boys on their own and sexually abuse them.

One traumatised boy would sleep in a crawlspace under a house to hide from Nancarrow.

Convicted double killer David Tamihere was best man at Nancarrow's first wedding.

The Herald obtained a wedding photograph showing Nancarrow standing beside his best man.

Tamihere was released in 2010 after spending 20 years in prison for the murders of Swedish tourists Sven Urban Hoglin and Heidi Paakkonen.

Tamihere, now in his late 60s, has always denied involvement in the murders.

Sounds like denial is a way of life for these two creeps.




Royal Navy commander awarded MBE by Queen

A disgraced former Royal Navy commander, who was once honoured by the Queen, has avoided jail after being caught on camera by paedophile hunters posing as a 14-year-old boy.

Lieutenant Commander Graham Trewhella, from Gosport in Hampshire, blamed 'loneliness' after being arrested for using dating app Grindr to meet someone he thought was a teenage boy, a court heard.

But when he arrived to meet ‘George’, the 62-year-old was instead greeted by a man from vigilante paedophile hunting group Trap, an online organisation with more than 241,000 likes on Facebook.

Hampshire Police were called by the group and later found more than 1,000 indecent images of children on his computer.

Trewhella was arrested by officers on October 28, 2017, before retiring from his position in the Navy.

Portsmouth Crown Court heard that the father of three, who used his own photos for his Grindr profile, spent two days messaging someone he believed to be a 14-year-old boy called 'George'.

Following his arrest, police found nearly 1,100 indecent images of children on his Dell computer - including 329 of the most severe category - with analysis suggesting searches for the images dated back to 2015.

Trewhella pleaded guilty to charges of attempting to arrange or facilitate a child sex offence, attempting to engage in sexual communication with a child, and three charges of making indecent images.

Prosecutor Nicholas Hall told the court the disgraced naval officer at one point said he wanted 'maybe (sex) later'.

Mr Hall said: 'The person posing as George made it plain that he was only 14 and asked whether the defendant would be happy with that and he said that he was.

'This went on for certainly two days.'

In a video uploaded to Trap's social media pages, a shocked Trewhella stands in a hat and grey Rab coat, and is challenged by a man who tells him: 'You've thrown your life away'.

Struggling for words, Trewhalla replies: 'I don't do anything outside' and 'I wasn't going to do anything'. 

When he later spoke to probation, Trewhella admitted his actions were 'absolutely wrong' and 'unbelievably irresponsible'. 'When I look at what I've done now it horrifies me - I'm incredibly remorseful.'

Trewhella had been named on the New Year's honours list in 2009 for services to the Royal Navy. 

In mitigation, Phillip Allman told the hearing that Trewhella's three children had remained supportive of their father.

He added that his actions came as 'a result of loneliness' after splitting with his wife 15 years ago, saying: 'This is the most remarkable stain on his character. It's something he will ultimately have to live with for the rest of his life,' Mr Allman said. 

Sentencing, Recorder Simon Levene handed him a 17 month jail sentence suspended for two years, commenting that putting him behind bars would do 'nothing towards his rehabilitation'.

Mr Levene said: 'You are deeply ashamed and very, very embarrassed - not just at being caught but at what you realise you've been up to over the last few years.

'I accept that this is a case where I can suspend the sentence because I think that you fall into that category of offender who can be helped.'

He added that in jailing him there was a risk that sex criminals in prison could make him an even worse offender. 




WA man charged over allegations of bestiality and child sex abuse

Police will allege they made a sickening discovery involving animals on the hard-drive of a man who’d been arrested over horrific child sex allegations.

A 35-year-old man has been charged over allegations of bestiality and child sex abuse as part of an ongoing investigation in Western Australia.

The man was initially charged in December with offences allegedly linked to two boys, aged between seven and eight, from 2019 to 2020.

The man was charged with 11 counts of indecently recording a child and five counts of indecently dealing with a child.

Police also allege at the time of his arrest he possessed an external storage device, which was subsequently analysed.

“Analysis of the device by technology crime squad identified a number of images and recordings containing child sexual offences,” police said in a statement on Monday.

He has now been charged with a further 26 offences including two counts of carnal knowledge of an animal, 11 counts of indecently recording a child, five counts of indecent dealing with a child, three counts of possessing child exploitation material and one count of sexual penetration of a child.

The man is scheduled to face Bunbury Magistrates Court later on Monday.

He was charged following a joint operation between the child abuse squad and the joint anti child exploitation team.




Victorian nurse’s registration cancelled over child abuse material

A nurse who posed as a 12-year-old girl to engage in sexual chat and send depraved child abuse images on social media has had his registration cancelled.

Edgard Ramirez, 33, has also been banned from working at any health service where he has access to or contact with children for five years.

Posing as a 12 or 13-year old girl called “Angel”, Ramirez engaged in sexual chats with other social media users and sent child pornography images to them about 75 times, the Victorian Civil and Administrative Tribunal (VCAT) was told.

His crimes were undone when Australian Border Force officers stopped him at Melbourne Airport after a short trip to the United States in November 2018 and found more than 1000 files with child abuse videos and pictures on his phone and iPad.

More than 200,000 image and video files were also found stored on his iPad accounts, with more than 5000 found to be child pornography files.

The material depicted acts of children in solo sex acts, sex acts between children, children with adults, sadism and bestiality, with the victims ranging from newborn babies to 15 year olds.

“The acts involving children were utterly cruel, depraved and shocking,” VCAT senior member John Billings and members Mary Archibald and Pamela Barry said in their ruling on Friday.

“Some children appeared to be under the influence of drugs or alcohol while others were crying or otherwise in apparent distress.”

VCAT members described the acts depicted as ‘utterly cruel’ and ‘depraved’.

Ramirez pleaded guilty to importing, accessing and distributing child pornography and was jailed in Victoria’s County Court in February last year for three years.

He must serve at least one year and nine months before he is eligible for release on a good behaviour bond. He was also placed on the sex offenders register for life.

Ramirez trained as a nurse in his native Philippines and did further training to work as a nurse in Australia. He was granted a visa enabling him to re-enter Australia in 2018 and worked at a regional Victorian hospital as a surgical nurse.

He was granted permanent residency but his visa was cancelled following his conviction. It’s likely he’ll be deported after completing his sentence.

The VCAT members said although it was not suggested Ramirez engaged in criminal conduct in any professional workplace, his conduct was nonetheless very serious and breached the nurse’s code of professional conduct, which recognised vulnerable people, including children, must be protected from sexual exploitation and physical harm.

“Even if Mr Ramirez is to depart Australia in the foreseeable future, we intend that our determinations will deter him from reoffending,” the members said in their judgment.

Is there some way to make sure his determinations follow him wherever he goes?

“But we also intend that our determinations will deter other nurses from such conduct in the interests of maintaining professional standards and public confidence in the profession.”




Doncaster, UK man jailed for sex offences against young girl

A man has been sentenced to 14 years in prison after being found guilty of a string of sexual offences against a young girl.

At his sentencing Judge Sarah Wright, paid tribute to the girl's courage to come forward and protect others saying her evidence was 'utterly compelling.'

Lloyd’s abuse was uncovered when the girl confided in a close friend, who informed teachers at their school and a report was made immediately to South Yorkshire Police.

DC Becky Breakwell, who led the investigation said Lloyd has always denied the allegations and showed no remorse.

Despite being so young, Lloyd’s victim has always provided a very clear account of his perverse actions towards her. She suffered over a period of three years, feeling unable to tell anyone what was happening. “Lloyd has always denied the allegations against him showing no remorse for the devastating impact this has had on his victim, instead insisting that his actions were innocent play.

DC Breakwell continued: “It is critical that all victims of child sexual abuse feel that they can speak out and talk about what has happened to them. We will investigate all reports and have specially trained officers and partners who can offer the right help.

The victim has shown exceptional bravery and this conviction, which will ensure others are kept safe, would not have been possible without her continued strength and resolve.”

The victim is currently receiving support from the Doncaster Rape and Sexual Abuse Counselling Service (DRASACS).

Lloyd, of Broxholme Lane, was jailed at Sheffield Crown Court and will be subject to the sex offender register for life.
